Waiver

The undersigned, being of lawful age, does hereby, and for his/her heirs, executors, administrators, successors and assigns, release, waive, acquit and forever discharge the City of Bakersfield, its Mayor, Council, officers, agents and employees, Active Bakersfield Alliance, including its board of directors, board members and advisory board members, Bakersfield College, Kern Community College District and its trustees, officers, employees, volunteers and agents, Kern County Museum and its trustees, officers, employees, volunteers and agents, and Mercury Events LLC from any and all claims, actions, causes of action, rights, damages, costs, expenses and compensation whatsoever, which the undersigned may hereafter accrue, on account of or in any way growing out of any and all known and unknown, foreseen and unforeseen bodily and personal injuries, death, or property damage, resulting from or relating in any way whatsoever to the undersigned’s participation in the Bakersfield Marathon. 

It is further understood and agreed that all rights under Section 1542 of the Civil Code of California and any similar law of any state or territory of the United States are hereby expressly waived. Said section reads as follows:

1542. Certain claims not affected by general release. A general release does not extend to claims which the creditor does not know or suspect to exist in his/her favor at the time of executing the release, which if known by him must have materially affected his/her settlement with the debtor.

In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.

As it applies to my participation in this event, I agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC’s guidance at: https://www.cdc.gov. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the community or by this race for my participation in this race.

Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.

EXHIBITOR BOOTH AGREEMENT

In consideration for the right to occupy space and be an Exhibitor at the Bakersfield Marathon Healthy Living Expo at the Kern County Museum, 3801 Chester Avenue, Bakersfield, 93301, exhibitor agrees to be bound by the following terms and conditions. 

EXPO: Exhibitors may enter the premises for the purpose of exhibit booth set-up beginning on Saturday, March 29th, 2025 starting at 6:00am. Set-up of exhibit booths must be completed no later than 9:00am. Exhibit booths must not be dismantled or removed before the close of the Expo on March 30th, 2025 at 4:00pm. In the event an exhibitor violates this close provision, the exhibitor may be excluded from participation in future expos. Exhibits must be removed no later than 7:00pm (the time between close and booth removal/dismantle is hereinafter referred to as the “Break Down Period”).

EXHIBITOR BOOTH PLACEMENT: Consideration will be given to the Exhibitor’s needs; however, final booth placement is at the discretion of Bakersfield Marathon Admin. Placing advertising materials or equipment, or soliciting in the aisles or any area other than the space allotted to an Exhibitor is strictly forbidden. No Exhibitor shall obstruct aisles, common areas, or the neutral space between the exhibit booths with his/her goods or in any other manner. All exhibits must comply with local fire department regulations and any and all other applicable governing authority’s law, regulations, and/ or rules and may not contain a popup tent. All aisles must be kept clear as required by local fire codes.

SPECIAL REQUESTS: The use of audio and/or video equipment is not a right, and Bakersfield Marathon Admin reserves the right to determine that an Exhibitor’s use of audio and/or video equipment constitutes interference with other Exhibitors and must be discontinued.

TRANSFER OF SPACE: Your booth is solely for your use and may not be subleased to any individual or shared with another vendor. The distribution, display, introduction (verbal or otherwise) of literature, pamphlets, advertisements, displays and/or materials of any form whatsoever for a non-paying Exhibitor is strictly prohibited. Bakersfield Marathon Admin reserves the right to police and enforce this policy.

FESTIVAL AREA AGREEMENT

In consideration for the right to occupy space and be an Exhibitor at the Bakersfield Marathon Finish Line Festival at the Kern County Museum, 3801 Chester Avenue, Bakersfield, 93301, exhibitor agrees to be bound by the following terms and conditions.
