PINK ON PARADE
(ADULT – Age 18 or Older): Waiver and Release of Liability; Assumption of Risk; and Indemity Agreement
1. I represent that: (i) I am at least eighteen (18) years of age or older; (ii) I am competent to enter into this Waiver and Release of Liability; Assumption of Risk; and Indemnity Agreement (“Agreement”); (iii) my physical condition is adequate to participate safely in the PINK ON PARADE (“Event”), (iv) I am responsible, and assume the risk, for my safety and well-being at all times during the Event.
2. I understand that the Event Organizers (as defined below) have the sole discretion to deny participation in the Event, at any time and/or for any reason they deem just and proper in their sole discretion. I agree to be familiar with, and abide by, any rules established for the Event and follow the instructions of Event Organizers at all times during the Event. For safety purposes, I agree to refrain from using headphones and cellular phones during the Event.
3. I understand the risks associated with my participation in the Event, including, without limitation, the potential for bodily injury, loss of or damage to equipment/property, exposure to extreme weather, conditions, and circumstances; contact with other participants, spectators, animals, or other natural or manmade objects; inadequate safety measures, participants of varying skill levels, situations beyond the immediate control of the Event Organizers, and other undefined, not readily foreseeable, and presently unknown risks and dangers (collectively, “Risks”). I understand that these Risks may arise from the actions or inactions of me and/or other participants or the negligent acts or omissions of the Released Parties (as defined below), and I expressly and knowingly assume all such Risks and responsibility for any damages, liabilities, losses or expenses which I may incur as a result of my participation in the Event.
4. I, and for my heirs, executors, administrators, assigns, or personal representatives hereby waive any and all rights, claims or causes of action of any kind whatsoever arising out of my participation in the Event, and do hereby Release, Waive, and Covenant Not to Sue, and I further agree to Indemnify, Defend and Hold Harmless, Riverside Community Health Foundation (“RCHF”) and the Event site (including its respective affiliates, Directors, Officers, employees, volunteers, agents, attorneys, representatives, successors and assigns, and the like), and all sponsors and/or beneficiaries of the Event (collectively, “Released Parties” or “Event Organizers”), from and against any and all liabilities, claims, demands, damages, causes of actions, loss or expense (including court costs and reasonable attorneys’ fees) of any kind or nature however arising out of, resulting from, or relating to my participation in the Event, including if caused in whole or in part by the negligent acts or omissions of the Released Parties.
5. I understand that photographs, video recordings, and other media will be taken during the Event. I hereby authorize and consent to the publication in any format or media by the Event Organizers of any materials containing my name, likeness, or image arising from my participation in the Event for the purpose of promoting RCHF, The Pink Ribbon Place, or the Event, or for any other purpose deemed appropriate by any of the foregoing, and I release RCHF, The Pink Ribbon Place, and the Event, and all persons acting under their authority, from any claims I might have due to the initial or subsequent publication of such materials.
BY SIGNING BELOW, I HEREBY WARRANT THAT: (i) I have read this Agreement carefully, and understand its terms and conditions; (ii) I acknowledge that I will be giving up substantial legal rights by signing this Agreement and have signed it without any inducement, assurance, or guarantee; (iii) this Agreement represents our complete understanding regarding these issues, and no oral representations, statements, or inducements have been made apart from this Agreement; (v) any provision of this Agreement held to be unlawful, void, or unenforceable shall be deemed severable from this Agreement and shall not affect the validity and enforceability of any remaining provisions; and (v) my signature below confirms my complete and unconditional acceptance of the terms, conditions, and provisions of this Agreement.

I represent that: (i) I am the parent or legal guardian of each minor named below (collectively, “Minor”); (ii) I am competent to enter into this Waiver and Release of Liability; Assumption of Risk; and Indemity Agreement (“Agreement”) on behalf of the Minor; (iii) the Minor’s physical condition is adequate to participate safely in the PINK ON PARADE (“Event”), (iv) I am responsible, and assume the risk, for the Minor’s safety and well-being at all times during the Event.
2. I understand that the Event Organizers (as defined below) have the sole discretion to deny participation in the Event, at any time and/or for any reason they deem just and proper in their sole discretion. I understand that the Minor is to be familiar with, and abide by, any rules established for the Event and follow the instructions of Event Organizers at all times during the Event. For safety purposes, I understand that the Minor must refrain from using headphones and cellular phones during the Event.

In consideration of you accepting this entry, I, the participant, intending to be legally bound do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against the Event Director, Riverside Community Health Foundation, RunSignup.com, and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.
I know that running a road race is a potentially hazardous activity. I should not enter and run unless I am medically able to do so and properly trained. I assume all risks associated with running in this event including, but not limited to: falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims which I might have based on any of those and other risks typically found in running a road race. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any race official relative to my ability to safely complete the run. I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event and that a licensed Medical Doctor has verified my physical condition.
In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.
As it applies to my participation in this race, I agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC’s guidance at: https://www.cdc.gov. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the community or by this race for my participation in this race.
Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.
This event follows the standard running industry policy: All entry fees are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable and bib numbers are non transferable.
By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver including the no refund policy.
