In consideration of you accepting this entry, I, the participant, intending to be legally bound do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against the Event Director, RunSignup.com, and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.

I know that running a road race is a potentially hazardous activity. I should not enter and run unless I am medically able to do so and properly trained. I assume all risks associated with running in this event including, but not limited to: falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims which I might have based on any of those and other risks typically found in running a road race. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any race official relative to my ability to safely complete the run. I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event and that a licensed Medical Doctor has verified my physical condition.

In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.

As it applies to my participation in this race, I agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC’s guidance at: https://www.cdc.gov. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the community or by this race for my participation in this race.

Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.

This event follows the standard running industry policy: All entry fees are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable and bib numbers are non transferable.

By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver including the no refund policy.

PLEASE READ CAREFULLY—THIS IS A LEGAL DOCUMENT THAT AFFECTS YOUR LEGAL RIGHTS!

THIS RELEASE AND WAIVER OF LIABILITY AND ASSUMPTION OF RISK (the Release) is executed on this day by the Participant, in favor of FIVE STAR NTP with an address of 59 Hwy. 9 South, Dawsonville, GA 30534, its members, managers, officers, employees, contractors, volunteers, and agents (collectively, the Releases).

I, the Participant, wish to participate in or assist the Releasees in conducting the event or activity named above (the Event).  I understand that the Event (or future Events if this Release covers more than a single Event) may include, without limitation, running and walking races; competitions, which may be strenuous and physical in nature; fairs; displays; booths; educational presentations; and other events in which I may come into contact with many members of the general public, adults and children.  My participation in the Event may include, without limitation, traveling to and from the Event; consuming food or drink available or provided at the Event; erecting or dismantling display materials and booths; interacting with adults and children who may be unknown to me or the Releasees; and competing in physically strenuous activities.  If I wish to  participate regularly in Events, this Release may remain valid for a period up to and including one (1) year, and its validity shall be determined by the dates written above.

I, THE UNDERSIGNED PARTICIPANT, FREELY, VOLUNTARILY AND WITHOUT DURESS EXECUTE THIS RELEASE TO ATTEST TO MY UNDERSTANDING AND AGREEMENT TO THE FOLLOWING TERMS:

•          I, the undersigned Participant, knowingly assume the risk of injury, harm and loss associated with my involvement as a Participant at the Event.

•          I, the undersigned Participant, understand that there is an inherent risk in connection with the Event in that my participation may include activity that is physically demanding and/or competitive, and I expressly and specifically assume the risk of injury or harm related to such activities and release, indemnify, and hold harmless the Releasees, to the fullest extent permitted by law, from any and all liability for loss, cost, expense, injury, illness, death or property damage resulting directly or indirectly from my involvement in the Event as a Participant.  I acknowledge that such risk is increased if I am overweight or unaccustomed to strenuous exercise and assume all known and unknown risks, whether or not they may be increased by the condition of my physical or mental health.

•          I, the undersigned Participant, understand and acknowledge that the Releasees do not assume any responsibility for or obligation to provide financial or other assistance, including but not limited to medical, health or disability insurance in the event of injury, illness, death or property damage. I understand that the Releasees are under no obligation to provide, carry or maintain health, medical, travel, accident, disability or other insurance coverage for any Participant, and I agree that I am solely responsible for any such costs or expenses.

•          I, the undersigned Participant, hereby release and forever discharge, hold harmless and indemnify the Releasees and their successors and assigns from any and all liability, claims and demands which I or my heirs, assigns, next of kin or legal representatives may have or which may hereinafter accrue with respect to any bodily injury, personal injury, illness, death or property damage which may now or hereafter arise from or is in any way related to my participation in an Event, whether caused wholly or in part by the negligence, fault or other misconduct of the Releasees or of other Participants.

•          I, the undersigned Participant, agree that, in the case of injury or medical emergency, the Releasees may seek on my behalf, or administer to me, such first aid or emergency medical care is deemed necessary for my welfare, but that the Releasees are under no special obligation to do so.  Any cost or liability associated with such services received during my participation in an Event shall be solely my responsibility and not that of the Releasees.

