FORR/Reading Lions 5K Participant Release of Liability and Assumption of Risk In consideration of being allowed to participate in any way in the FORR/Reading Lions 5K Road Race, related events, and activities on July 18, 2024 (“FORR/Reading Lions 5K”), and the benefits to be derived therefrom, I, the undersigned, acknowledge, appreciate, and agree that: 1. In this document, “the Releases” are: Friends of Reading Recreation and Reading Lions Club (the organizers of the event), its officers, officials, directors, agents, representatives, and employees; New England Timing, its officers, officials, directors, agents, representatives, and employees; sponsoring agencies and their officers, officials, directors, agents, representatives, and employees; supporting agencies and their officers, officials, directors, agents, representatives, and employees; sponsors; supporters; advertisers; volunteers; other participants; the Town of Reading; and, if applicable, owners and lessors of premises and/or equipment used to conduct the event; 2. There are many risks and dangers associated with running in this event, including, but not limited to, slips, falls, contact with other participants, collisions, the effects of weather (including, but not limited to, cold, heat, rain, and snow), the effects of traffic and surface road conditions, actions and inactions by others participating in the FORR/Reading Lions 5K, and negligence and human error by the Releases and others. I fully understand and acknowledge these risks and dangers, both known and unknown, and knowingly and voluntarily assume full responsibility for them, whether or not covered by my personal health or other type of insurance; 3. The risk of injury and loss from participation in the FORR/Reading Lions 5K is, as it is for any sporting event, significant, and includes, but is not limited to, serious bodily injury, permanent paralysis, disability, impairment, and death, as well as property loss and damage. I fully understand and acknowledge these risks, both known and unknown, and knowingly and voluntarily assume full responsibility for them, whether or not covered by my personal health or other type of insurance; 4. I attest and verify that I am physically fit and have sufficiently trained, and am sufficiently fit, for this event; 5. I, on behalf of myself and my heirs, assigns, transferees, personal representatives, next of kin, executors, and administrators, hereby release, waive, forever discharge, and agree not to sue, the Releasees from any and all liability, claims, demands, damages, actions, or rights of action of whatever nature or description, in equity or at law, present or future, resulting from or relating in any way to the FORR/Reading Lions 5K and with respect to any and all injury, disability, impairment, death, loss, or damage to person or property, whether arising from the negligence of the Releasees, or otherwise, to the fullest extent permitted by law. Simply put, neither I nor any of my heirs, assigns, transferees, personal representatives, next of kin, executors, or administrators, will sue the Releasees, or try to hold them legally or financially responsible, for any harm, injury, or death that might relate to taking part in the Run for Healing. This release is intended to be the maximum and broadest release permitted by law; 6. I, on behalf of myself and my heirs, assigns, transferees, personal representatives, next of kin, executors, and administrators, hereby indemnify, defend, and save and hold harmless, the Releasees from and against any present or future claim, cause of action, loss or liability for injury to person or property, which I may suffer or for which I may be liable to any other person, related to my participation in the FORR/Reading Lions 5K, resulting from any cause whatsoever (including, but not limited to, negligence by the Releases), and regardless of fault. In addition, to the extent that the Releases feel it reasonably necessary to take action due to any delay by myself and my heirs, assigns, transferees, personal representatives, next of kin, executors, and administrators to properly carry out our obligations under this section, we shall promptly reimburse the Releases for all reasonable costs and expenses incurred by the Releases, in taking such action including but not limited to, reasonable attorney’s fees; 7. I will comply with any and all rules and instructions for the FORR/Reading Lions 5K. If, at any time, I determine any condition to be unsafe, I will immediately remove myself from that situation; 8. I understand that photographs and digital images, and video, digital, and audio recordings, may be taken of me, my image and likeness, my name, and my voice, in connection with the race. I hereby consent to the taking and publication of such photographs, images, and recordings, and grant full use of them, and my name and voice, for any lawful purpose, including but not limited to news reports and event promotions; 9. I am at least eighteen years of age and have carefully read and freely sign this Participant Release of Liability and Assumption of Risk. I understand and agree that no oral or written representations can or will alter the contents of this document. I, on behalf of myself and the Minor Child, and our heirs, assigns, transferees, personal representatives, next of kin, executors, and administrators, hereby release, waive, forever discharge, and agree not to sue, the Releases from any and all liability, claims, demands, damages, actions, or rights of action of whatever nature or description, in equity or at law, present or future, resulting from or relating in any way to the FORR/Reading Lions 5K and with respect to any and all injury, disability, impairment, death, loss, or damage to person or property, whether arising from the negligence of the Releases, or otherwise, to the fullest extent permitted by law. In the event that immediate medical or dental, or other emergency, care is needed and I cannot be reached in a reasonable amount of time, I authorize the Releasees to make decisions, including but not limited to, transportation to emergency medical facilities, to care for the Minor Child. I will be responsible for all fees and expenses that are incurred; 9. I understand that photographs and digital images, and video, digital, and audio recordings, may be taken of me and of the Minor Child, of our images and likenesses, and of our names and our voices, in connection with the Run for Healing. I hereby consent to the taking and publication of such photographs, images, and recordings, and grant full use of them, and of our names and voices, for any lawful purpose, including but not limited to news reports and event promotions; 10.
