WAIVER AND RELEASE OF LIABILITY 

IN CONSIDERATION of being permitted to participate in any way in the P.A.I.L. Remembrance Walk (the “Event”), co-hosted by Alive In My Heart, Miles’ Mission, Nationwide Children’s Hospital and the City of Columbus (each referred to as a “Co-host” and collectively as “Co-hosts”) and organized by Columbus Running Company (the “Event Organizer”), I, the participant, intending to be legally bound, execute this Waiver and Release of Liability (the “Waiver”) and hereby:

Waive and forever release any and all rights and claims for damages or injuries that I may have against Co-hosts, the Event Organizer, RunSignup.com, and their respective administrators, directors, agents, officers, members, volunteers, independent contractors, and employees, other participants, Event sponsors, vendors and, if applicable, owners and lessors of premises, property and/or equipment used for the Event (each referred to as a “Releasee” and collectively, as “Releasees”) for any and all injuries to me or my personal property that I may suffer before, during or after the Event, including any social or economic loss either not known to me or not foreseeable at this time. 

Recognize, intend, and understand that this Waiver is binding on my heirs, executors, administrators, or assignees. 

Acknowledge that my participation in the Event in any capacity, including but not limited to walking the course of the Event, is a potentially hazardous activity. I should not participate in the Event and walk unless I am medically able to do so and properly trained. I assume all risks associated with participating in this Event including, but not limited to falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims which I might have based on any of those, and other risks typically found in participating, including but not limited to walking a course such as the one in the Event. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of Event officials relative to my ability to safely participate in the Event. I certify as a material condition to my being permitted to participate in the Event that I am physically fit and sufficiently trained for participation in this Event and that a licensed medical professional has verified my physical condition. I further acknowledge that Co-hosts or the Event Organizer are not responsible for providing me with adequate training or verifying my medical records or my fitness level for participating in the Event. 

Authorize and give my consent to the Co-hosts and the Event Organizer to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care in the event of an illness, injury or medical emergency arising during the Event. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization. THIS WAIVER EXTENDS TO ANY LIABILITY ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE MEDICAL TREATMENT AND TRANSPORTATION PROVIDED IN THE EVENT OF AN EMERGENCY, INCLUDING, BUT NOT LIMITED TO, NEGLIGENT EMERGENCY RESCUE OPERATIONS.

Further agree that if, despite this Waiver, I, or anyone on my behalf, makes a claim against any of the Releasees, I will indemnify, save, and hold harmless each of the releasees from any litigation expenses, attorney fees, loss, liability, damage, or cost which any may incur as the result of such claim.

Agree to abide by the Center for Disease Control (“CDC”)’s recommendations for the prevention of the spread of COVID-19 and any transmittable disease and attest to having read the CDC’s guidance at: https://www.cdc.gov as they apply to my participation in the Event. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the city, the community or by the Co-hosts and Event Organizer with respect to my participation in this Event.

AUTHORIZE AND GRANT UNLIMITED PERMISSION TO EACH CO-HOST AND EVENT ORGANIZER TO USE, RE-USE, PUBLISH, AND RE-PUBLISH INFORMATION ABOUT ME AND REPRODUCTIONS OF MY LIKENESS (PHOTOGRAPHIC OR OTHERWISE) AND/ OR MY MINOR DEPENDENT THAT WILL BE ATTENDING OR PARTICIPATING IN THE EVENT WITH ME, IN ANY PHOTOGRAPHS, MOTION PICTURES, RESULTS, PUBLICATIONS OR ANY OTHER PRINT, VIDEOGRAPHIC OR ELECTRONIC RECORDING OF THIS EVENT FOR THE PURPOSE OF ADVERTISING, PUBLIC RELATIONS, MARKETING OR ANY OTHER LAWFUL USE. IN CONNECTION WITH THIS PUBLICITY AUTHORIZATION, I WAIVE ALL RIGHTS TO INSPECT OR APPROVE THE PICTURES, VIDEOS, WORDS, ILLUSTRATIONS, PROMOTIONAL COPY OR OTHER MATERIALS THAT MAY BE USED IN CONNECTION THEREWITH. I WILL MAKE NO MONETARY OR OTHER CLAIM AGAINST THE CO-HOSTS OR THE EVENT ORGANIZER FOR THE USE OF SUCH LIKENESS, PHOTOGRAPHS, VIDEOTAPES AND/OR VOICE RECORDING.

