In consideration of being permitted to participate in the 2026 Amory Turkey Trot 5K (“Event”), I acknowledge that participation in a road race, running event, or walking event involves inherent risks that may result in serious injury, illness, permanent disability, death, or property damage.

I understand and voluntarily assume all risks associated with my participation in the Event, whether known or unknown, including but not limited to falls; slips; trips; uneven or defective road or sidewalk surfaces; potholes; curbs; intersections; vehicles and traffic; contact or collisions with other participants, spectators, volunteers, animals, bicycles, or other persons or objects; weather conditions; heat; cold; rain; dehydration; physical exertion; fatigue; medical emergencies; equipment failure; course conditions; and any other risks ordinarily associated with participating in a road race or outdoor athletic event.

I certify that I am physically capable of participating in this Event and understand that it is my responsibility to determine whether I am sufficiently healthy and prepared to participate. I accept full responsibility for my physical condition and my decision to participate. I agree to follow all instructions, rules, traffic controls, course markings, and safety directions provided by race officials, law enforcement, volunteers, or other Event personnel.

To the fullest extent permitted by law, I, on behalf of myself and my heirs, executors, administrators, personal representatives, successors, and assigns, hereby waive, release, discharge, and agree to hold harmless MoveWell, LLC; the City of Amory, Mississippi; their respective elected and appointed officials, officers, employees, departments, representatives, agents, contractors, and volunteers; the Event Director and Event organizers; RunSignup; the race timing company and its personnel; all Event sponsors and their respective owners, officers, employees, representatives, and agents; all Event volunteers; participating property owners; vendors; service providers; and any other individuals or organizations involved in organizing, sponsoring, supporting, permitting, providing services for, or conducting the Event (collectively, the “Released Parties”) from any and all claims, demands, causes of action, damages, losses, liabilities, costs, or expenses arising out of or relating to my participation in the Event, including injury, illness, death, or damage to or loss of personal property, to the fullest extent permitted by applicable law.

This release is intended to include claims arising from the ordinary negligence of any Released Party to the extent such claims may lawfully be released under Mississippi law. Nothing in this agreement is intended to waive or release any claim that cannot legally be waived or released.

I understand that streets along or near the race course may contain vehicular traffic and that road conditions cannot be guaranteed. I understand that the presence of law enforcement officers, traffic-control personnel, barricades, cones, signs, course marshals, or volunteers does not eliminate all risks associated with traffic or participation in the Event. I agree to remain alert, follow the designated course, obey instructions from Event personnel and law enforcement, and exercise reasonable care throughout the Event.

In the event of an accident, illness, injury, or medical emergency, I authorize Event personnel to obtain or arrange emergency medical assistance that they reasonably believe is necessary. I understand that neither the Event nor any Released Party is responsible for providing medical insurance or paying for medical treatment on my behalf. I accept responsibility for medical expenses incurred as a result of my participation, except to the extent otherwise required by applicable law.

I understand that the Event may be postponed, modified, shortened, relocated, delayed, or canceled because of weather, unsafe course conditions, emergencies, governmental directives, acts of God, or other circumstances that Event organizers determine could affect participant or public safety. I understand that Event organizers may modify the course, schedule, start time, procedures, or other Event details when reasonably necessary.

All registration fees are non-refundable unless otherwise expressly stated by the Event organizer. I understand that failure to participate, disqualification, removal from the course, weather, or other circumstances outside the Event organizer's control do not automatically entitle me to a refund. Race bibs and registrations may not be transferred unless expressly authorized by the Event organizer.

I grant MoveWell, LLC and its authorized Event partners permission to photograph, videotape, record, or otherwise capture my participation in the Event and to use my name, likeness, image, voice, race results, and photographs or recordings taken in connection with the Event for legitimate Event-related, promotional, advertising, archival, and informational purposes in any media, without compensation to me, to the extent permitted by law.

I understand that participation in the Event is voluntary. I acknowledge that I have read this Participant Waiver, Release & Assumption of Risk carefully, understand its terms, understand that I am giving up certain legal rights by agreeing to it, and voluntarily agree to be bound by it.

PARTICIPANTS UNDER AGE 18: If the participant is under 18 years of age, I certify that I am the participant's parent or legal guardian and have authority to enter into this agreement on the participant's behalf. I give permission for the minor to participate in the Event, acknowledge the risks associated with the minor's participation, authorize emergency medical care as described above, and agree to the terms of this waiver and release on behalf of myself and the minor to the fullest extent permitted by applicable law.

By electronically accepting this waiver and completing registration, I acknowledge that my electronic acceptance is intended to serve as my signature and agreement to the terms above.