•          I, the undersigned Participant, expressly agree that this Release shall be governed by Georgia law, and, to the extent Georgia law may not apply, is intended to be as broad and inclusive as permitted by the laws of the state where the Event takes place. I further agree that in the event any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining clauses or provisions of this Release, which shall continue in full force and effect.

•          I, the undersigned Participant, hereby grant and convey unto FIVE STAR NTP all right, title and interest in any and all photographs and video or audio recordings of or including my image or voice, made by any of the Releasees in connection with an Event, including, without limitation, the right to use and publish such photographs or recordings for any purpose, without notice to me, and to any royalties, proceeds or other benefits derived from them.

·                     I, the undersigned Participant, understand that the event is designed to be family orientated and a positive experience.  If I, or anyone in attendance with me displays unsportsmanlike conduct towards any other participant, spectator, volunteer, sponsor, or staff; I will be removed from premises and removed from any and all results with no refunds.

I HAVE READ THIS RELEASE AND WAIVER OF LIABILITY AND ASSUMPTION OF RISK, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT.

If the Volunteer/Participant is under 18 years of age, I, a parent having legal custody or the legal guardian of the Volunteer/Participant also hereby release and forever discharge the Releasees, for myself and on behalf of such minor Volunteer/Participant, from any claim whatsoever in connection with the Event, including, without limitation, a claim which arises or may hereafter arise on account of the decision by any representative or agent of the Releasees to exercise the power to consent to medical or dental treatment on behalf of the Volunteer/Participant.

 --Additional COVID-19 Waiver--

I further agree to abide by the Center for Disease Control’s (CDC) recommendations for the prevention of the spread of the 2019 Novel Coronavirus Disease (COVID-19) and other communicable diseases, and I attest to having read the CDC’s guidance at: https://www.cdc.gov/coronavirus/2019-ncov/prepare/prevention.html. I assume all such risks being known, appreciated, and accepted by me. I acknowledge the contagious nature of COVID-19 and other communicable diseases and voluntarily assume the risk that I may be exposed to or infected by COVID-19 and/or other communicable diseases by participating in this event. I acknowledge that such exposure or infection may result in personal injury, illness, permanent disability, and/or death. I understand that the risk of becoming exposed to or infected by COVID-19 in connection with my participation in this event and personally assume this risk

MUST BE 18 OR OLDER TO AGREE TO THE TERMS PROVIDED. MINORS MUST HAVE THIS

COMPLETED BY A PARENT OR GUARDIAN.

LIABILTY WAIVER

I hereby waive, release and discharge any and all claims for damage for personal

injury, death or property damage which I may have, or which may hereafter accrue to

me, as a result of participation in activities at any City of Lovejoy facilities or while in any

City of Lovejoy vehicles. This release is intended to discharge in advance the City of

Lovejoy, its employees and agents from any and all liability arising out of or connected

in any way with my participation in activities at this or any City of Lovejoy facility or

vehicle even though that liability may arise out of negligence or carelessness on the

part of those parties. It is understood that activities such as the ones I will be

participating in involve an element of risk and danger of accidents and knowing those

risks, I hereby assume those risks. It is further agreed that this waiver, release and

assumption of risk is to be binding on my heirs and assigns. I agree to indemnify and to

hold harmless, the City of Lovejoy, its employees and agents from any loss, liability,

damage, cost or expense which they may incur as the result of my death or any injury

or property damage that I may sustain while participating in any activity involving

Lovejoy facilities or vehicles.

I am the parent or legal guardian of the participant listed below. I hereby consent that

the participant may participate in activities taking place on City of Lovejoy property

and using City of Lovejoy vehicles and I hereby execute the Agreement, Waiver and

Release on his/her behalf. I hereby affirmatively state that the said Participant is

physically able to participate in said activity. I hereby agree to personally supervise and

monitor participant while engaged in said activity. I hereby agree to indemnify and

hold the persons and entities mentioned above free and harmless from any loss, liability,

damage, cost or expense that they may incur as result of the death or any injury or

property damage that said participant may sustain while participating in activities at

any such Lovejoy facility.

I have carefully read this agreement, waiver and release and fully understand its

contents. I am aware that this is a release of liability and a contract between myself

and the City of Lovejoy and I sign it of my own free will.

