PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, MEDICAL AUTHORIZATION, PHOTO RELEASE, DOG PARTICIPATION ADDENDUM, AND REFUND POLICY

In consideration of my entry being accepted into the RVBA 5k-9 Run/Walk, I, the undersigned participant, intending to be legally bound, hereby waive, release, and discharge any and all rights and claims for damages, losses, liabilities, injuries, or causes of action that I may have now or in the future against RVBA Roscoe Village Business Association, DK Races LLC, RunSignup.com, the Event Director, event officials, timers, sponsors, venue owners, municipalities, volunteers, contractors, agents, representatives, successors, and assigns, and all other persons or entities associated in any way with this event (collectively, the “Released Parties”), arising out of or related to my participation in this event, attendance at this event, travel to or from this event, or the participation of any dog brought by me to this event, whether occurring before, during, or after the event, to the fullest extent permitted by law. This release is binding upon me and upon my heirs, executors, administrators, personal representatives, and assigns.

I understand that running, walking, volunteering, spectating, and participating in a road race or related event are potentially hazardous activities that can result in serious injury, illness, disability, death, or property damage. I certify that I am medically able to participate, am physically fit, and am sufficiently trained for this event. I voluntarily assume all risks associated with participation, including but not limited to falls, contact with other participants, volunteers, spectators, animals, or vehicles, the effects of weather, heat, cold, humidity, rain, traffic, and course conditions, and all other risks commonly associated with road races and public events, whether known or unknown. I agree to abide by the instructions and decisions of race officials, medical personnel, law enforcement, and event staff regarding my ability to safely participate in or continue the event.

If I choose to participate with a dog, I represent, warrant, and agree that I am the owner of the dog or the authorized handler of the dog and that I accept full responsibility for the dog and all actions, behavior, and supervision of the dog at all times. I agree that the dog will remain in my care, custody, and control throughout the event and that I am solely responsible for any injury, damage, loss, claim, or expense caused by or arising from the dog’s participation, behavior, or presence at the event.[petfestmke +1]
I further represent and warrant that any dog I bring to the event is in good health, is current on rabies vaccination and any legally required vaccinations, is free of contagious conditions to the best of my knowledge, is physically able to participate, and has no known dangerous, vicious, or aggressive propensities. I understand that race officials and event staff may, in their sole discretion, refuse, restrict, or remove any dog or handler from the event for safety reasons, including aggressive, disruptive, uncontrolled, or unsafe behavior, and that no refund will be owed in such case.

I agree that any dog participating with me must be leashed at all times using a fixed, non-retractable leash not exceeding 6 feet and must remain under the control of a competent adult handler at all times. I agree to follow all posted event rules and all instructions of race officials and event staff regarding dog handling, staging, course etiquette, waste cleanup, spacing, and safety. I understand that failure to comply with these requirements may result in removal from the event without refund.

I knowingly and voluntarily assume all risks related to dog participation in the event, including but not limited to bites, scratches, falls, entanglement, leash-related incidents, collisions, dog fights, crowd interactions, noise sensitivity, heat-related illness, dehydration, overexertion, and injuries to me, my dog, other persons, other dogs, or property. I, on behalf of myself and anyone entitled to act on my behalf, waive and release all claims against the Released Parties arising out of or related to my dog’s participation or presence at the event, to the fullest extent permitted by law. I further agree to indemnify, defend, and hold harmless the Released Parties from and against any and all claims, demands, damages, liabilities, losses, costs, and expenses arising from or related to my acts or omissions or the acts, omissions, or behavior of my dog.

In the event of illness, injury, accident, or medical emergency involving me during or related to the event, I authorize the Event Director and event personnel to secure from any licensed hospital, clinic, physician, emergency responder, or other medical provider any care deemed necessary for my immediate treatment, and I agree to be fully responsible for all costs of such care, including transport, medications, treatment, and hospitalization. If my dog requires emergency attention during the event and I am unable to act, I authorize event personnel to obtain such veterinary or emergency care for my dog as may be deemed reasonably necessary under the circumstances, and I agree that all resulting costs are solely my responsibility.

I agree to comply with all event safety rules and all applicable health, safety, and public event requirements in effect at the time of the event, whether issued by governmental authorities, the host, the venue, or event management. I understand that such requirements may change and I agree to comply with them as a condition of participation.

I grant permission to the Released Parties to record, photograph, film, or otherwise capture my name, voice, likeness, image, race results, and, if applicable, the image or likeness of my dog, in connection with the event, and to use the same in any photograph, motion picture, recording, broadcast, website, social media, publication, advertisement, promotion, or other legitimate purpose related to the event or the promotion of future events, without compensation, notice, or further approval.

I understand and agree that all entry fees are non-refundable and non-transferable, including in the event of cancellation, postponement, modification, shortened course, format change, weather, emergency, public safety concerns, governmental order, act of God, or any circumstance beyond the control of the Released Parties. I understand that bib numbers are non-transferable and that event details may be changed at any time without prior notice.

By submitting my registration, signing electronically, or otherwise participating, I acknowledge that I have carefully read this Waiver and Release, fully understand its contents, understand that I am giving up substantial legal rights by signing it, and sign it freely and voluntarily without inducement. If the participant is under 18 years of age, the parent or legal guardian signing below acknowledges that they have read and agree to this Waiver and Release on behalf of the minor participant and consent to the minor’s participation subject to all of its terms. If a minor will participate with a dog, the parent or legal guardian accepts full responsibility for the dog and the minor’s handling of the dog.
