IWSC ATHLETE EVENT RELEASE, WAIVER, ASSUMPTION OF RISK & INDEMNITY AGREEMENT
IMPORTANT: BY CHECKING THE BOX BELOW AND COMPLETING THIS DIGITAL REGISTRATION, YOU ARE AGREEING TO WAIVE CERTAIN VALUABLE LEGAL RIGHTS. PLEASE READ CAREFULLY BEFORE PROCEEDING.
1. General Assumption of Risk & Inherent Dangers of Training and Competition
The Participant (and the Parent/Legal Guardian if the Participant is a minor under 18) explicitly acknowledges and understands that ski and snowboard training, dry-land camps, and related athletic competitions are inherently hazardous activities that involve great risk of severe physical injury, permanent disability, paralysis, or death.
By completing this registration, I understand, appreciate, and contractually assume all inherent risks associated with participating in this IWSC event, camp, or clinic. I recognize that INJURIES OF ALL TYPES ARE A COMMON AND ORDINARY OCCURRENCE of these competitive activities. These risks and dangers include, but are not limited to:
High speeds, loss of balance, loss of control, and catastrophic falls on extremely firm, slick, or icy surfaces, as well as dry-land training surfaces, asphalt, or varied mountain terrain.
Variations in mountain terrain, steepness, ruts, bumps, bare spots, thin cover, rocks, stumps, trees, forest growth, and changing weather, light, and snow conditions.
Collisions or entanglements with natural objects, man-made objects, lift towers, fence lines, padding, timing equipment, gate panels, other competitors, event staff, coaches, or media personnel.
Specific competition hazards including irregular intervals between racers, fall zones, trajectories of out-of-control skiers/riders, and the extreme physical exertion required to stretch physical abilities for competitive results.
Malfunction, failure, breakage, or improper adjustments of specialized competition equipment, bindings, helmets, or safety gear.
2. Participant Safety, Equipment, and Conduct Rules
I agree to be bound by and strictly adhere to all rules, safety regulations, and codes of conduct set forth by IWSC, the Competition Jury, and the sport's National Governing Body (NGB), including any applicable Athlete Safety or SafeSport policies.
I understand that the participant is solely responsible for the choice of appropriate equipment, its safe condition, the speed at which they train, and the selection of their line through any course or training feature.
I understand that following the advice, instructions, or terrain choices of coaches, Competition Jury members, or course officials does not and cannot guarantee my safety.
If at any time I perceive a course feature, weather condition, or trajectory to be unsafely exposed or beyond my physical capabilities, I accept the personal responsibility to immediately notify a staff member and withdraw from the activity.
3. Release of Liability and Covenant Not to Sue
In consideration for being permitted to enter the event, camp, or competition, utilize facilities, and participate in IWSC-affiliated activities, I HEREBY AGREE TO WAIVE ANY AND ALL CLAIMS AGAINST AND TO HOLD HARMLESS, RELEASE, INDEMNIFY, DEFEND, AND AGREE NOT TO SUE IWSC, its host ski resorts, property owners, trustees, directors, officers, employees, volunteers, sponsors, and insurers (collectively referred to as the "Released Parties") from any and all liability, claims, or demands arising out of ordinary negligence or property damage.
This release explicitly includes claims based on the alleged negligence of the Released Parties in setting courses, selecting training terrain, conducting drills, maintaining surface conditions, providing medical attention, or enforcing event rules. I contractually agree that neither I, nor my legal heirs, assignees, or personal representatives, will initiate any lawsuit or legal action against the Released Parties.
4. Medical Authorization & Expense Responsibility
I hereby represent that the Participant is in excellent physical and mental health, has no medical conditions that restrict safe participation, and is covered by a current health/hospitalization insurance policy.
In the event of an emergency during IWSC activities, I authorize IWSC staff, coaches, ski patrol, or licensed physicians to administer any necessary first aid, emergency medical care, or medical transport.
I agree to accept full financial responsibility for any and all costs incurred due to such medical treatment or emergency evacuation, and agree to indemnify and hold harmless the Released Parties from any such costs.
5. Digital Signature and Legal Binding
If the participant is under the age of 18, the individual completing this RunSignUp registration warrants that they are the Parent or Court-Appointed Legal Guardian of the minor child. The Parent/Guardian explicitly enters into each and every agreement, representation, waiver, and liability release described above on behalf of themselves, the minor participant, and any other parent or guardian of the participant, intending to give up the right to maintain any claim or suit against IWSC arising out of the minor's participation.
Severability: If any clause or provision of this Release is deemed invalid or unenforceable by a court of competent jurisdiction, the remaining terms shall continue to hold full contractual force and effect.
I HAVE CAREFULLY READ THIS RELEASE OF LIABILITY, FULLY UNDERSTAND THAT I AM FORFEITING VALUABLE LEGAL RIGHTS FOR MYSELF AND/OR MY MINOR CHILD, AND ACCEPT ALL PROVISIONS FREELY AND VOLUNTARILY BY COMPLETING THIS DIGITAL REGISTRATION.
