WAIVER FOR MADISON ROTARY CLUB
INAUGURAL 0.5K “RACE” AND COUCH POTATO RACE

SATURDAY JUNE 15, 2024

In consideration of monies paid for entering the race and accepting this entry, I, the participant intending to be legally bound by the
terms herein, do hereby voluntarily and knowingly waive and forever release and waive any and all rights and claims for damages or injuries
that I may have against the Madison Rotary Club, the event director, Runsignup.com, sponsors, vendors, and all of their agents, members,
employees, volunteers, representatives, successors and assigns assisting with the race and event, for any and all injuries to me or my personal
property, or the minor I am signing on behalf of or the minor’s personal property. This Waiver includes all injuries and/or damages suffered
by me, or the minor I am signing on behalf of, before, during or after the race and event. I recognize, intend and understand that this Waiver
is binding on me, the minor I am signing on the behalf of, my/minor’s heirs, executors, administrators and/or assigns.

I know that running a race is a potentially hazardous activity, which could cause injury or death. I will not enter and participate
unless I am medically able and properly trained, and by my signature, I hereby certify that I am medically able to perform this race and event,
and am in good health, and I am properly trained. If I am signing on behalf of a minor child (18 years or under) as a parent or guardian, I
hereby certify that the minor is medically able to perform this race and event, minor is in good health and is properly trained. I (or the minor)
agree to abide by any decision of a race official relative to any aspect of my participation in this event, including the right of any official to
deny or suspend my (or my minor’s) participation for any reason whatsoever. I attest that I have read the rules of the race and agree to abide
by them. I (or the minor) assume any and all risks associated with running/walking in this event, including but not limited to: falls, physical
contact with other participants, volunteers, race personnel, contract service providers, employees, and spectators including the potential the
contraction of a communicable disease resulting from contact with other participants, volunteers, race personnel, contract service providers,
employees, and spectators. I (or the minor) assume all risks including: the effects of the weather; high heat and/or humidity; freezing cold
temperatures; traffic and the conditions of the road including surrounding terrain. I (or the minor) further agree to abide by the Center for
Disease Control’s (CDC) recommendations for the prevention of the spread of the 2019 Novel Coronavirus Disease (COVID-19) and other
communicable diseases, and I attest to having read the CDC’s guidance at: https://www.cdc.gov/coronavirus/2019-ncov/variants/omicron-
variant.html. I (or the minor) assume all such risks being known, appreciated, and accepted by me or the minor I am signing on the behalf of.

I understand that ALL entry fees are non-refundable, there are NO deferrals or transfers and this event and race my be cancelled
before or during the event. This Waiver may be electronically signed and any such electronic signature shall be binding upon race participant.
I understand that bicycles, skateboards, baby joggers/strollers, roller skates or inline skates, animals, and personal music players are not
allowed in the race, and I (or the minor) will abide by all race rules.

I grant permission to all of the foregoing to use my or my minor’s photographs, motion pictures, recordings or any other record of
this event for any legitimate purposes.

I hereby warrant that I have read this Waiver carefully, understand its terms and conditions as it applies to me or the minor I am
signing on behalf of, acknowledge that I have accepted the terms of this Waiver without any inducement, assurance or guarantee, and intend
for my acceptance to serve as confirmation of my complete and unconditional acceptance of the terms, conditions and provisions of this
Waiver. If I am signing on behalf of a minor, I hereby certify that I am over the age of 18 year and have the full authority to sign on behalf of
said minor, and I shall indemnify and hold the Madison Rotary Club harmless against any and all claims or damages that may result from my
authority for the minor. This Waiver represents the complete understanding between the parties regarding these issues and no oral
representations, statements or inducements have been made apart from this Waiver. If any provision of this Waiver is held to be unlawful,
void, or for any reason unenforceable, then that provision shall be deemed severable from this Waiver and shall not affect the validity and
enforceability of any remaining provisions.
