2024 Lobo Cancer Challenge Agreement and Waiver
The Lobo Cancer Challenge is a special event coordinated by the UNM Comprehensive Cancer Center. The mission of the UNM Comprehensive Cancer Center is to provide unique, specialized and essential cancer care to all New Mexicans. As a participant, you will help raise awareness and help raise funds for research and patient care.
The Lobo Cancer Challenge wants all participants to have fun, but also to take their fundraising efforts seriously. We want each participant to be successful in raising at least the suggested fundraising minimum. We will provide ideas and fundraising tips throughout your fundraising efforts to help you reach your goal. We will also provide fundraising incentives to a certain number of participants who raise more than the minimum amount. And, we will recognize and honor the top three fundraising individuals and teams, so don't stop at just the suggested fundraising minimum!

If the above participant is a MINOR (under age 18), parent or legal guardian must approve the submission of this Lobo Cancer Challenge Agreement and Waiver.
I, the undersigned, state that I am the parent or legal guardian of the Participant, who is a minor and whose name appears above. I understand that the all of the Lobo Cancer Challenge Agreement and Waiver (Agreement) terms and conditions apply to said Participant and myself. I further understand that said Participant cannot participate under ANY circumstances without parental/guardian consent. This Agreement is binding upon myself, the said Participant, and any person suing on behalf of said Participant.
Fundraising Agreement
I understand that my registration fee, as set forth below, is non-transferable and non-refundable. The registration fee is not tax deductible and does not count toward any fundraising commitment.

