In consideration of participating in the 2025 Rye Neck School Foundation Polar Plunge (the "Event"), I represent that I understand the nature of the Event and that I and/or my minor child am qualified, in good health, and in proper physical condition to participate in the Event and all activities associated therewith and I agree to the following waiver and release: 

I fully understand that the Event involves risks of serious bodily injury, including but not limited to viral infections, bacterial infections and other communicable diseases and illnesses, loss of consciousness, hypothermia, heart attacks, and other life-threatening conditions, permanent disability, paralysis and death, which may be caused by my own actions, or inactions, those of others participating in the Event, the conditions in which the Event takes place, or the negligence of the "Releasees" named below; and that there may be other risks either not known to me or not readily foreseeable at this time; and I am voluntarily participating in the Event with full knowledge of the inherent risks, hazards, and dangers involved and hereby fully accept and assume any and all risks and all responsibility for losses, costs, and damages I and/or my minor child incur as a result of my and/or my minor child’s participation in the Event. This release includes all injuries and/or damages suffered by me before, during or after the event. 

I, for myself, my heirs, successors, executors, survivors and assigns, hereby knowingly and intentionally waive and release, indemnify, and hold harmless the Rye Neck School Foundation, RunSignup.com, and all of their respective officers, agents, administrators, directors, volunteers, employees, contractors, sponsors, advertisers and, owners and lessors of premises on which the Event takes place (each a "Releasee" and together, the "Releasees" herein), individually and collectively, from and against all liability, claims, causes of action, suits, demands, losses, damages, expenses (including reasonable attorney's fee) and negligence of any kind or nature, whether foreseen or unforeseen, arising directly or indirectly out of any damage, loss, injury, paralysis, or death to me or my property as a result of participation in the Event, whether such damage, loss, injury, paralysis, or death results from the negligence or other acts however caused by or contributed to by the Rye Neck School Foundation and any Releasee, or from some other cause. I for myself, my heirs, successors, executors, survivors and assigns further agree not to sue the Rye Neck School Foundation or any Releasee, individually and collectively, as a result of any damage, loss, injury, paralysis, or death suffered in connection with my participation in the Event. 

The Rye Neck School Foundation reserves the right to remove me from the Event and all associated activities therewith at any time, for any reason, in its sole discretion.

I also hereby consent to and permit emergency treatment to me and/or my minor child in the event of illness or injury. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.

I hereby grant Rye Neck School Foundation permission to use my name, picture, voice and words in social media, television, radio, films, newspaper, magazines, and other media, and in any other form not heretofore described for promotional purposes, worldwide and without my prior consent.

I further agree that if, despite this release, waiver of liability, and assumption of risk, I, or anyone on my and/or my minor child's behalf, makes a claim against any of the Releases, I will indemnify, save, and hold harmless each of the Releasees from any loss, liability, damage, or cost which any may incur as the result of such claim. 

By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver, understand that I have given up substantial rights by signing it and have signed it freely and without any inducement or assurance of any nature and intend it be a complete and unconditional release of all liability to the greatest extent allowed by law and agree that if any portion of this agreement is held to be invalid the balance, notwithstanding, shall continue in full force and effect.
