RUNSIGNUP Waiver
In consideration of you accepting this entry, I, the participant, intending to be legally bound do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against the Event Director, RunSignup.com, and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.

I know that competing in TOUGH BUCK is a potentially hazardous activity. I should not enter and run unless I am medically able to do so and properly trained. I assume all risks associated with running in this event including, but not limited to: falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims which I might have based on any of those and other risks typically found in running a road race. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any race official relative to my ability to safely complete the run. I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event and that a licensed Medical Doctor has verified my physical condition.

In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.

As it applies to my participation in this race, I agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC’s guidance at: https://www.cdc.gov. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the community or by this race for my participation in this race.

Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.

This event follows the standard running industry policy: All entry fees are non-refundable. The non-refundable entry fee is solely for participation in the event and no part of the entry fee is consideration for the drawing, which is open only to participants of the event and not to the general public. The Event Director reserves the right to postpone or cancel the event due to circumstances beyond the Event Director’s control, such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. The Event DIrector reservesthe right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable and bib numbers are non transferable.

By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver including the no refund policy.

PARTICIPANT INDEMNIFICATION AGREEMENT AND RELEASE

READ THIS PARTICIPANT INDEMNIFICATION AGREEMENT AND RELEASE (THIS “AGREEMENT”) CAREFULLY BEFORE SIGNING. THIS AGREEMENT HAS LEGAL CONSEQUENCES AND WILL AFFECT THE PARTICIPANT’S LEGAL RIGHTS AND WILL ELIMINATE THE PARTICIPANT’S ABILITY TO BRING FUTURE LEGAL ACTIONS.  THE UNDERSIGNED PARTICIPANT IS REFERRED TO HEREIN AS “THE PARTICIPANT” OR “I”.

Assumption of Risks:  TOUGH BUCK is meant to be a test of toughness, strength, stamina, and mental endurance in potentially challenging and hostile environments.  Participants should consider TOUGH BUCK a hazardous activity, and by signing this Agreement I acknowledge and agree that my participation in TOUGH BUCK carries with it inherent risks of physical injury, including, potentially, permanent disability and death, presented by both the environment and other participants, many of which risks cannot be eliminated, regardless of the care and precautions taken by MTNTOUGH Inc. (“MTNTOUGH”) and MDF/BDF, Mule Deer Foundation/Blacktail Foundation a 501(c)3 organization (“MDF”) and its directors, officers, employees, agents, contractors, insurers, spectators, co-participants, equipment suppliers, and volunteers, and all TOUGH BUCK event sponsors, organizers, promoters, directors, officials, property owners, and advertisers, and representatives of any of the foregoing (collectively, the “Released Parties”).

By executing this Agreement, I acknowledge that I understand that it is my responsibility to consult with my personal physician prior to my participation in TOUGH BUCK to ensure that such participation will not pose any unusual risks to my health and well-being, or the health and well-being of other participants.

By executing this Agreement, I acknowledge and fully accept the inherent risks of my participation in TOUGH BUCK and agree that I am willingly and voluntarily participating in TOUGH BUCK, and, having read this Agreement and other materials provided by the Released Parties, if any, that I: (1) understand the nature of TOUGH BUCK; (2) understand the demands of this activity relative to my physical condition; and (3) understand and accept potential injuries that may result from participating in TOUGH BUCK, the risks of all of which I assume and accept, and for which I take full responsibility, on behalf myself, as well as my spouse, children, parents, guardians, heirs, next of kin, and any legal or personal representatives, executors, administrators, successors and assigns, or anyone else who might claim or sue on my behalf (collectively, the “Releasing Parties”).  This release shall survive the completion of TOUGH BUCK.

Waiver of Liability: In consideration of being permitted to participate in TOUGH BUCK, I, on behalf of myself and the Releasing Parties, hereby forever waive, release, covenant not to sue, and discharge the Released Parties from any and all claims resulting from the ordinary or gross negligence of any of the Released Parties in the conduct of TOUGH BUCK. This waiver shall survive the completion of TOUGH BUCK.

Indemnification Agreement: In consideration of being permitted to participate in TOUGH BUCK, I hereby agree to hold harmless, defend and indemnify the Released Parties from and against any and all claims of co-participants, rescuers, and others arising from conduct in the course of my participation in TOUGH BUCK. For the purposes hereof, “claims” includes all actions and causes of action, claims, demands, losses, costs, expenses and damages, including legal fees and related expenses. This indemnity obligation shall survive the completion of TOUGH BUCK.

Photography/Video Release: Participants involved in any activities offered by MTNTOUGH and MDF may be photographed or videotaped during participation in such activities.  I hereby consent to the use of these photographs and/or videos without compensation, on the MTNTOUGH and/or MDF website or in any editorial, promotional or advertising material produced and/or published by or for MTNTOUGH and/or MDF. Participation in the drawing constitutes permission for MTNTOUGH and MDF and sponsors to use the winner’s name and likeness for promotional purposes without additional compensation.

Venue and Jurisdiction: If legal action proceeds in a court of law, the state or federal court of Montana has the exclusive jurisdiction and that only the substantive laws of Montana shall apply.

Severability: I acknowledge and agree that the Assumption of Risk, Waiver of Liability, and Indemnification Agreement set forth above are intended to be as broad and inclusive as is permitted by law in the State of Montana and that if any provision shall be found to be unlawful, void, or for any reason unenforceable, then that provision shall be severed from this Agreement and does not affect the validity and enforceability of any remaining provisions.

