RIDE ALONG AGREEMENT & LIABILITY WAIVER
In registering for the “Ride/Run” with Saint Joseph’s Center, it is important that you are aware of, understand (by carefully reading) and acknowledge the liability waivers provided below, which can affect your legal rights with regard to your participation in the Ride Along. The Ride Along is organized, promoted, and/or managed by Saint Joseph’s Center (the “Organizer”).
It is important that you are aware that any physical activity which you participate in, including the Ride Along, can potentially be very challenging and thus lead to injury, illness, and discomfort and in some cases even death. Accordingly, it is vital that you consult with your physician(s) before embarking on any vigorous activities. The Organizer cannot advise you on your ability to participate in the Ride Along.
You, as a participant in the Ride Along, agree, on behalf of yourself and all persons who you have registered, to accept all risks associated with biking, running or walking, in the Ride Along and agree to hold Saint Joseph’s Center, Saint Joseph’s Center Foundation, Saint Joseph’s Center Auxiliary, the City of Scranton, Lackawanna County, The Lackawanna Heritage Valley National and State Heritage Area, Anthracite Bicycle Coalition Association, Scranton Running Co., Groove Brewing, RiverView Winery, McGrath's Pub & Eatery, The Cycle Yard, Susquehanna Brewing Company, and each of their past, present, and future predecessors-in-interest, successors-in-interest, attorneys, agents, representatives, partners, officers, directors, employees, insurers, reinsurers, third-party administrators and all other persons, partnerships, corporations, firms, associations and other legal entities with whom any of the foregoing have been, are now or may hereafter be affiliated (collectively, the “Released Parties”) harmless of and from any liability in the event of any injury, which may or may not lead to death to yourself or any participant under the age of 18 who you registered and bear total responsibility. You, on behalf of yourself and any participant under the age of 18 who you have registered, hereby release and forever discharge the Released Parties from any and all claims, demands, causes of action, claims for relief, obligations and liabilities of whatever kind or nature, whether known or unknown, suspected or unsuspected, whether at law or in equity, which you hold or own or may hereafter acquire, by reason of any acts, occurrences, transactions, omissions or transgressions relating to the Ride Along.
You hereby acknowledge that you are aware of the risks involved in participating in the Ride Along, which gives you and those that you register, the ability to participate whenever, wherever, and however you choose. You certify that you are of good physical health and conditioning and pose no danger to any other participants, due to any pre-existing medical conditions.
You will not hold the Released Parties responsible or liable for your choice of venue which may result in injury or death to self or damage to your personal property or someone else’s property. In the event of injury, you agree to be responsible for any medical or legal fees incurred in participating in the Ride Along. The Organizer reserves the right to cancel the Ride Along due to any Act(s) of God (an Act of God is a legal term for events outside human control, such as sudden natural disasters, for which no one can be held responsible).
You hereby permanently grant the Organizer permission to record your voice and to photograph of you in conjunction with the Ride Along. You understand and agree that the term photograph as used herein encompasses both still photographs and video recordings. You further grant the Organizer permanent permission to use your photograph, voice, and likeness taken in conjunction with the Ride Along, in any form. You further waive any right of inspection or approval of any such recordings and photographs. You understand that any such recordings and photographs recorded by the Organizer shall become the sole property of the Organizer.
By registering for the Ride Along, you are affirming that you have read this Agreement and fully understand its terms. You understand that you and all registered parties are giving up substantial rights, including the right bring legal claims against the Released Parties. You acknowledge that you are entering this Agreement freely and voluntarily and intend, by your acceptance, to be bound by a complete and unconditional release of all liability to the greatest extent allowed by law. If the participant is a minor or incapacitated adult, you certify that you are the participant's parent or guardian and agree to this waiver and release from liability on behalf of the participant. You warrant that you are of legal age and legally competent to execute this agreement and accept full responsibility therefore. If any provisions of this Agreement or the application thereof to any person or circumstance is held invalid or unenforceable to any extent, you acknowledge and agree that the remainder of this Agreement and the application of those provisions to other persons and circumstances shall not be affected thereby and those provisions shall be enforced to the greatest extent permitted by law.
