GIRLS ON THE RUN 5K EVENT WAIVERS (ADULT & YOUTH) 

Waiver Acknowledgment and Agreement

The following document includes both the Girls on the Run 5K Event Waiver for Adult Participants and the Girls on the Run 5K Event Waiver for Youth Participants.

By checking the acknowledgment box associated with this document, I certify that:

·        I have reviewed both waivers in full, and

·        I am either:

o   the participant age 18 or older and agree to the Adult Waiver, or

o   the parent or legal guardian of a participant under the age of 18 and agree to the Youth Waiver on their behalf.

I understand that I am agreeing only to the waiver applicable to my role and the participant’s age, and that I have the legal authority to sign on behalf of the participant if under 18.

Girls on the Run 5K Event Waiver – Adult Participants (Ages 18+)

Applies to participants 18 and older. 

This is a legally binding ASSUMPTION OF RISK, COVENANT NOT TO SUE, AGREEMENT TO INDEMNIFY, AND RELEASE AND WAIVER OF LIABILITY (“Agreement”) made by me in favor of Girls on the Run International together with (1) its associated Girls on the Run councils, including independent 501(c)(3) organizations authorized or licensed to operate Girls on the Run–branded programs, and (2) its local partner sites, including but not limited to local schools, parks, and facilities where Girls on the Run programs are conducted (collectively, “GOTR”) in connection with my participation in a Girls on the Run 5K Event (the “Event”). This Agreement applies to GOTR and its owners, directors, affiliates, officers, contributors, sponsors, coaches, employees, contractors, agents, volunteers, and assigns (collectively, the “Released Parties”). 

Consent To Participate in the Event: I hereby agree to participate in the Girls on the Run 5K Event, as a volunteer/runner/spectator. Physical reactions to exercise may include weather-related illness, abnormal heartbeats and blood pressure and, in rare instances, events such as heart attacks. While GOTR takes all reasonable safety precautions, GOTR makes no guarantees regarding these and other risks, including but not limited to, contracting known or unknown viruses, exposure to insects, and potential trip and fall hazards on the course or at the facility or event venue. Additional risks may include those caused by terrain, facilities, temperature, weather, equipment, vehicular traffic, lack of hydration, and actions of other people including, but not limited to, participants, other volunteers, spectators, coaches, event officials, and directors of the 5K Event. 

Assumption of Risk; Release of Liability and Covenant Not to Sue: Recognizing the risks of the 5K Event, and in consideration for being permitted to participate, I hereby knowingly and voluntarily assume all risks, both foreseeable and unforeseeable, associated with my participation in the Event, including, without limitation, physical or emotional injury, illness, damage to property, and death, whether caused by my own actions, the actions of others, environmental conditions, or otherwise.

On behalf of myself and my family, heirs, and personal representatives, I hereby release, discharge, and covenant not to sue, and agree to indemnify and hold harmless GOTR and the Released Parties from and against any and all claims, causes of action, demands, damages, losses, costs, expenses, and attorneys’ fees of any kind, whether known or unknown, arising out of or related directly or indirectly to my participation in the 5K Event, even if caused, in whole or in part, by the negligence or negligent acts or omissions of GOTR or the Released Parties, to the fullest extent permitted by applicable law.

Consent to Emergency Medical Treatment:  I hereby authorize GOTR, if after making efforts reasonable under the circumstances to reach an emergency contact or authorized individual, or if sound medical practice decrees that there is not time to make such an attempt, to consent to any x-ray examination, anesthetic, dental, medical, or surgical diagnosis or treatment, and hospital care, to be rendered to me under the general or special supervision and on the advice of any physician, surgeon, or other health care professional who may treat me. 

I agree to pay for any such treatment. I agree to reimburse GOTR for all costs and expenses it may incur related to such treatment. I also understand that this GOTR Council may not carry accident medical insurance and that such insurance coverage is my responsibility. 

I acknowledge that GOTR is not a medical provider and does not employ healthcare professionals.

Photo Release: I hereby grant GOTR and its partners, licensees, successors, contractors, and service providers, the absolute, irrevocable and unrestricted right to use photographs, video recordings, and audio recordings (including without limitation all originals, negatives, prints and transparencies or any duplicates or reproductions of the foregoing) that have been or will be taken of me (collectively, “Images”), in which I may be included with others, to copyright the same, in the name of GOTR or otherwise; to use, re-use, publish and republish the same in whole or in part, individually or in conjunction with other photographs and videos, and in conjunction with any printed matter, in any and all media now and hereafter known, and for any purpose whatsoever; and to use my name in connection herewith.  

