Waiver

As the parent or legal guardian of the child(ren) named, I hereby give my full consent and approval for my child or children to participate in Cardio Kidz. I understand and acknowledge that running is a potentially hazardous activity. I assume all risks associated with my child or children running in this event including, but not limited to: falls, contact with other participants, the effects of weather, including high heat and/or humidity, conditions of the course, all such risks being known and appreciated by me. In addition to giving my full consent for my child's participation, I do hereby waive, release, hold harmless and forever discharge Cardio Kidz, the Race Director, volunteers, directors, board members, officials, staff, sponsors, supervisors, and representatives for any injury that may be suffered by my child in normal cause of participation in the designated sport and the activities incidental thereto, whether paid damages, injury, or loss due to negligence or not.

Additionally, I grant Cardio Kidz permission to use my child's image, voice, and likeness in any program for promotion of Cardio Kidz including written materials, website materials on any and all Cardio Kidz publication across the entire worldwide web (including but limited to www.cardiokidz.org), Cardio Kidz local social media sites including but limited to Facebook, Instagram, LinkedIn and any other unnamed form of social media, video, audio, or other forms without prior consent or compensation of any kind. Registrants may request a limitation on use, which may be granted if related to personal safety concerns. Please contact us at info@cardiokidz.org with your request.

Further, I, and my child or children, agree to abide by and uphold the Cardio Kidz mission and *Code of Conduct. Participants, parents, spectators or any on-site individual acting in a way that doesn’t uphold the code of conduct or core values will face disciplinary action.

*CODE OF CONDUCT - Cardio Kidz is dedicated to supporting the physical, social, and emotional growth of children, of all abilities, in a positive community-focused athletic environment. The program aims to instill healthy habits, build confidence, and foster a sense of community among children and their families. Be kind and conscientious to all participants. Unsportsmanlike conduct will not be tolerated and could result on being removed from the program. Parents & guardians please set a good example of sportsmanship for your kids to follow. Remember, this is not the Olympics, and we are all here to celebrate our KIDS’ SUCCESSES and increase their confidence. We strive for the program to be FUN, POSITIVE & SAFE for all. 

I have read and understand the code of conduct. By checking the box below, I agree that my child and I will abide by them. I understand that if my child or I break any of these rules, we will be notified with a written warning and if we continue to disregard the rules, either myself or my child may be dismissed from Cardio Kidz for the remainder of the series with no refund. 

Lastly, this event follows the standard running industry policy.  I understand my Cardio Kidz registration is non-refundable, non-transferable, and cannot be applied to future registrations. We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. 

By submitting this entry, I (a parent or adult guardian for all children under 18 years) have read and agree to the above release and waiver including the no refund policy.


Waiver

FLO FITNESS- Liability Release
Because physical exercise can be strenuous and subject to risk of serious injury, the club urges you to obtain a physical examination from doctor before using any exercise equipment or participating in any exercise activity. You (each member, guest, and all participating family members) agree that if you engage in physical exercise or activity or use any club amenity on the premises or off premises including any sponsored club event, you do so entirely at your own risk.

Any recommendation for changes in diet including the use of food supplements, weight reduction and/or body building enhancement products are entirely your responsibility, and you should consult a physician prior to undergoing any dietary or food supplement changes. You agree that you are voluntarily participating in these activities and use of these facilities and premises and assume all risks of injury, illness, or death. We are also not responsible for any loss of your personal property.

This waiver and release of liability includes, without limitation, all injuries which may occur as a result of; (a) your use of all amenities and equipment in the facility and your participation in any activity, class, program, personal training or instruction; (b) the sudden and unforeseen malfunction of any equipment; (c) our instruction, training, supervision, or dietary recommendations; and (d) your slipping and/or falling while in the club, or on the club premises, including adjacent sidewalks and parking areas.

You acknowledge that you have carefully read the “waiver and release” and fully understand that it is a release of liability. You expressly agree to release and discharge the health club, and all affiliates, employees, agents, representatives, successors, or assigns, from any and all claims or causes of action against the club for personal injury or property damage.

To the extent that statute or case law does not prohibit release for negligence, this release is also for negligence on the part of the club, its agent, and employees.

If any portion of this release from liability shall be deemed by a court of competent jurisdiction to be invalid, then the remainder of this release from liability shall remain in full force and effect and the offending provision or provisions severed here from.

By signing this release, I acknowledge that I understand its content and that this release cannot be modified orally.
 
To protect FLO Fitness & Martial Arts, Inc., FLO Mixed Martial Arts & Fitness, FLO Sports Performance members and visiting participants against the risk of disease, the following policy has been adopted to minimize the risk of transmission of all NIV, Hepatitis-B, and other blood-borne pathogens during training activities. Current available medical evidence suggests that the risk of transmission of all HIV during the type of body contact that occurs in martial arts training is extremely slight. Organizations such as the NCAA, the National Academy of Pediatrics Committee on Sports Medicine, and the U.S. Olympic Committee have concluded that persons infected with blood-borne pathogens, particularly HIV, should not be barred from participating in contact sports. Certain federal and state anti-discrimination laws may also prohibit such a ban. These organizations have concluded that the already-slight risk of transmission of all HIV, and of other blood-borne diseases, can be reduced further by adoption of the Centers for Disease Control-recommended “universal precautions” with regard to exposed bodily fluids.

