In consideration of you accepting this entry, I, the participant, intending to be legally bound and hereby waive or release any and all right and claims for damages or injuries that I may have against the Event Director, RunSignup.com, and all of their agents assisting with the event, sponsors and their representatives and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees. I also authorize the use of photographs or videos that include my image for promotional, informational, or other reasons deemed to be in the best interest of the event.
I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event and that my physical condition has been verified by a licensed Medical Doctor. By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above waiver.
By agreeing to the following terms you may be waiving your legal right to a jury trial to hold the provider legally responsible for any injuries or damages resulting from risks inherent in the sport or recreational opportunity or for any injuries or damages you may suffer due to the provider's ordinary negligence that are the result of the provider's failure to exercise reasonable care.
As a condition of use of any City of Livingston facility, or participation in any program, sports league, class, recreation or fitness activity, you agree as a participant or parent/guardian of a participant in the program, to assume all risks and hazards of engaging in or spectating at any city activity or facility, including assuming all risks for personal injury, death and property damage. You further agree to hold harmless the City of Livingston, its staff, instructors, volunteers, officials, sponsors, partners or representatives from liability for any losses, damages or injuries that may occur in any way as a result of these activities or facility uses – regardless of cause and including, but not limited to, any injuries or damages you may suffer due to the City of Livingston’s, or its staff’s, instructors’, volunteers’, officials’, sponsors’, partners’ or representatives’ ordinary negligence. You further certify that you are properly prepared to engage in any activities you have selected and that you have recently consulted a physician to establish that it is safe and appropriate for you to engage in these activities. Therefore, having read and understood the above, and in consideration of the City of Livingston accepting your entry into a City of Livingston recreation facility or program, by clicking the “accept” button below, you, for yourself and anyone entitled to act on your behalf, agree to waive and release the City of Livingston, all staff, volunteers, sponsors, and representatives from all claims or liabilities of any kind arising out of your participation in (or as a spectator of) any program or use of any facility.