Acknowledge that while prior registration for participation in the Event is required, the Co-hosts and Event Organizer reserve the right to postpone or cancel the Event due to circumstances beyond their control such as unsafe weather conditions, government order and restrictions, natural disaster, emergency or as required to protect the safety of local residents and participants. Co-hosts and the Event Organizer reserve the right to change the details of the Event or cancel the Event without prior notice. I understand that I will not be owed any refund or compensation if the Event is canceled, changed, or postponed for any reason whatsoever.
 

I AM 18 YEARS OF AGE OR OLDER, HAVE READ AND FULLY UNDERSTAND THE TERMS OF THIS WAIVER, UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL RIGHTS BY SIGNING THIS WAIVER, HAVE SIGNED IT VOLUNTARILY AND WITHOUT ANY INDUCEMENT OR ASSURANCE OF ANY NATURE AND INTEND IT TO BE A COMPLETE AND UNCONDITIONAL WAIVER AND RELEASE OF ALL LIABILITY TO THE GREATEST EXTENT ALLOWED BY LAW. I AGREE THAT IF ANY PORTION OF THIS WAIVER IS HELD TO BE INVALID, THE REMAINING PROVISIONS, NOTWITHSTANDING, SHALL CONTINUE IN FULL FORCE AND EFFECT.

The below section applies to Parent/ Guardian of any participant under the age of 18:

I certify that I am the parent or legal guardian of the above-named participant in the EVENT. On behalf of myself and my spouse, partner, co-guardian or any other person who claims the participant as a dependent, I have read the above “Waiver and Release of Liability”, I understand its contents, and sign this acknowledgement of my own free act. I acknowledge that my dependent and I have agreed to the terms and conditions of my dependent’s participation in the Event, and I hereby give my consent to participation by my dependent in the Event, and to receive medical treatment determined to be necessary. 

FURTHER, I UNDERSTAND THE NATURE OF THE EVENT AND THE MINOR’S EXPERIENCE AND CAPABILITIES, AND BELIEVE THE MINOR TO BE QUALIFIED, IN GOOD HEALTH, AND IN PROPER PHYSICAL CONDITION TO PARTICIPATE IN THE EVENT. I HEREBY RELEASE, DISCHARGE, COVENANT NOT TO SUE, AND AGREE TO INDEMNIFY AND SAVE AND HOLD HARMLESS EACH OF THE RELEASEES FROM ALL LIABILITY CLAIMS, DEMANDS, LOSSES, OR DAMAGES ON THE MINOR’S ACCOUNT CAUSED OR ALLEGED TO BE CAUSED IN WHOLE OR IN PART BY THE NEGLIGENCE OF THE "RELEASEES" OR OTHERWISE, INCLUDING NEGLIGENT RESCUE OPERATION AND FURTHER AGREE THAT IF, DESPITE THIS RELEASE, THE MINOR, OR ANYONE ON THE MINOR’S BEHALF, OR I MAKE A CLAIM AGAINST ANY OF THE RELEASEES NAMED ABOVE, I WILL INDEMNIFY, SAVE, AND HOLD HARMLESS EACH OF THE RELEASEES FROM ANY LITIGATION EXPENSES, ATTORNEY FEES, LOSS LIABILITY, DAMAGE, OR COST ANY MAY INCUR AS THE RESULT OF ANY SUCH CLAIM.

I FURTHER GIVE CO-HOSTS AND EVENT ORGANIZER THE PERMISSION TO PUBLISH IN PRINT, ELECTRONIC, OR VIDEO FORMAT THE LIKENESS OR IMAGE OF MY DEPENDENT FOR ANY LEGAL PURPOSES PURSUANT TO PARAGRAPH 7 OF THE WAIVER.  I RELEASE ALL THE CLAIMS AGAINST THEM WITH RESPECT TO COPYRIGHT OWNERSHIP AND PUBLICATION INCLUDING ANY CLAIM FOR COMPENSATION RELATED TO THE USE OF THE MATERIALS.