FLO Fitness and Martial Arts / FLO Sports Performance members will observe these “universal precautions.” Generally, this means that instructors and all persons training at FLO Fitness and Martial Arts / FLO Sports Performance shall treat all exposed bodily fluids as if they are infected. Specifically:

If you have any open cuts or sores, you must clean them with a suitable antiseptic and cover them securely with a leak-proof dressing before coming onto the mat. Make sure they stay covered while you are training. If your hands or feet have broken skin, suitable gloves or shoes/sandals may be worn to cover these areas. If you notice that someone else has an open cut or sore, remind her or him of this obligation before training with that person.

If a bleeding wound, even a minor one, occurs during training, the person bleeding shall immediately stop training and leave the mat until the bleeding stops or the wound is securely covered. Immediate measures shall be taken to stop the bleeding. If the person needs assistance with this, each person assisting shall wear a pair of latex gloves, which are available in the first-aid kit. Hands shall be washed with soap and hot water immediately after gloves are removed. All used gloves and bloody rags or dressings will be placed in a leak-proof plastic bag provided for that purpose and disposed of carefully. Minor bloodstains on clothing should be greeted with disinfectant solution provided for this purpose. If there are major bloodstains, the clothing shall be removed as soon as possible, placed into a leak-proof container, and handled carefully until it can be laundered or disposed of.

If you come into contact with the blood of another, you shall immediately stop training, leave the mat, and wash the exposed area thoroughly with soap and hot water before returning.

If blood is present on the mat, the training partner of the person bleeding should ensure that no one inadvertently comes in contact with the blood. The blood should be cleaned up as soon as possible by wiping the exposed surface with a disinfectant solution provided for that purpose. Each person assisting with the task shall put on a pair of latex gloves and shall wash their hands with soap and hot water immediately after the gloves are removed. It is preferable that the person bleeding cleans up his or her own blood. Bloody rags and used gloves shall be disposed of as set out in Paragraph 2. Finally, there are other diseases and illnesses aside from those known to be transmitted through blood. You are reminded that you are responsible for not only your own health and safety, but the health and safety of others with whom you train. If you know or suspect that you have any illness or disease that might infect others, refrain from training until you are not at risk to others.

PLEASE, READ THE FOLLOWING CAREFULLY BEFORE SIGNING:
I, the undersigned, acknowledge that I am applying for instruction in FLO Fitness and Martial Arts / FLO Sports Performance, a club located within the facility of FLO Fitness and Martial Arts and that I have watched or participated in at least one fitness/martial arts class. I understand that martial arts training involves strenuous exercise and personal body contact and I understand that because of this, there is always an inherent risk of injury that cannot be eliminated. Such injuries may include, but are not limited to, pulled muscles, dislocated joints, and broken bones.

In accordance with the law, FLO Fitness and Martial Arts / FLO Sports Performance does not exclude individuals with medical conditions that do not pose a medically recognized threat to the health or safety of other students in the normal course of training.

I understand that there are some unavoidable circumstances that may require special caution on my part to minimize danger to others or myself, and I acknowledge that it is my responsibility to act accordingly.

I understand that some students may be infected with diseases such as HIV/AIDS and Hepatitis that can be transmitted by exchanges of blood or other bodily fluids, and that I may be training with them. I acknowledge that I have read and will follow the FLO MMA blood Borne Pathogen Policy for dealing with injuries to myself and others that present opportunities for exposure to blood or bodily fluids.

I acknowledge that the FLO Fitness and Martial Arts / FLO Sports Performance carries no insurance against injury to any of its members or students. As a condition to being admitted to the FLO MMA as a student, I assume the risk of all injuries and do hereby hold the FLO Fitness and Martial Arts/FLO Sports Performance, its employees and agents harmless from any and all liability due to injuries suffered by me or caused by third parties to me, arising out of activities involving fitness and/or martial arts, or any variation thereof, whether occurring on the premises of the FLO Fitness and Martial Arts / FLO Sports Performance or elsewhere.

I understand that the techniques I learn from FLO Fitness and Martial Arts / FLO Sports Performance are strictly for self-defense and for sport. Any injuries or damages I cause outside of regular training hours to any individual(s) or thing I shall take full responsibility.

I understand that FLO Fitness and Martial Arts Research/FLO Sports Performance is an educational system. For the benefit of education and training, and for the safety of other members and myself, I will strictly follow the Rules of the Gym and the Rules of Training as outlined in the FLO MMA Training Handbook. I also hereby agree to abide by the by-laws of the FLO Fitness and Martial Arts. Should I break any of these rules or by-laws, I understand that it is the decision of the Chief Instructor(s) whether or not I may continue training. I will abide by his/her decision.

IF THE APPLICANT IS A MINOR: I, the undersigned, as a parent or guardian of the above applicant, certify that I have read the above contract. I consent to the applicant’s receiving the instruction applied for and I agree to the provisions of the contract for myself and said applicant.
