Assumption of Risk, Release, Waiver of Liability, and Indemnity Agreement

I understand that PPLT has agreed to allow me to visit, enter, and use the Property pursuant to a Permit issued to The August Race and under the terms and conditions set forth in this Assumption of Risk, Release, Waiver of Liability, and Indemnity Agreement (the “Agreement”).

1.    The Property consists of improved parkland and unimproved natural and open space lands, and associated roads, bridges, trails, fences, and similar improvements. I understand that the natural, open space conditions occurring on the Property (including but not limited to, changes in water levels in streams, unpredictable weather conditions, and wildlife) may pose risks and hazards, and such conditions may change quickly.  

2.    I acknowledge that there is an inherent risk of injury when using outdoor facilities, such as public lands, and factors outside of PPLT’s control, such as the weather, may increase the risk of injury.  I knowingly and voluntarily accept all risks associated with my voluntary entry on and use of the Property.  I acknowledge that my use of the Property and its improvements could result in property damage, loss, injury, or death.  As a condition of entering the Property, therefore, I understand and agree that PPLT assumes no responsibility for accidents or injury caused before, during, or after my visit to the Property.  I accept full responsibility for any harm or damage that might occur, resulting in property damage, loss, injury, or death to others or to myself.  I also agree to follow all rules, regulations, and instructions of PPLT while visiting the Property.

3.    In signing this Agreement, I fully recognize, understand, and agree that if I suffer property damage, loss, injury, or death, I voluntarily agree to waive, release and discharge, to the fullest extent allowed by law, any and all rights and claims which I may now have, or which I may hereafter accrue against PPLT, and its employees, board, volunteers, agents, successors, and assigns.  I agree to indemnify and hold harmless PPLT, and its employees, board, volunteers, agents, successors, and assigns, from any and all claims, losses, damages, and liability, including the cost of the defense thereof, occasioned by, growing out of, or in any way arising or resulting from my use of the Property or any act or omission on the part of myself, my agents, employees, officers, or invitees in connection with my use of the Property as specified in this application.

4.    I understand that by signing this document, I may be waiving my rights to a jury trial to hold PPLT, and its employees, board, volunteers, agents, successors, and assigns legally responsible for any injuries or damages resulting from risks inherent in sport and outdoor recreational opportunities or for any injuries or damages I may suffer due to PPLT’s ordinary negligence that are the result of PPLT’s failure to exercise reasonable care.

5.    This Agreement shall be binding upon my heirs, personal representatives, and successors, and it shall inure to the benefit of PPLT and its board, employees, volunteers, agents, successors, and assigns.

I, the participant (or a parent or adult guardian for all children under 18 years), intending to be legally bound do hereby waive and forever release any and all right and claims for damages or injuries that I may have against the Event Director, RunSignup.com, and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.

I know that running a race is a potentially hazardous activity. I should not enter and run unless I am medically able to do so and properly trained. I assume all risks associated with running in this event including, but not limited to: falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims which I might have based on any of those and other risks typically found in running a road race. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any race official relative to my ability to safely complete the run. I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event and that a licensed Medical Doctor has verified my physical condition.

In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.

By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver.

Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.
