FIRST ANNUAL SILVER HEIST 5K & LITTLE BANDITS BOLT
WAIVER AND RELEASE OF LIABILITY
In consideration of accepting this entry to participate in the First Annual Silver Heist 5K or Little Bandits Bolt, I, the participant (or parent/legal guardian for participants under the age of 18), intending to be legally bound, hereby agree to the following:
Release of Liability
I, on behalf of myself, my heirs, executors, administrators, or assigns, do hereby waive, release, and forever discharge the Orwell Historical Society Inc., the Orwell Village School Booster Club, the Town of Orwell, event directors, volunteers, sponsors, and all other organizations or individuals involved in the event (collectively referred to as "Released Parties") from any and all liability for injuries, damages, or claims arising from my participation in this event.
This waiver includes, but is not limited to, injuries or damages resulting from falls, contact with other participants, effects of weather, traffic, course conditions, and any other risks inherent to participating in a running event.
Acknowledgment of Risks
I understand and acknowledge that running or walking in a road race is a potentially hazardous activity. I certify that I am physically fit and have trained sufficiently to participate. I assume all risks associated with this event and attest that I am voluntarily participating with full knowledge of the risks involved.
I further acknowledge that these risks are known and understood by me, and I agree to abide by all decisions of race officials regarding my ability to safely complete the event.
Medical Authorization
In the event of illness, injury, or a medical emergency during the event, I hereby authorize the event organizers to secure any necessary medical treatment for me. I agree to be fully responsible for the cost of any such medical services, including but not limited to transport, treatment, and hospitalization.
I further acknowledge and agree that any medical personnel, doctors, or other individuals who may provide medical assistance during the event are acting voluntarily and will not be held liable for any injuries, damages, or outcomes resulting from their assistance, except in cases of gross negligence or willful misconduct.
COVID-19 and Safety Guidelines
I agree to comply with all local, state, and federal COVID-19 safety guidelines, including those issued by the Centers for Disease Control and Prevention (CDC) and the event organizers. I further acknowledge that my participation may pose risks related to the transmission of infectious diseases, including COVID-19, and I voluntarily assume all such risks.
Photo and Media Release
I grant the Released Parties permission to use my name, voice, and image in photographs, videos, or other media taken during the event for legitimate promotional purposes without compensation.
Non-Refundable Policy
I understand that all entry fees are non-refundable. The event organizers reserve the right to cancel or postpone the event due to circumstances beyond their control, including but not limited to weather emergencies, natural disasters, or safety concerns. In such cases, no refunds will be issued. I further understand that bib numbers are non-transferable.
Force Majeure
The Released Parties shall not be held responsible for any delay, cancellation, or alteration of the event resulting from circumstances beyond their reasonable control, including but not limited to acts of God, natural disasters, pandemics, government restrictions, labor disputes, or any other force majeure event.
Choice of Law
This waiver and any disputes arising out of or related to it shall be governed by the laws of the State of Vermont, without regard to its conflict of laws principles.
Attorney’s Fees
Each party shall be responsible for its own attorney’s fees and costs incurred in connection with any dispute arising out of or related to this waiver or the event.
General Release and Indemnification
I agree to indemnify, defend, and hold harmless the Released Parties from any claims, damages, or liabilities arising from my participation in this event. This agreement is binding upon my heirs, executors, administrators, and assigns.
Severability Clause
If any provision of this waiver is found to be unlawful, invalid, or unenforceable, the remaining provisions shall remain in full force and effect and shall not be affected by the invalidity of any single provision.
Acknowledgment and Acceptance
By completing this online waiver, I acknowledge that I have read and fully understand its contents. I affirm that I am at least 18 years of age or, if I am under 18, my parent or legal guardian has completed this waiver on my behalf.
The "Fun Times" Disclaimer
While the organizers hope this event will be an enjoyable and memorable experience for all participants, we make no guarantees regarding the amount of fun you will have. Your enjoyment may vary depending on your attitude, the weather, and whether you remembered to bring your running shoes.
