ASSUMPTION OF THE RISK. I acknowledge and understand the following:

1. Participation includes possible exposure to and illness from infectious diseases including but not limited to COVID-19. While particular rules and personal discipline may reduce this risk, the risk of serious illness and death does exist;

2. I knowingly and freely assume all such risks related to illness and infectious diseases, such as COVID-19, even if arising from the negligence or fault of the Released Parties; and

3. I hereby knowingly assume the risk of injury, harm and loss associated with the Activity, including any injury, harm and loss caused by the negligence, fault or conduct of any kind on the part of the Released Parties.

WAIVER AND RELEASE
This WAIVER AND RELEASE (this “Release”) is being provided by the undersigned (the “Participant”) in connection with the Glowing Smiles 5k run/walk and Kids dash (the “Event”). For the opportunity to participate in the Event, the Participant knowingly and voluntarily, hereby releases, waives, forever discharges the Vergara family, all sponsors, helpers, volunteers, and other participants, and their heirs (collectively, “Released Parties”) from and against all demands, damages, liabilities, obligations, suits, and any other claims whatsoever, in law or in equity (collectively, “Claims”) of any kind, nature or description whatever, whether known or unknown (and if unknown, regardless of whether knowledge of the same may have affected the decision to make this Release), which now exist or which may hereafter arise based on any fact or circumstance arising from, related to, or in connection with the Participant’s attendance at or participation in the Event. 

I am aware and agree to allow the Released Parties to take photograph and videos during the event and I agree such photos/ videos may be used with or without my name for any lawful purposes, including but not limited to publicity illustration and web content. I hereby grant Released Parties permission to use my likeness in photograph, video, or other digital media in any and all of its publications, including web-based publications, without payment or other consideration. I waive the right to inspect or approve the product where my likeliness appears, and I waive the right to royalties or other compensation related or arising from the use of the photographs or videos.

The Participant makes this Release on behalf of all children under the age of 18 or other persons under the care of the Participant accompanying the Participant. The Participant acknowledges that he/she has read this Release and intends to be legally bound by this document. I, the Participant, agree I am responsible for children under the age of 18 or other persons under my care that I have registered, and make this Release on my and their behalf.