In consideration of the acceptance of my registration to participate as a Lobo Cancer Challenger:
I agree to try and raise the suggested fundraising minimum amount in associated with the participant type.
I agree that ALL money raised, whether I complete the event or not, will be donated to the Lobo Cancer Challenge and is not subject to refund to me or my donors for any reason.
I agree to satisfy the suggested fundraising amount as of 11:59pm, on Monday, September 30th, 2024.
I agree that if I become injured and I choose not to participate, however I will still fundraise.
If I am younger than 18, I will require a parent or legal guardian to sign and agree to this Lobo Cancer Challenge Agreement and Waiver.
I agree that if the 2024 Lobo Cancer Challenge is cancelled, moved to another location, or rescheduled for any reason including but not limited to an Act of God, act of terrorism, or civil unrest, that I will still be responsible for meeting my fundraising minimum and that I will not receive a refund of my registration fee or monies donated by me, or by a third party on my behalf.
Participant Agreement
Riding, running, walking or climbing is not a risk-free activity. The Lobo Cancer Challenge will organize and provide as safe a route as possible. We will require all participants to follow our safety rules during the event.
At all times while participating in the Lobo Cancer Challenge, I agree to abide by all rules and regulations established by Lobo Cancer Challenge organizers, staff and support personnel as well as all traffic laws and local vehicle codes and all rules of the road for listed below:
Cyclists
· Helmet must be worn at all times while riding a bicycle;
· Obey all traffic signs, signals and rules of the road at all times;
· Headphones, iPods and radios are strictly prohibited while riding;
· Obey all instructions from all law enforcement personnel at all times;
· Obey instructions from the Lobo Cancer Challenge staff, road crew and volunteers;
· Ride single file and as far to the right of the road as possible, except to pass as a cyclist;
· Pass on the left side only as a cyclist;
· Ride defensively in consideration of your fellow riders;
· Use proper hand signals when turning;
· Communicate with your fellow riders, using proper cycling terms such as "on your left" and "car back";
· The Lobo Cancer Challenge is a ride, it is not a race and should not be treated as a race at any time;
· Cross railroad tracks at right angles;
· Do not cross the yellow centerline regardless of passing zone;
· When approaching intersections that require vehicles to yield or stop, each cyclist is responsible for verifying that the intersection is clear before proceeding in the intersection;
· Ride in control of your bicycle at all times, including being able to stop within a reasonable distance;
· Endangering the safety of your fellow riders is strictly prohibited;
· When you stop, move well off the road so you do not interfere with oncoming traffic;
· When you embark after stopping, yield to oncoming traffic before proceeding into the road;
· I agree that I will not ride with an infant or child seat along with any other riding apparatus attached to my bicycle;
· While participating in the Lobo Cancer Challenge, I will be using public streets and facilities and where many hazards exist and I am aware and appreciate the risks that may result;
· If I as a rider observe any unusual or significant hazard during the Lobo Cancer Challenge, I will immediately bring the hazard to the attention of the nearest official or Lobo Cancer Challenge staff;
· The risk of injury from participating in the Lobo Cancer Challenge is significant, including the potential for dehydration, permanent paralysis and death and while rules, safety initiatives, equipment and personal discipline may reduce this risk, the risk of serious injury does still exist;
· I acknowledge and agree that I, and I alone, am solely responsible for my personal health and safety and all personal property that I bring with me to the Lobo Cancer Challenge;
· I, as a rider, will maintain personal health insurance while participating in the Lobo Cancer Challenge;
· I knowingly and freely assume all such risks, both known and unknown, associated with participating in the Lobo Cancer Challenge, and, understanding such risks, voluntarily want to participate in the Lobo Cancer Challenge; and
· I consent to treatment in the event of an emergency or incident if, in the judgment of the on-site personnel, I require medical care.
Stair Climb/5K/Cub Pack
· Obey all traffic signs, signals and rules of the road at all times;
· Headphones, iPods and radios are strictly prohibited while running/walking;
· Obey all instructions from all law enforcement personnel at all times;
· Obey instructions from the Lobo Cancer Challenge staff, road crew and volunteers;
· The Lobo Cancer Challenge is a run/walk, it is not a race and should not be treated as a race at any time;
· When approaching intersections that require vehicles to yield or stop, each runner/walker is responsible for verifying that the intersection is clear before proceeding in the intersection;
· Endangering the safety of your fellow runners/walkers is strictly prohibited;
· When you stop, move well off the road so you do not interfere with oncoming traffic;
· When you embark after stopping, yield to oncoming traffic before proceeding into the road;
· While participating in the Lobo Cancer Challenge, I will be using public streets and facilities and where many hazards exist and I am aware and appreciate the risks that may result;
· If I as a runner/walker observe any unusual or significant hazard during the Lobo Cancer Challenge, I will immediately bring the hazard to the attention of the nearest official or Lobo Cancer Challenge staff;
· The risk of injury from participating in the Lobo Cancer Challenge is significant, including the potential for dehydration, permanent paralysis and death and while rules, safety initiatives, equipment and personal discipline may reduce this risk, the risk of serious injury does still exist;
· I acknowledge and agree that I, and I alone, am solely responsible for my personal health and safety and all personal property that I bring with me to the Lobo Cancer Challenge;
· I, as a runner/walker, will maintain personal health insurance while participating in the Lobo Cancer Challenge;
· I knowingly and freely assume all such risks, both known and unknown, associated with participating in the Lobo Cancer Challenge, and, understanding such risks, voluntarily want to participate in the Lobo Cancer Challenge; and
· I consent to treatment in the event of an emergency or incident if, in the judgment of the on-site personnel, I require medical care.
I agree that I am physically capable of participating in the Lobo Cancer Challenge. If I am aware of or am under treatment for any physical ailment or illness, I will obtain my medical care provider's approval to participate in the Lobo Cancer Challenge. I am aware and will provide a doctor's note or other proof of primary health care provider has permitted me if asked by Lobo Cancer Challenge staff.
Release
I, on behalf of myself (including Minor Participant, if applicable), and my heirs, assigns, personal representatives, administrators, estate and next of kin, hereby voluntarily, irrevocably and forever:
(i) release the Lobo Cancer Challenge/UNM Comprehensive Cancer Center, Medalist Sports, LLC, each sponsor of the Lobo Cancer Challenge, each funding partner of the Lobo Cancer Challenge, each vendor providing goods or services to the Lobo Cancer Challenge, each owner and/or lessor of any premises, property or piece of equipment used to conduct the Lobo Cancer Challenge, each of the foregoing parties' respective affiliates, each of the foregoing parties' respective current and former owners, partners, members, officer, directors, trustees, advisors, consultants, employees, agents, volunteers, officials, board members, representatives, successors, assigns and other participants (each a “releasee” and collectively, “releasees”), and also agree to release the University of New Mexico ("UNM"), the Regents of the University of New Mexico, the affiliates of UNM, and its directors, officers, representatives, members, agents, employees, participants, volunteers, students, their respective affiliates from any and all liability for negligence or for any other claim, judgment, loss, liability, cost and expenses (including, without limitations, attorney's fees and costs) arising out of, or connected with, the activity from any and all liability whatsoever, including without limitation, liability for any and all injuries, disabilities, death, losses or damages to person or property, arising directly or indirectly in connection with my participation in the Lobo Cancer Challenge whether or not caused by any act or omission of the releasees including recklessness, active or passive negligence, or other fault of the releases, to the fullest extent permitted by law;
(ii) Waive my right to sue or make any demand whatsoever against any releasee for any damages or losses arising, directly or indirectly, in connection with my participation in the Lobo Cancer Challenge;
(iii) agree never to sue any releasee asserting any claim for damages or losses suffered, directly or indirectly, in connection with my participation in the Lobo Cancer Challenge; and
(iv) agree to indemnify and hold each releasee harmless from any and all claims, demands, suits, damages, expenses, cost, liabilities, judgments, settlements, and losses of any and every kind suffered or incurred by any release and arising, directly or indirectly, in connection with my participation in the Lobo Cancer Challenge.
Consent for Publicity Waiver
By accepting this Lobo Cancer Challenge Agreement and Waiver, I hereby consent to the use of my name and image by the Lobo Cancer Challenge to promote its event. I also understand that I will not be compensated for any such use.
By accepting this Lobo Cancer Challenge Agreement and Waiver, I hereby give permission for news release, photographs, video, audio, publications, newspapers, magazines, advertisements, reports and website.
I also have the option to withdraw this permission by submitting a letter to:

I understand that retraction of my permission does not obligate the Lobo Cancer Challenge to remove previously distributed content.
I Accept
I understand and agree that my registration as a participant in the Lobo Cancer Challenge is NOT transferrable, even if I do not or cannot participate for any reason.
I have read and understand the above. I hereby commit to being a Lobo Cancer Challenger and to meet the expectations set forth above. I acknowledge that I am participating in the Lobo Cancer Challenge to benefit the UNM Comprehensive Cancer Center. I acknowledge that as a Lobo Cancer Challenger, I will be engaging in fundraising activities to benefit the UNM Comprehensive Cancer Center and that any funds raised or held pursuant to such activities will be forwarded to the Lobo Cancer Challenge. I am agreeing to all of the terms of the fundraising waiver, publicity consent and participation agreement and understand that by agreeing to these terms I am waiving significant legal rights. I am aware that by signing this fundraising waiver, participation agreement and publicity consent or by selecting the "I accept" button during the on-line registration process, I am agreeing to all the terms listed above in this Lobo Cancer Challenge Agreement.
