I agree that if I participate in this physical activity, program or event (the "Event") or use any Event facility or Event premises, I do so at my own risk.

I agree that I am voluntarily participating in the Event and assume all risk of injury, illness, damage or loss to me or my property that might result, including, without limitation, any loss or theft of personal property.

I agree to release, hold harmless, and covenant not to sue the Eagle Ridge Academy Donut Dash Event, their employees, agents, assigns, or any volunteer, participant, or spectator of the Event for any claim of ordinary negligence arising out of my participation in the Event. I understand that this release, hold harmless, and covenant not to sue is limited to claims for ordinary negligence and in no way shall be construed to release claims for conduct that constitutes greater than ordinary negligence, conduct that constitutes reckless or grossly negligent conduct or willful, wanton or intentional acts.

I further agree to allow Eagle Ridge Academy and sponsors, without limitation or compensation, the unrestricted right to utilize my image or name in video or still photography, for the promotion of this event.

I understand that this is a fundraising event and if I am unable to participate, the event will not issue me a refund.

I acknowledge that I have carefully read this Waiver and Release and fully understand it in full. By my signature and/or agreement with online registration I am waiving any right that I may have to bring legal action to assert a claim of ordinary negligence against Eagle Ridge Academy, subsidiaries and affiliates and all Event sponsors.
