LIABILITY WAIVER & RELEASE
ALL PARTICIPANTS IN HUMAN POTENTIAL LLC (DBA THE HUMAN POTENTIAL RUNNING SERIES) AND RELATED EVENTS ARE REQUIRED TO ASSUME ALL RISK OF PARTICIPATION IN THESE EVENTS BY ACCEPTING & AGREEING TO THIS GENERAL RELEASE AGREEMENT.
ENTRY TO HUMAN POTENTIAL LLC (DBA THE HUMAN POTENTIAL RUNNING SERIES) CONTAINS A LIMITATION ON YOUR LEGAL RIGHTS – PLEASE READ IT CAREFULLY!
I know that participating in a trail race is a potentially hazardous activity. I enter and run this race certifying that I am medically able and properly trained. I assume any and all risks associated with running this event including, but not limited to; falls, contact with other participants, contact with other land users, the effects of extreme weather, natural and man-made obstacles hidden or in full view, and the conditions of the trails. Knowing these facts and in consideration with your acceptance of my entry fee, I hereby for myself, my heirs, my executors, administrators or anyone else who might claim on my behalf, covenant not to sue, and waive, release, and discharge the organizer of this event – Human Potential LLC (dba Human Potential Running Series), GR Operations LLC, GRCO LLC and GR TERRA LLC, and any individual and organization associated with the trail run; land managers, land owners, local government and police; volunteers, and any and all sponsors, including their agents, employees, assigns or anyone acting for or on their behalf, from any and all claims of liability for death, personal injury foreseen or unforeseen, known and unknown.
The undersigned further grants full permission to use any photographs, videotapes, motion pictures, recordings, or any other record of this event for any legal purpose. I also understand that entry fees are not refundable under any circumstance. I also understand that race registrations are only transferable to other participants, future years races or other Human Potential LLC events under special circumstances detailed on the Human Potential LLC website and that those conditions are non-negotiable. I also understand that it is my personal responsibility to read, watch, or listen to all race materials provided by Human Potential LLC, including but not limited to; Pre and Post Race Emails, The Runner’s Manual, The Race Meeting, and The Race Website; and to arrive at the event having fully prepared to take on the challenges associated therein.
The Race Director reserves the right to modify or cancel the race or course for health and/or safety concerns, trail condition concerns or natural disaster. In such cases there will be no refunds of race entry fees. Each athlete must accept any such risk of their entry fee paid. There is no complimentary race entry to a future race. Entry fees collected are used to develop and produce the event, starting well in advance of the race date – including course preparation, race supplies, permits and administration. We will make every effort to produce a fair and safe event for all participants. Any decision we make that impacts the race, its date, or potential cancellation is carefully considered and based on the overall event safety, sustainability, and manageability. I agree to abide by the rules and decisions of race officials. I understand that my entry fee is nonrefundable and to adhere to all HPRS Credit, Deferral, and Bib Transfer Policies as provided at: https://humanpotentialrunning.com/race-policies/
As it applies to my participation in this race, I agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC’s guidance at: https://www.cdc.gov/coronavirus/2019-ncov/communication/guidance.html. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the community or by this race for my participation in this race.
By submitting this entry, I acknowledge (or a parent or adult legal guardian for all children under 18 years) having read and agreed to the above release and waiver, including the no refund policy, and that I understand and agree to be bound by the terms and conditions set forth herein.
