In consideration of your accepting this entry, I, the undersigned, intending to be legally bound, hereby, for myself, my family, my heirs, executors, and administrators, forever waive, release & discharge any and all rights & claims for damages & causes of suit or action known or unknown, that we may have against The Louie Bluie Rabbit Run 5K, the Event Director(s), Total Race Solutions, Inc, the Run and See Tennessee Race Series, RunSignup, the City of Caryville, TN, Cove Lake State Park, and all other political entities, all independent contractors & construction firms working on or near the course, all event officials & volunteers, & all sponsors of the race, & related race events & their officers, directors, employees, agents & representatives, successors, & assigns, for any and all injuries that may be suffered by me in this event. This release includes all injuries and/or damages suffered by me before, during, or after the event. I recognize, intend, and understand that this release is binding on my heirs, executors, administrators, or assignees.

I know that running a road race is a potentially hazardous activity. I should not enter or participate unless I am medically able to do so and properly trained. I assume all risks associated with participating in this event including, but not limited to: falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims that I might have based on any of those and other risks typically found in participating in a running event. I acknowledge all such risks are known and understood by me. I attest that I am physically fit, am aware of the dangers & precautions that must be taken when running in warm or cold conditions, & have sufficiently trained for the completion of this event. I also agree to abide by any decision of an appointed medical official relative to my ability to safely continue or complete the run. In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director(s) to secure from any accredited hospital, clinic and/or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.

As it applies to my participation in this event, I agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of the COVID Virus. I agree to abide by any COVID Virus distancing and other safety guidelines issued by the state, the community or by this race required for my participation in this race. I attest that I will not show up to race if I have been exposed to the Covid Virus, exhibit any symptoms of the virus, or have a fever greater than 100.4 degrees Fahrenheit. 

Further, I hereby grant full permission to the Louie Bluie Rabbit Run 5K, Total Race Solutions, the Run and See Tennessee Running Series, and/or agents hereby authorized by them, to use any photographs, videotapes, motion pictures, recording, or any other record of this event for any legitimate purpose at any time. By furnishing my email address, I acknowledge that I authorize The Louie Bluie Rabbit Run 5K, Total Race Solutions, Inc and the Run and See Tennessee Running Series to include me on mass emails concerning the The Louie Bluie Rabbit Run 5K or any Total Race Solutions, Inc or Run and See Tennessee Running Series event. I understand that my personal data will not be shared with any other entity without my express written approval.

 I understand if I use a MP3 player, IPOD, headset, cell phone or other electronic device while participating in the event, I will do so in a reasonable manner using common sense and awareness of those around me.

This event follows the standard running industry policy: All entry fees are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants, event staff, and volunteers. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable and bib numbers are nontransferable.

The goal of this race is to stage an event that is safe and enjoyable to everyone who attends or works the event. We have certain standards of behavior that we require in order to help achieve that goal. All participants, volunteers and staff will be required to show respect and courtesy to everyone that works or attends our event. We will not allow anyone to intimidate, bully, disparage, or curse anyone at our event. Anyone who does not comply with this standard of behavior will be required to vacate the race venue, and in the case of a registered participant will not be eligible for an award or given a refund of their registration fee.   

I agree that the laws of the state of the State of Tennessee  apply to this contract and waiver and that the only proper venue for any legal action is Campbell County, Tennessee.
