WAIVER, RELEASE AND CONSENT TO MEDICAL TREATMENT
In consideration for the opportunity to participate in the 22nd Annual Run for the Rose 5k Fun Run & Family 1k ( the “Run for the Rose”), I agree, on behalf of myself, my heirs, and personal representative(s), to fully release the Dr. Marnie Rose Foundation, Run for the Rose, The TMC Corporation/John P. McGovern Campus, the City of Houston, the Events Hive, their affiliates, employees and agents as well as race officials, volunteers and sponsors (“Released Parties”) from any and all claims for any injury, illness, or other damage, including but not limited to property damage, which may directly or indirectly result from my participation in the Run for the Rose. I agree, for myself and all my heirs, not to sue the Released Parties or initiate or assist in the prosecution of any claim for damages or cause of action against the Released Parties which I or my heirs may have as a result of any personal injury, death or property damage I may sustain while participating in the Run for the Rose.
I understand and acknowledge that this event may be dangerous and involves the risk that participants will sustain injuries. I acknowledge that I am responsible for the safety and well-being of any minor children in my care at the Run for the Rose (“my Children”). I represent that my Children (if applicable) and I are in proper physical condition to participate in the Run for the Rose, and I agree that I will follow recommended operating procedures if I use a stroller.
I consent to and authorize the Released Parties to secure any medical treatment if they, in their sole discretion, determine that my Children or I need medical care while participating in the Run for the Rose if I am unable to do so myself. I accept full responsibility for all costs related to such medical treatment, including any transportation costs, and I discharge all Released Parties involved from any type of liability arising out of my treatment or transport. I agree that I am fully and solely responsible for any of my property and personal belongings that I bring or that I use during the Run for the Rose, and that the Released Parties will not be responsible for or provide any security for my property and personal belongings.
I grant the Dr. Marnie Rose Foundation permission to communicate with me via email, mail, telephone, text message or any other digital methods about the Run for the Rose and other non-profit related matters. I understand that I may request that the organization remove me from their distribution lists at any time.
MEDIA RELEASE
I agree that the Dr. Marnie Rose Foundation may use, for any purpose whatsoever and without compensation, any photographs, videotapes, audiotapes or other depictions of me and my Children related to the Run for the Rose and assign the Dr. Marnie Rose Foundation, its advertising agency, licensees, and producers of its educational and promotional materials and their successors and assigns, the irrevocable right to use, publish, and copyright my picture, voice, and/or moving image, and any picture, voice, and/or moving image of my Children, for educational programs, advertising, and promotion of its programs, including the right to alter any of these, combine them with others and place them on the Dr. Marnie Rose Foundation or Run for the Rose web site or any other form of media.
REFUND POLICY
I acknowledge that my entry fee is non-refundable, including if the race is cancelled, and my entry is non-transferable.
