In consideration of you accepting this entry, I, the participant, intending to be legally bound, do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against the Event Director, Racing Expectations, RunSignup.com, CurePSP, Inc., and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend, and understand that this release is binding on my heirs, executors, administrators, or assignees.

I know that running a road race is a potentially hazardous activity. I should not enter and run unless I am medically able to do so and properly trained. I assume all risks associated with running in this event, including, but not limited to, falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims that I might have based on any of those, and other risks typically found in running a road race. I acknowledge that all such risks are known and understood by me. I agree to abide by all decisions of any race official relative to my ability to complete the run safely. I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event and that a licensed Medical Doctor has verified my physical condition.

In the event of an illness, injury or medical emergency arising during the event, I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me, including but not limited to medical transport, medications, treatment and hospitalization.

Board Policy 7:305, Concussions and Head Injuries, requires, among other things, that a participant who exhibits signs and symptoms, or behaviors consistent with a concussion or head injury must be removed from participation or competition at that time and that such student will not be allowed to return to play unless cleared to do so by a physician licensed to practice medicine in all its branches or a certified athletic trainer. A concussion is a brain injury, and all brain injuries are serious. They are caused by a bump, blow, or jolt to the head or by a blow to another part of the body with the force transmitted to the head. They can range from mild to severe and can disrupt the way the brain normally works. Even though most concussions are mild, all concussions are potentially serious and may result in complications, including prolonged brain damage and death, if not recognized and managed properly. In other words, even a "ding" or a bump on the head can be serious. You can't see a concussion, and most sports concussions occur without loss of consciousness. Signs and symptoms of concussion may show up right after the injury or can take hours or days to appear fully. If any attendees report symptoms of concussion, or if you notice the symptoms or signs of concussion yourself, seek medical attention right away.

As it applies to my participation in this race, I agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC’s guidance at: https://www.cdc.gov. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the community or by this race for my participation in this race.

Further, I hereby irrevocably and perpetually grant to CurePSP, Inc., a Maryland nonstock corporation, and its respective agents, employees, representatives, successors, and assigns, and anyone authorized by them (collectively, “CurePSP”), the right and permission to use, reproduce, display, publish, broadcast, alter, and modify my photograph, likeness, statements, and image in video footage and recordings (collectively, “my image”) in association with materials created by CurePSP or used in CurePSP programs form any purpose, including but not limited to incorporating my image into educational, advertising, promotional, and/or publicity materials, books, pamphlets, or other materials (the “Materials”), in any and all media now existing or hereafter created, without territorial, time, use or any other limitations. I acknowledge that CurePSP shall own all rights, title, and interest in any Materials, and I waive any right I may have to inspect or approve of the Materials. I further acknowledge such Materials could be used, reproduced, displayed, published, broadcast, or altered by CurePSP, but that CurePSP is not obligated to use my image. I understand that I will not be paid any royalty or other compensation, and I give up any right I may have to payment if my image is used. I hereby release, discharge, and agree to hold harmless CurePSP from any and all past, present, and future rights, claims, demands, damages, and actions which I, my beneficiaries, administrators, and/or executors or assigns have or may have in connection with the use of my image in any and all media, including but limited to any actions for blurring, distortion, alteration, optical illusion, or use in composition form. I understand and agree that: (1) this release shall be binding upon and inure to the benefit of the parties and our respective successors, licensees, heirs, executors, and assigns (as applicable), except that my obligations may not be delegated or assigned; and (2) this release constitutes the entire agreement between the parties regarding my image and no waiver, modification, or addition to this release shall be valid unless in writing and signed by parties. I state further that I have read or have had read to this release prior to its execution, and that I am fully familiar with the contents hereof.  

This event follows the standard running industry policy: All entry fees are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control, such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable, and bib numbers are non-transferable.

By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver, including the no refund policy.
