In consideration of acceptance of my entry, I hereby release, discharge, and agree to hold harmless the “Footin’ It For Family” 5K organization, Cohocton Lions
Club, Gene and Pat Drum Farms, Simolo Farms, Town of Cohocton, Steuben County, New York State, any sponsors, officials or organizers of this event and each
of them together with their successors, assigns, officers, agents and employees from any and all liability for injuries to property or person suffered by me as a
result of my participation in this event. By execution of this waiver, I assume all risks associated with my participation in this event including, but not limited to
falls, the effects of weather, traffic, road and trail conditions, and all risks associated with running or walking in a country setting whether or not such risks are
specifically known or appreciated by me. I specifically agree that is it not the duty of any of the parties listed above to check, monitor, or evaluate my physical
condition for the appropriateness of my participation in this event at any time. I agree to indemnify any of the parties listed above for damages cause by me to
any such party or parties and any third parties, by virtue of my participation in this event. I further agree to yield to all emergency vehicles on the course in the
event they must treat another participant.
I also give my consent and permission the irrevocable right to use, for any purpose whatsoever and without compensation, (I) any photographs, videotapes,
audiotapes of me that are made during the course of this event; and (II) the results of my participation in this Event (e.g. race time, name, participant number).
I understand that I have given up substantial rights by signing this release, and have signed it freely and voluntarily with out any inducement, assurance or
guarantee being made to me and intend my signature to be a complete and unconditional release of liability to the greatest extent allowed by law.
