ACCIDENT WAIVER, RELEASE OF LIABILITY, and PHOTO RELEASE

I acknowledge that this event may be an extreme athletic test of a person’s physical and mental limits with the potential for serious injury, property loss, and death. Risk factors include, but are not limited to, terrain, facilities, temperature, weather, condition of the athletes, equipment, vehicular traffic, actions of other people including but not limited to, participants, volunteers, spectators, coaches, event officials, event monitors, and producers of the event, and lack of hydration. These risks are inherent to athletes and are also present for volunteers.

I assume all risks of participating or volunteering in this event. I realize that the injuries and risks above may arise from negligence or carelessness by the persons or entities listed here, and from dangerous or defective equipment or property owned, maintained or controlled by them or because of their possible liability without fault. 

I certify that I am physically fit, have sufficiently trained for participation in this event and have not been advised otherwise by a qualified medical person. I acknowledge that the Accident Waiver and Release of Liability form will be used by the event holders, sponsors and organizers, and that it governs my actions and responsibilities at this event. In consideration of my application and permitting me to participate or volunteer in this event, I am acting for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows: 
(A) I Waive, Release and Discharge from any and all liability for my death, disability, personal injury, property damage, property theft or actions of any kind which may happen to me including my traveling to and from this event, THE FOLLOWING ENTITIES, ITS OFFICIALS, EMPLOYEES, AGENTS AND VOLUNTEERS:  Accusplit Inc, The Rotary Club of Pleasanton North, The Pleasanton North Rotary Foundation, Rotary International, City of Pleasanton,  Zone 7 Water Agency, and event volunteers;  
(B) I Indemnify and Hold Harmless the above persons and entities from any and all liabilities or claims resulting from my presence at this event, whether caused by negligence or otherwise.  I accept full and sole responsibility for any and all medical expenses that I may incur due to any injury, accident and/or illness I suffer due to the event. I understand that I may be recorded. The event holders, producers, sponsors, organizers and or assigns may use my photo, video, name or film likeness for any purpose related to the event. I understand I am waiving financial recovery from injury, accident and negligence and releasing liability for the listed persons and entities to the maximum extent permissible by law. 

By clicking on Accept Waiver and Complete Registration, I certify that I am 18 or older; I have read this ACCIDENT WAIVER, RELEASE OF LIABILITY, and PHOTO RELEASE; I understand its content; and I have the authority to sign for the participants I have registered. I consent to the use of my email address for communications with respect to this and future events and that I am responsible to notify all persons with respect to this event.
