Waiver

I agree that as a member of South Coast Roadrunners (hereinafter “SCRR” or “the club”), I know that running in and volunteering for organized group runs, social events, and races associate with the club are potentially hazardous activities, which could cause injury or death. I will not participate in any club organized events, group training runs or social events, unless I am medically able and properly trained, and by my signature, I certify that I am medically able to perform all activities associated with the club and am in good health, and I am properly trained. I agree to abide by all rules established by the club, including the right of the club’s board to deny or suspend my participation for any reason (including but not limited to not following club rules; rude, disrespectful, offensive, or harassing behavior; cheating in a race; etc.). I attest that I have read the rules of the club and agree to abide by them. I assume all risks associated with being a member of the club and participating in all club activities, which may include but no limited to: falls, physical contact with other participants/members, volunteers, race personnel, contract service providers, employees, and spectators including the potential the contraction of a communicable disease resulting from contact with other participants/members, volunteers, race personnel, contract service providers, employees, and spectators. I assume all risks including: the effects of the weather, including high heat and/or humidity or cold temperatures; traffic; the conditions of the road, bike path, sidewalk, or trail; and the conditions of the surrounding terrain. I further agree to abide by the Center for Disease Control’s (CDC) recommendations for the prevention of the spread of the 2019 Novel Coronavirus Disease (COVID-19) and other communicable diseases, and I attest to having read the CDC’s guidance at: https://www.cdc.gov/coronavirus/2019-ncov/prepare/prevention.html. I assume all such risks being known, appreciated, and accepted by me. I know that running and volunteering in club runs and races are potentially hazardous activities. I should not enter and run in club activities unless I am medically able and properly trained. I assume all risks associated with running in club activities including, but not limited to, falls, contact with other participants, the effects of weather, including high heat and or humidity, the conditions of the road, bike path, or sidewalk, all such risks being known and appreciated by me. In connection with the submission of this application and in consideration of being permitted to join South Coast Roadrunners, I, on behalf of myself, my spouse, and heirs, hereby RELEASE, WAIVE, DISCHARGE AND COVENANT NOT TO SUE SCRR, its officers, agents, sponsors, members, or volunteers and the Road Runners Club of America from all liability to the undersigned, for any loss or damage, and/or any claim or demands therefore on account of injury to my person or property, whether caused by the negligence of the releasees or any third party while I am participating in any event organized, hosted or sponsored by the releasees. I further expressly agree that this RELEASE AND WAIVER OF LIABILITY is intended to be as broad and inclusive as is permitted by the law of the State of California and that if any portion thereof is held invalid, it is agreed that the balance shall continue in full legal force and effect. In addition, I acknowledge the contagious nature of COVID-19 and other communicable diseases and voluntarily assume the risk that I may be exposed to or infected by COVID-19 and/or other communicable diseases by participating in any activities associate with the club. I acknowledge that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. I understand that the risk of becoming exposed to or infected by COVID-19 in connection with my participation in any club activities, and personally assume this risk. I grant permission to all of the foregoing to use my photographs, motion pictures, recordings or any other record of the club for any legitimate purposes. I understand that the club does not provide for refunds in the event of cancellations of services, and by signing this waiver, I consent that I am not entitled to a refund if the any club activities including events are cancelled. My signature indicates (1) that I have read, understand, and agree to this RELEASE AND WAIVER OF LIABILITY, including the SCRR safety guidelines below, (2) that I have voluntarily signed this RELEASE AND WAIVER OF LIABILITY, and (3) that no oral representations, statements or inducement apart from that set forth in this written agreement have been made to me. SCRR SAFETY GUIDELINES All SCRR members and guests should be aware of these guidelines to ensure everyone’s safety on club runs. - Runners are advised to run on the sidewalk or bike path at all times. Per the City of Irvine Municipal Code Ordinance number 192: Pedestrians are prohibited from proceeding along a bicycle path or lane where an adjacent adequate pedestrian facility exists. - Obey all traffic laws. Do not cross a street against a red light. - Wear a reflective vest, light or reflective clothing when running at night. Carry a light if running on an unlit course. - Carry emergency identification and phone numbers at all times. Do not leave an injured (or otherwise stopped runner alone). - Know the route, or run with someone who does and be courteous to other runners, walkers, roller-bladers, bikers, and of course, drivers. - Share the path. Run on the right side of the bike path and allow room for bikes to pass in both directions. - Carry adequate water, particularly during long runs, trail runs, and in warm weather. - Do not wear headphones during club runs and be alert at all times. - Bicycles, skateboards, baby joggers/strollers, roller skates, and inline skates are not recommended in club organized runs.