VOLUNTEER AGREEMENT

• Volunteers must sign in and sign out at the designated station for all events.

• You must wear the provided Volunteer ID Badge for the duration of your volunteer

time.• Volunteers are expected to conduct themselves in a friendly and courteous manner.

• Be mindful that giveaways and food at City functions are meant for guests to enjoy.

Please do not take more than the allotted amount.

• Volunteer assignments will be mandated by the staff member(s) managing the event.

Requests for specific assignments will not be considered unless you have a related

health concern.

• We ask that volunteers immediately notify the staff of all safety concerns that may

arise

• School organizations are welcome. Students must be supervised by an adult teacher,

advisor, or authorized parent volunteer.

Individuals that fail to comply with the rules set forth may be removed from the

volunteer list.

In consideration of the above named individual being allowed to participate in any

way in the City of Lovejoy’s events and activities, I, the undersigned acknowledges and

agrees that:

• The risk of injury to participant from the activities involved in these programs exists but

unlikely. Injury may include the potential for falling, exposure to heat/cold, and/or

death, and while particular rules, equipment, and personal discipline may reduce this

risk, the risk of serious injury does exist; and,

• For myself, spouse, and/or child, I knowingly and freely assume all such risks, both

known and unknown, even if arising from the negligence of the city or others, and

assume full responsibility for my nor my child's participation; and,

• I willingly agree to comply with the events stated and terms and conditions for

participation and will exercise ordinary and reasonable due care. If I observe any

unusual significant concern in my or my child's participation, I will remove myself or my

child from the participation and bring such attention of the nearest emergency official

immediately, if necessary; and,

• I myself, my spouse, my child, and on behalf of my/our heirs, assigns, personal

representatives and next of kin, HEREBY RELEASE AND HOLD HARMLESS THE CITY OF

LOVEJOY, its directors, officers, officials, agents, employees, volunteers, other

participants, sponsoring agencies, sponsors, advertisers, and if applicable, owners and

lessors of premises used to conduct the event ("Releases"), with respect to any and all

injury, disability, death, or loss or damage to person or property incident to my or my

child's involvement or participation in this event, whether arising from the negligence of

the releasees or otherwise, to the fullest extent permitted by law.PHOTO RELEASE

I grant to The City of Lovejoy, its representatives and employees the right to take

photographs of me and my property in connection with the above-identified subject. I

authorize The City of Lovejoy to use and publish the same in print and/or electronically.

I agree that The City of Lovejoy may use such photographs or video of this event with or

without my name and for any lawful purpose, including for example such purposes as

publicity, illustration, advertising, and Web content.

COVID WAIVER

I am voluntarily choosing to enter onto premises owned, leased, or managed by the

City of Lovejoy. I acknowledge that entering the premises may expose me to hazards or

risks that may result in my illness, injury, or death including, but not limited to, risk of

COVID-19 infection. I fully understand and am aware of the serious nature of such

hazards and risks and accept all with no reservation of right or extension of liability

whatsoever. I acknowledge that I will have no legal recourse for anything closely or

remotely considered for cause or contributory cause to any damages, injury or harm

from choosing to enter the premises. I understand and agree that the risk of COVID-19

infection cannot be eliminated even through reasonable precautions taken by the City

of Lovejoy. In consideration of being permitted to participate in this event, I further

agree that I shall indemnify, defend, and hold harmless the City of Lovejoy, its

employees, representatives, officers, and agents from all claims, suits, or actions related

to COVID-19 infection arising out of my presence on the premises, other than deliberate

acts of gross negligence by the City of Lovejoy, its officers, employees, and/or agents.

I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY

UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY

SIGNING IT, AND SIGN IT FREELY AND VOLUNTARILY WITHOUT ANY INDUCEMENT. IF ON

BEHALF OF A MINOR, I, BY SIGNING BELOW, ACKNOWLEDGE AND AFFIRM THAT I AM THE

PARENT AND/OR LEGAL GUARDIAN OF MINOR PARTICIPANT AND HAVE THE AUTHORITY

TO SIGN ON MINOR’S BEHALF. FAILURE TO SIGN THIS AGREEMENT SHALL RESULT IN YOUR

NON-PARTICIPATION.
