Waiver

In consideration of you accepting this entry, I, the participant, intending to be legally bound do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against the Event Director, Propel Forward, RunSignup.com, and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.

In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.

As it applies to my participation in this event, I agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC’s guidance at: https://www.cdc.gov. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the community or by this race for my participation in this event.

Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.

By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver including the no refund policy.

I, the undersigned __________________________________________ (hereinafter referred to as “Releasor”) for and in consideration of participating in Pistons and Props, an automobile and airshow (“Event”) do hereby execute this “WAIVER OF LIABILITY, RELEASE AND HOLD HARMLESS AGREEMENT”.

Releasor understands that the Pistons and Props and its Board of Directors, does not assume any liability for personal injury (including death) and/or property loss or damage that may occur during the “Event”. Releasor hereby agrees to assume any and all risks attendant to participation in the “Event” and releases, discharges and relinquishes all claims, debts, demands or causes of action that may have against the “Event”, Chairperson and volunteers that may arise as a result of the “Event” or Releasor’s participation in the “Event”. Releasor agrees to indemnify the “Event”, Propel Forward against all liabilities, judgements, costs, damages, and expenses that may be charged to or recovered from the “Event” on account of damage to property of REVV Aviation, Propel Forward, the “Event” and all the individuals involved in the “Event”. Any final judgement rendered against “Event” for any cause for which Releasor is liable shall be conclusive against Releasor as to liability and amount. 

Releasor specifically agrees to release and hold harmless the “Event” for any and all claims by Releasor, which may result from the “Event”. Releasor does hereby waive all claims, release, defend and hold harmless the “Event” Chairperson, and volunteers in both their private and public capacities from any and all liability claims, suits, demands, or causes of action which may arise from the above-described activity. 

It is further agreed that the execution of the “WAIVER OF LIABILITY, RELEASE AND HOLD HARMLESS AGREEMENT” will not constitute a waiver by the “Event” of the defense of governmental immunity where applicable, or any other defense recognized by the courts of the State of Wisconsin.

General Vendor Guidelines & Important Information:

Application Process: Vendor spaces are available on a first-come, first-served basis. Applications will be reviewed by the board to ensure diversity in product offerings. We aim to limit the number of similar vendors to create a more engaging experience for attendees.
Food Vendor Insurance: Food vendors must provide a certificate of liability insurance that names the following entities as additional insured:

Vendor Space Sizes:
Indoor Vendors: 10' x 10' (bring your own tables and chairs)
Outdoor Vendors: 20' x 20' (additional fees apply for larger footprints).
Outdoor Food Vendors: 20' x 20' or a standard-length food truck (additional fees apply for larger footprints).
Setup & Breakdown:
Indoor Vendors: Set up by 8:45 AM and remain until 4:00 PM (no early breakdown).
Outdoor Vendors: Set up by 9:00 AM and must be ready by 10:00 AM. Breakdown begins at 5:00 PM unless otherwise approved.
Waste Management: Vendors are responsible for removing all refuse from their space at the end of the event.
Alcohol: Vendors are not permitted to sell or serve alcohol.
Rain Date: In the event of inclement weather, the event will be rescheduled for July 20, 2025.
Compliance: Vendors must comply with all local and state regulations.
Food Truck Requirements: Food trucks must drop their trailers. Vehicles may not remain attached to food trucks during the event.
You are not allowed to sell water, soda, or Gatorade, to avoid overlap with our event beverage providers, without expressed written permission from the event Host.
 
Vendor Fees & Commission Policy:

Indoor Vendors: $75 (Early Bird rate)
Outdoor/Food Vendors:
$100 (before March 1st, 2025)
$125 (after March 1st, 2025)

Vendor Commission:
To incentivize our vendors and ensure a fair and equitable business relationship, we have established a commission policy for gross sales exceeding $10,000. This policy is designed to reward successful vendors while maintaining a sustainable business model.

Commission policy Overview:
The commission policy applies to vendors whose gross sales exceed $10,000. By implementing this policy, we aim to support vendors who achieve strong sales while also contributing to the overall success of the event.

Commission Policy Rate:
Threshold: Vendors will be charged a commission only on the amount that exceeds $10,000 in gross sales.
Rate: A 2.5% commission will be applied to the sales amount above the $10,000 threshold.

I certify that I have read the foregoing instrument, that I understand its terms and conditions, that I make this waiver and release voluntarily, and that I have not relied upon any representation made by the Event, its staff, volunteers in signing this waiver and release of claims.
