NOTICE:    I acknowledge that running is a strenuous activity that is conducted outdoors, where weather, surface conditions, traffic, and other aspects of this race present hazards that I voluntarily accept.  I attest that I will participate in this race as a footrace, and that I am physically fit, sufficiently trained, and otherwise prepared to complete the race.  I acknowledge that credible sources advise that there exists a COVID-19 pandemic, and that I willingly choose to participate in this race, with other participants,  notwithstanding those risks that are known, or that may become known as medicine/science develops.   I accept responsibility for making myself familiar with the CDC’s COVID-19 guidelines, as well as North Carolina’s relevant state and local directives concerning COVID-19.  I agree that I am solely responsible for abiding by the various directives that relate to COVID-19, as well as all other applicable ordinances and/or laws. 

RELEASE & WAIVER:  In consideration of The Murphy Scholarship Fund’s acceptance of my race entry, I intend to legally bind myself, my agents, my  executors, my heirs, and/or the like, specifically including any minor child and/or other person for whom I have the capacity to contract, so as to waive and to release any and all rights and/or claims that I may have against The Murphy Scholarship Fund, for any  type of injury and/or damage suffered by me, directly and/or indirectly, if it is in any way related to this race and/or the activities associated therewith.    Furthermore, I intend for my waiver and my release to extend to any person and/or entity acting on behalf of and/or in conjunction with The Murphy Scholarship Fund, specifically including, but not limited to the Murphy Scholarship Fund’s race organizers, employees, volunteers, and/or the like, as well as their sponsors, and/or their representatives, successors, and/or assigns, to the fullest extent permitted by North Carolina law.

CONTRACT:  Beyond my waiver and release, I contract, agree, and covenant not to sue The Murphy Scholarship Fund on account of any activities associated with this race and/or the activities associated therewith.  I intend for this contract, agreement, and covenant not to sue to be consistent in scope with what is outlined in the preceding section.  I acknowledge that this race may be videotaped, photographed, and/or otherwise recorded.  In connection therewith, I grant my permission to use my name and likeness, and that of my children, including photographs and/or other records of this race, in which I may appear, for any legitimate purpose, including advertising and promotion.   And, if ever relevant, I agree that all of the contracts, agreements, covenants, waivers, and releases that are memorialized herein shall be construed under North Carolina law.  Should any provision in this document be void or voidable, then all other provisions are severable, and that the severable provisions shall survive, and that they shall remain in full force and effect
