RELEASE FROM RESPONSIBILITY, ASSUMPTION OF RISK AND WAIVER

In consideration of my being permitted by Fort Lewis College to participate in the following activities: NARROW GAUGE 10M & 5K at the following location(s) Fort Lewis College on MAY 28, 2023 , I, The Participant, exercising my own free choice to participate voluntarily in the above named activities, and promising to take due care during such participation, hereby release and discharge, defend, indemnify, save and hold harmless the State of Colorado acting through the Board of Trustees of Fort Lewis College, and their officers, agents, employees, and any other persons or entities acting on their behalf, and the successors and assigns for any and all of the aforementioned persons and entities, against all claims, damages, expenses, liability and court awards including costs, and attorneys’ fees and related costs, demands, and causes of action whatsoever, either in law or in equity, relating to injury, disability, death or other harm, to person or property or both, arising from my participation in and/or presence at the above listed activities.

Notwithstanding anything contained herein to the contrary, I understand that all terms and conditions of this Release shall be construed or interpreted as consistent with, and not as a waiver, express or implied, of any of the immunities, rights, benefits, protection, or other provisions of the “Colorado Governmental Immunity Act”, Section 24-10-101, et seq., CRS, as now or hereafter amended, and that any claims for injuries to persons or property arising out of negligence of the State of Colorado, its departments, institutions, agencies, boards, officials and employees is subject to the provisions of Section 24-10-101, et seq., CRS, as now or hereafter amended, and the risk management statutes, Section 24-30-1501, et seq., CRS, as now or hereafter amended.

I acknowledge that I am aware of any hazards and risks which may be associated with my participation in the above named activities. I understand, accept, and assume those hazards and risks, and waive all claims against the State of Colorado acting through the Board of Trustees of Fort Lewis, and other persons as set forth above. I understand that I am solely responsible for any costs arising out of any bodily injury or property damage sustained through my participation in normal or unusual acts or conduct associated with the above named activities.

I have had sufficient time to review and seek explanation of the provisions contained above, have carefully read them, understand them fully, and agree to be bound by them. After careful deliberation, I voluntarily give my consent and agree to this Release, Assumption of Risk and Waiver.

In consideration of you accepting this entry, I, the participant, intending to be legally bound do hereby waive and forever release any and all right and claims for damages or injuries that I may have against the Event Director, RunSignup.com, and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.

I know that running a road race is a potentially hazardous activity. I should not enter and run unless I am medically able to do so and properly trained. I assume all risks associated with running in this event including, but not limited to: falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims which I might have based on any of those and other risks typically found in running a road race. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any race official relative to my ability to safely complete the run. I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event and that a licensed Medical Doctor has verified my physical condition.

In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.

COVID-19

I agree to notify SJBPH immediately if I become aware of Covid symptoms or diagnosis in myself. 

I agree to social distance, use hand sanitizer, and respect mask rules at the start and finish of the race. 

The week prior to the race, I will screen myself on race morning for any of the specific Covid symptoms.  I will not to come if I am not feeling well or have any symptoms.

If in the two weeks prior to the race I have experienced fever, cough, difficulty breathing, headaches, body aches, loss of taste or smell, sore throat, runny nose, nausea, vomiting, or diarrhea, I will not attend the Fastest 5k. 

I will NOT to attend if I have been in contact with someone in the prior two weeks who has tested positive for Covid or who has experienced Covid symptoms.
By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver.

Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.
