In consideration of being permitted to participate in the 5K road race (the “Race”) organized by RunSignup.com (“Event Director”) and sponsored by Roark Capital (“Sponsor”), I hereby understand, acknowledge, and agree as follows:
Assumption of the Risk. Participation in the Race is inherently dangerous and exposes me to risk of injury and even death. I fully understand and accept the inherent risks and dangers of same, and assume full responsibility for all risks of property damage, personal injury, and death. I should not enter and run unless I am medically able to do so and properly trained. I agree to abide by all decisions of any race official relative to my ability to safely complete the run. I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event. Moreover, I agree to limit my participation in the Race to the extent I am comfortable and physically capable.
Waiver and Release. I, the participant, for myself, and for my heirs, executors, administrators and anyone else entitled to act on my behalf, to the full extent permitted by law, waive, release, covenant not to sue, and forever discharge Event Director and Sponsor, including their officers, directors, managers, members, employees, agents, attorneys, staff, volunteers, representatives, successors and assigns (collectively, the “Releasees”), from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, sickness, and injury including death, that may be sustained by me, or any of the property belonging to me, whether caused by the negligence of the Releasees or otherwise, related in any way to my participation in the Race, or on account of any first-aid treatment or other medical services rendered in connection with an emergency during my participation in the Race, willful or wanton negligence or misconduct excepted. This waiver and release shall not apply with respect to claims based on the gross negligence or willful misconduct of Event Director.
First Aid. In the event of an illness, injury or medical emergency in connection with or arising out of my participation in the Race, I hereby authorize and give my consent to the Event Director or Sponsor to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.
Photo/Video Release. I understand and accept that Event Director and/or Sponsor may take pictures/digital images or videos of me during the Race which may later be used/published for online media, printed brochures, videos, websites, and other formats. I understand that I will not be paid in any way for the use of pictures/digital images or videos of me. I grant and convey to Event Director and Sponsor all right, title, and interests in any and all photographs, images, video or audio recordings of me or my likeness made in connection with my participation in the Race including but not limited to any royalties, proceeds, or other benefits derived from such photographs or recordings.
Non-refundable Fees. I understand that the Race follows the standard running industry policy in that all entry fees are non-refundable. Event Director or Sponsor reserves the right to postpone or cancel the Race due to circumstances beyond their control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. Event Director and Sponsor reserve the right to change the details of the Race without prior notice. I further understand that bib numbers are non-transferable.
By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver including the no refund policy.
