The undersigned, being the age of 18 or above, or with a legal parent/guardian’s signed consent, desires to participate in the University’s Campus Recreation program activities including, but not limited to, aquatics, fitness, recreational sports, outdoor trips, personal training, wellness, special events and birthday parties.  I realize the activities are potentially hazardous.  I should not enter the program unless I am medically able and properly trained which I represent myself to be.  I assume any and all risks associated with the program including, but not limited to, falls, personal injury, collision with other participants, injury due to use of equipment and facilities, and the effects of weather including high heat and/or humidity, all such risks being known and appreciated by me.  I attest that I am physically fit to participate in this program.  I understand that my participation in the activity is entirely voluntary on my part. 

Knowing the risks and, in consideration of being permitted to participate in the Campus Recreation sports program at the University, I for myself and my personal representatives, heirs and assigns, do hereby hold harmless and release, waive, discharge and covenant not to sue the Board of Governors of Missouri State University, Missouri State University, its Board members, officers, and employees (hereinafter collectively referred to as “MISSOURI STATE UNIVERSITY”) from any and all claims or liability on account of death, damage, or injury to person or property of the undersigned of any kind or nature whatsoever arising out of, or in any way connected with the undersigned’s participation in the program, even though the claim or liability may arise out of the negligence or carelessness on the part of MISSOURI STATE UNIVERSITY, or any third person, whether foreseen or unforeseen,  known or unknown. 

The undersigned hereby expressly agrees that this consent and release is intended to be as broad and inclusive as permitted by the laws of the State of Missouri and that if any portion hereof is held invalid, it is agreed that the balance, notwithstanding, continue in full legal force and effect. 

I also declare that I will take all necessary and/or recommended precautions to ensure my own person against physical and/or mental injury and property loss or damage.  This includes, but is not limited to, following printed or verbal instructions given by the activity leader(s). 

I hereby authorize and give my irrevocable and unlimited consent to Campus Recreation and Missouri State University to copyright, use, and/or publish all images, photographs, recordings, or slides in which I, the undersigned, appear while enrolled as a participant in any of their programs.  I further agree that Campus Recreation or Missouri State University may transfer, use, or cause to be used such media in public displays, publications, commercials, and advertisements, and otherwise without limitations or reservation. 

The undersigned further states that the foregoing Activity Consent and Release has been carefully read, knows the contents thereof, and has agreed to sign the Activity Consent and Release as their own free act and deed. 

ENDURANCE EVENT PARTICIPANT WAIVER, RELEASE OF LIABILITY, AND COVENANT NOT TO SUE

1. Express Assumption of Risk I know that participating in an endurance event (including, but not limited to, road races, triathlons, ultra marathons, trail runs, swim races, cycling races, or other similar events) is a potentially hazardous activity. I attest that I am medically able, physically fit, and properly trained to participate. I assume all risks associated with participating in this event, including but not limited to: falls; contact with or actions of other participants, spectators, or officials; the effects of weather (including extreme heat, cold, humidity, or precipitation); dehydration; cardiac arrest or other sudden medical emergencies; hazards of the course, including traffic, uneven terrain, water hazards, and wildlife encounters; equipment failure; and potential delays in emergency medical response due to remote locations. I acknowledge that all such risks are known, understood, and appreciated by me.

2. Waiver, Release, and Indemnification (Including Negligence) In consideration of your accepting this entry, I, the participant, intending to be legally bound for myself, my heirs, executors, administrators, personal representatives, and assignees, do hereby waive, release, forever discharge, and covenant not to sue the Event Director, RunSignup.com, Heartland Racing Management, LLC, event sponsors, local municipalities, emergency response agencies, and all of their respective agents, officers, directors, representatives, volunteers, and employees (collectively, the "Released Parties") from any and all claims, liabilities, or demands for damages, personal injury, illness, permanent disability, death, or property damage arising out of my participation in this event. This release explicitly includes any claims or liability caused in whole or in part by the NEGLIGENCE of the Released Parties or any ordinary negligence in the operation, organization, or execution of the event.

3. Medical Authorization and Responsibility I agree to abide by all decisions of any race official relative to my ability to safely complete the event. In the event of an illness, injury, or medical emergency arising during the event, I hereby authorize and consent to the Event Director and staff securing any medical treatment, emergency transportation, or hospitalization deemed necessary for my immediate care from any accredited clinic, hospital, or medical provider. I agree that I am solely and fully responsible for all costs and expenses associated with any medical services rendered, including medical transport, treatment, medication, and hospital stays.

4. Rules, Equipment, and Safety I agree to abide by all event rules, local laws, law enforcement directions, and instructions provided by race officials or course marshals. I reserve sole responsibility for the safety, inspection, and maintenance of all personal equipment I bring or use during the event (including bicycles, helmets, footwear, and hydration gear). I understand that race officials reserve the right to disqualify or remove me from the event at any time without a refund if I fail to follow safety guidelines or present a safety hazard.

5. Communicable Disease Safety I agree to abide by all health and safety recommendations and guidelines issued by public health authorities (including the CDC), state/local governments, and the event organizers regarding communicable diseases, viruses, and illnesses. I voluntarily assume all risks related to exposure to or infection by communicable diseases while participating in or traveling to/from the event.

6. Media and Likeness Release I hereby grant full permission to the Released Parties to use my name, voice, photo, image, video recordings, results, or any other record of my participation in this event for any legitimate promotional or commercial purpose, in any media now known or hereafter devised, without compensation or prior approval.

7. Cancellation, Refund, and Transfer Policy All entry fees are non-refundable and bib numbers/entries are non-transferable unless explicitly permitted by race management. Event management reserves the right to cancel, postpone, delay, or alter the event, course, or details without prior notice due to circumstances beyond reasonable control, including natural disasters, extreme weather, safety emergencies, or municipal mandates. No refunds, credits, or transfers will be issued under such circumstances. This event adheres to all Heartland Racing Co. FAQs & Policies published on www.heartlandracingco.com.

8. Governing Law and Severability This agreement shall be governed by and construed in accordance with the laws of the State in which the event takes place, without regard to its conflict of law provisions. Any legal action or proceeding arising out of this agreement shall be brought exclusively in the state or federal courts located within that jurisdiction. If any provision of this waiver is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect.

9. Parent or Guardian Signature for Minors (Under 18) If the participant is under 18 years of age, the undersigned parent or legal guardian certifies that they have the legal authority to sign this agreement on behalf of the minor. The parent/guardian hereby agrees to all terms of this release, waives the minor's and parent's rights as outlined above, and agrees to indemnify and hold harmless the Released Parties from any claims brought by or on behalf of the minor.

Acknowledgment By submitting this entry, I acknowledge that I have read, understood, and voluntarily agreed to all terms of this waiver, release of liability, and refund policy.
