WAIVER, INDEMNITY AND RELEASE OF LIABILITY

I understand that while participating in this Event or in training programs and related activities, I will be using public streets and facilities where many hazards exist, and I am aware of and appreciate the risks that may result. I am also aware that accidents may occur during this event which could result in serious injury or death. I am voluntarily participating in this event with knowledge of all such risks. 

I am physically capable of completing this Event. I will maintain personal health insurance while participating in the Event. I acknowledge that I am solely responsible for my personal health and safety, and the personal property I bring with me. I consent to treatment in the event of an emergency or other incident in which, in the reasonable judgment of the on-site personnel, I require medical care.

In consideration of the acceptance of this registration entry, I ASSUME FULL AND COMPLETE RESPONSIBILITY FOR ANY BODILY INJURY, PERSONAL INJURY, ILLNESS OR PROPERTY DAMAGE THAT MAY RESULT FROM MY PARTICIPATION IN THE EVENT, AND I (ON BEHALF OF MYSELF, MY HEIRS, PERSONAL REPRESENTATIVE AND ASSIGNS) HEREBY RELEASE, INDEMNIFY AND HOLD HARMLESS THE EVENT DIRECTOR, RUNSIGNUP.COM, MS RUNNING PRODUCTIONS, LAST MILE TIMING, EVENT VOLUNTEERS, YALE NEW HAVEN HOSPITAL, ITS AFFILIATES, AND ITS AND THEIR RESPECTIVE OFFICERS, EMPLOYEES, AGENTS AND REPRESENTATIVES, (HEREINAFTER AS “YNHH”), FROM (1) ANY AND ALL CLAIMS OF NEGLIGENCE WITH RESPECT TO LOSSES, INJURIES, AND LIABILITIES, OR DAMAGES (COLLECTIVELY, “CLAIMS”) MADE BY ANY THIRD PARTY ARISING FROM OR RELATED TO MY PARTICIPATION IN THIS EVENT OR (2) CLAIMS  ARISING FROM THE  NEGLIGENCE OF YNHH THAT I HAVE  BASED UPON ANY ACTS OR OMISSIONS, WHETHER KNOWN OR UNKNOWN, RELATING TO, ARISING OUT OF, OR IN CONNECTION WITH THE EVENT.  I ALSO AGREE TO INDEMINIFY AND HOLD HARMLESS (MEANING I AGREE TO PAY OR REIMBURSE YNHH FOR) ANY COSTS, PENALTIES, LEGAL FEES, OR JUDGMENTS THAT YNHH HAS TO PAY RELATED TO MY PARTICIPATION IN THE PROGRAM, EVEN IF THE COSTS RESULTED FROM YNHH’S NEGLIGENCE. This agreement may not be modified orally or in writing by any individual. I understand and acknowledge that running/walking involves inherent dangers that no amount of care, caution, instruction, or expertise can eliminate, and I am participating at my own risk.

I permit and authorize the free use and publishing of my name, image and picture in websites, broadcasts, telecasts, and the press as it pertains to this Event.

This agreement is intended to be as broad and inclusive as permitted by the laws of the State of Connecticut and should be interpreted in accordance with Connecticut law. If any portion of this agreement is held to be invalid, it is agreed that the remainder shall continue to have full legal force and effect.

PROVISIONS RELATING TO MINOR PARTICIPANTS IN THE EVENT

Waiver, Indemnity and Release of Liability for Minors Under the Age of 18. If you are a parent or guardian registering for a minor, please include your information as well as the minor's information. I hereby grant my child permission to participate in this Event. In consideration of the acceptance of this registration entry, I freely accept and voluntarily assume the risks of personal injury or property damage that may result from this potentially hazardous activity on behalf of my child.

I accept responsibility to inform my child that Yale New Haven Hospital has the right to disqualify and dismiss anyone that may cause disturbance during this event. I also understand that this is my responsibility to ensure proper training has occurred and that my child has been instructed on the Event, traffic rules and safety. I agree to accept any and all responsibility for disregarding these rules.

I assume full and complete responsibility for any injury or accident which may occur during my child’s participation in the Event, and I hereby release, indemnify and hold harmless Yale New Haven Hospital and its respective officers, employees, agents and representatives from any and all claims, losses, injuries, and liabilities, or damages (collectively, “Damages”) including said claims that may arise from the negligence of YNHH that I have on behalf of my child based upon any acts or omissions, whether known or unknown, relating to, arising out of, or in connection with the Event.  I also agree to indemnify and hold harmless (meaning I agree to pay or reimburse YNHH for) any costs, penalties, legal fees, or judgments that YNHH must pay related to my child’s participation in the program, even if the cost resulted from YNHH’s negligence. This agreement may not be modified orally or in writing by any individual. I understand and acknowledge that running/walking involves inherent dangers that no amount of care, caution, instruction, or expertise can eliminate, and I am allowing my child to participate at his or her own risk. I understand that every child must be accompanied by a responsible adult over the age of 21 at all times during the Event and that it is my responsibility to fulfill this requirement.

I will permit emergency treatment in the event of injury or illness while participating and give permission to use my child's name and photo taken during the event in any websites, broadcasts, telecasts and the press as it pertains to this Event.