Integration; Modification: I acknowledge and agree that this Agreement supersedes any and all previous oral or written promises or agreements, and that this Agreement cannot be modified or changed in any way by representations or statements by any agent or employee of MTNTOUGH and MDF. This Agreement may only be amended by a written document duly executed by the undersigned participant and MTNTOUGH and MDF.

Representations of Participant: 

I represent and warrant:
that I am in good health and in proper physical condition to safely participate in TOUGH BUCK, and I have not been advised or cautioned against participating by a medical practitioner; that I agree not to participate in TOUGH BUCK while under the influence of alcohol or drugs; that I am covered by proper medical insurance; and that I have become familiar with and will abide by all written and/or posted rules of TOUGH BUCK, and shall comply with all directions, instructions and decisions of MTNTOUGH and/or MDF personnel.

Emergency Medical Responses:  In the event of an injury to me that renders me unconscious or incapable of making a medical decision, I authorize MTNTOUGH and/or MDF personnel and emergency medical personnel to make emergency medical decisions on my behalf (including, but not limited to CPR and AED). I further authorize MTNTOUGH and/or MDF to secure emergency medical care or transportation (i.e., EMS) when deemed necessary and I agree to assume all costs of emergency medical care and transportation.

Removal from Event: I understand that MTNTOUGH and/or MDF personnel may immediately cause anyone who disobeys any rules, directions, instructions, decisions, or laws, or whose behavior endangers safety or negatively affects a person, facility, or property of any type or kind, to be removed from TOUGH BUCK.

ACKNOWLEDGMENT OF UNDERSTANDING: BY EXECUTING THIS AGREEMENT I ACKNOWLEDGE AND AGREE THAT I HAVE READ THIS PARTICIPANT INDEMNIFICATION AGREEMENT AND RELEASE, AND FULLY UNDERSTAND ITS TERMS. I FURTHER ACKNOWLEDGE AND AGREE THAT I UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS, INCLUDING MY RIGHT TO SEEK DAMAGES.  I FURTHER ACKNOWLEDGE THAT I AM FREELY AND VOLUNTARILY ELECTRONICALLY SIGNING THIS AGREEMENT AND PARTICIPATING IN TOUGH BUCK, AND I INTEND MY ELECTRONIC SIGNATURE TO BE A COMPLETE AND UNCONDITIONAL RELEASE OF ALL LIABILITY OF THE RELEASED PARTIES AND ACCEPTANCE OF THE INHERENT RISKS OF THE ACTIVITY, TO THE GREATEST EXTENT ALLOWED BY THE LAWS OF THE STATE OF MONTANA AND NEVADA.

TOUGH BUCK Fitness Event Drawing Rules

Eligibility:

Must be 18 years of age or older as of February 14, 2026.
Must be present at the TOUGH BUCK fitness event on February 14, 2026.
Must participate in the TOUGH BUCK workout.
Canadian Residents can participate in TOUGH BUCK
If the prizewinner is a resident of Canada, an additional mathematical skill-testing question will have to be answered in order to claim the prize, as required by Canadian law.

Location: Salt Palace Convention Center, Salt Lake City, Utah

Drawing Prize: (1) winner will receive a once-in-a-lifetime Mule Deer hunting package in Sonora, Mexico with MX Hunting. This premier hunt includes full outfitting, expert guiding, lodging, meals, and trophy care—everything needed for an unforgettable adventure in one of the most legendary mule deer destinations on Earth.

They are not donating the hunt.
They are not a sponsor of the event.

Entry Requirements:
To enter the drawing, participants must complete the TOUGH BUCK Hunt Giveaway Workout in its entirety during the event.
All participants who complete the workout will be automatically entered into the drawing. Everyone who completes the workout has an equal chance to win.

Drawing and Winner Selection:
The randomized drawing will be conducted on February 14, 2026, immediately following the event.

The winner will be randomly selected from all eligible participants who have completed the workout.

The winner must be present at the time of the drawing to claim the prize.

Prize Claiming:
The winner must provide valid identification and proof of age to claim the prize.
If the selected winner is not present at the time of the drawing, an alternate winner will be chosen.

General Conditions:
By participating in the TOUGH BUCK event and drawing, participants agree to abide by these rules and any additional rules or guidelines set by MTNTOUGH and MDF.

Transferability of Hunt Giveaway Statement
The hunt giveaway associated with TOUGH BUCK is transferable under the following conditions:

Eligibility for Transfer: The hunt may be transferred to another participant of the TOUGH BUCK workout program. This individual must be an active participant in the workout program to qualify for the transfer.

Eligible Recipients:

The recipient of the transferred hunt can be any of the following:
Spouse who completes the event
Child (18 years or older) who completes the event
Significant other who completes the event
Friend who completes the event
Cousin who completes the event
Any other eligible participant in the TOUGH BUCK workout program who completes the event

Mutual Transferability: Should the new participant win the hunt giveaway, they have the option to transfer the hunt back to the original participant or to another eligible participant, in accordance with the transfer rules.

Special Circumstances: In the event of death, an act of God, or other unforeseen circumstances that prevent participation or transfer, the hunt giveaway may be reallocated or handled in a manner deemed appropriate by TOUGH BUCK management, in accordance with applicable rules and regulations.
All transfers must comply with TOUGH BUCK’s rules and policies.

MTNTOUGH and MDF reserves the right to disqualify any participant for any behavior that the event organizers in their sole, good-faith judgement deem to be disruptive.

Liability:
MTNTOUGH and/or MDF are not responsible for any injury or loss that may occur as a result of participating in the event or claiming the prize.
