In consideration of you accepting this entry, I, the participant, intending to be legally bound do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against the Event Director, RunSignup.com, and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.

I know that running a road race is a potentially hazardous activity. I should not enter and run unless I am medically able to do so and properly trained. I assume all risks associated with running in this event including, but not limited to: falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims which I might have based on any of those and other risks typically found in running a road race. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any race official relative to my ability to safely complete the run. I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event and that a licensed Medical Doctor has verified my physical condition.

In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.

As it applies to my participation in this race, I agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC’s guidance at: https://www.cdc.gov/coronavirus/2019-ncov/prepare/prevention.html. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the community or by this race for my participation in this race.

Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.

This event follows the standard running industry policy: All entry fees are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable and bib numbers are non transferable.

By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver including the no refund policy.

I, in myself, do hereby acknowledge and agree that participation in any activities and programs comes with inherent risks. I have full knowledge and understanding of the inherent risks associated with any activity or program participation, including, but in no way limited to: (1) slips, trips, falls, and other injuries, and (2) illness, including exposure to, and infection with, viruses or bacteria. Coronavirus, COVID-19 is an extremely contagious virus that spreads easily through person-to-person contact. Federal and state authorities recommend social distancing as a mean to prevent the spread of the virus. COVID-19 can lead to severe illness, personal injury, permanent disability, and death. Participating in TOWN OF PARKER programs or accessing TOWN OF PARKER facilities could increase the risk of contracting COVID-19.  The TOWN OF PARKER in no way warrants that COVID-19 infection will not occur through participation in its programs or while accessing its facilities.
 
In consideration of my, and/or my child’s, participation in TOWN OF PARKER activities and programs, I, as the parent/guardian of the minor(s) named below, agree to release and on behalf of myself and the minor(s) named above, our heirs, representatives, executors, administrators, and assigns, HEREBY DO RELEASE THE TOWN OF PARKER, its officials employees, volunteers, agents, instructors, contractors, representatives and insurers (“Releasees”) from any causes of action, claims, or demands of any nature whatsoever which I, the named minor(s), our heirs, representatives, executors, administrators and assigns may have, now or in the future, against the TOWN OF PARKER on account of personal injury, property damage, illness, death or accident of any kind, arising out of or in any way related to the use of its facilities or participation in its programs.  In consideration of my, and/or the named minor(s)’, participation in TOWN OF PARKER activities and programs, I, the undersigned on behalf of myself and/or as the parent/guardian agree to INDEMNIFY AND HOLD HARMLESS Releasees from any and all causes of action, claims, demands, losses, or costs of any nature whatsoever arising out of or in any way related to my, and/or the named minor(s)’, activity and program participation.
 
I hereby certify on behalf of myself and the named minor(s) that I have full knowledge of the nature and extent of the risks inherent in any activity and program participation and that I, on behalf of myself and the named minor(s), am voluntarily assuming said risks. I understand that I, and the named minor(s), will be solely responsible for any loss or damage, including personal injury, property damage, illness, or death, the named minor(s) sustain while participating in any activities and programs and that by signing this agreement I, on behalf of myself and the named minor(s), HEREBY RELEASE Releasees of all liability for such loss, damage, or death.

Town of Parker Waiver of Liability and Release
I, the undersigned participant/parent or guardian of the participant, recognize and acknowledge that activities with the Town of Parker Parks and Recreation Department involve risk of serious injury, including permanent disability or death, and severe social and economic losses which might result from participant action, inaction, negligence of others, rules of play, or the condition of the premises or any equipment used thereon. Further, I understand that there may be other risks not known or reasonably foreseeable at this time and that such risks shall be assumed by the undersigned.
I authorize the employees of the Town of Parker and the instructor or coach of my (my child’s) team/activity to call for emergency rescue services for me (my child) should they be necessary in the case of injury or suspected injury, or during the times that the above named individual is participating in an activity sponsored by the Parker Parks and Recreation Department. I authorize the attending physician at the hospital to administer necessary emergency medical care to the above individual upon arrival at the hospital. I will accept responsibility for the payment of any and all treatment provided therein including emergency rescue services.
I certify that I am capable of participating safely in Town of Parker Recreation Department programs. I understand that the Town of Parker does not provide accident, health, or life insurance coverage for participants during program participation.
I further understand that I am legally responsible for actions of the above named individual including, but not limited to, any damage to private or public property. I am legally responsible for my own and/or my child’s welfare and actions including personal needs and medical expenses.
I agree to indemnify and hold the Town of Parker, its officers, agents, consultants, and representatives harmless from any loss, damage, or injury which may result from my or my child’s participation in activities sponsored by the Town of Parker Parks and Recreation Department. This release of liability and indemnity applies equally to losses, damages, or injuries caused or alleged to be caused in whole or in part by the negligence of the Town. I further agree to release, waive and discharge, and covenant not to sue the Town for any claims, demands, or actions whatsoever arising out of any damage, loss, or injury incurred on or to me or my child as a result of my participation or my child’s in activities sponsored by the Town. This release of liability and indemnity applies to me, the undersigned, or my child, as well as any personal representatives, assigns, heirs and next of kin.
Finally, I give my consent to use any photographs or videotape taken of me (my child) while participating in any Town of Parker Parks and Recreation Department program in future promotional or marketing materials.
I have read and fully understand the effect of the relinquishment of the rights that I hereby waive.