Release Related to Images. I hereby release and agree to hold harmless GOTR and its partners, licensees, successors, contractors, and service providers from any claims, damages, or liability arising out of or relating to the use, publication, reproduction, modification, alteration, or other lawful use of the Images, except to the extent such Images are maliciously created and published for the sole purpose of subjecting me to conspicuous ridicule, scandal, reproach, scorn, or indignity. I hereby waive any claims I may have based on any use of the Images or works derived therefrom, including, without limitation, claims for invasion of privacy, right of publicity, or defamation.

Sponsor Products and Services. From time to time, Girls on the Run sponsors may provide products or offer services to event participants. I understand that I may receive products or service offerings from sponsors of Girls on the Run and consent to their provision and my receipt thereof. GOTR is not responsible for such products or services.

Governing Law: This Agreement shall be construed in accordance with the laws of the state of North Carolina, which shall be the forum for any lawsuits filed in connection with or pursuant to this Agreement.

Acknowledgement; Severability; Jury Waiver: I expressly agree that this Agreement is intended to be as broad and inclusive a release of liability as permitted by applicable law, and that if any provision is held invalid or unenforceable, the remaining provisions shall nevertheless continue in full force and effect. I hereby warrant and represent that I am eighteen (18) years of age or older, that I have carefully read and understand this Agreement, that I have had the opportunity to ask questions before signing, and that I voluntarily agree to its terms. I understand and acknowledge that by signing this Agreement, I am assuming risks and waiving and releasing certain legal rights that I may otherwise have against GOTR and the Released Parties. To the fullest extent permitted by applicable law, I hereby irrevocably and unconditionally waive any right to a trial by jury in any legal action or proceeding arising out of or relating to this Agreement.

GIRLS ON THE RUN 5K EVENT WAIVER - Youth Participants (Under 18)

Parent/Guardian Executed

Applies to participants under the age of 18. A parent or legal guardian must complete this waiver on behalf of the participant.

 This is a legally binding ASSUMPTION OF RISK, COVENANT NOT TO SUE, AGREEMENT TO INDEMNIFY, AND RELEASE AND WAIVER OF LIABILITY (“Agreement”) made by me, as the parent or legal guardian of a minor child (the “Participant”), in favor of Girls on the Run International together with (1) its associated Girls on the Run councils, including independent 501(c)(3) organizations authorized or licensed to operate Girls on the Run-branded programs, and (2) its local partner sites, including but not limited to local schools, parks, and facilities where Girls on the Run programs are conducted (collectively, “GOTR”) in connection with the Participant’s participation in a Girls on the Run 5K Event (the “Event”). I represent and warrant that I am eighteen (18) years of age or older and have full legal authority to execute this Agreement on behalf of the Participant. This Agreement applies to GOTR and its owners, directors, affiliates, officers, contributors, sponsors, coaches, employees, contractors, agents, volunteers, and assigns (collectively, the “Released Parties”).  

Consent To Participate in the Event: I hereby consent to the Participant’s participation in the Girls on the Run 5K Event, as a runner, volunteer, or spectator, as applicable. On behalf of myself, the Participant, and our respective family members, heirs, executors, administrators, and personal representatives, I hereby release, discharge, and covenant not to sue, and agree to indemnify and hold harmless GOTR and the Released Parties from and against any and all claims, causes of action, demands, damages, losses, costs, expenses, and attorneys’ fees of any kind, whether known or unknown, arising out of or related directly or indirectly to the Participant’s participation in the 5K Event, even if caused, in whole or in part, by the negligence or negligent acts or omissions of GOTR or the Released Parties, to the fullest extent permitted by applicable law.

Release Related to Images. I hereby release and agree to hold harmless GOTR and its partners, licensees, successors, contractors, and service providers from any claims, damages, or liability arising out of or relating to the use, publication, reproduction, modification, alteration, or other lawful use of the Images of the Participant, except to the extent such Images are maliciously created and published for the sole purpose of subjecting the Participant to conspicuous ridicule, scandal, reproach, scorn, or indignity. I hereby waive any claims I may have based on any use of the Images or works derived therefrom, including, without limitation, claims for invasion of privacy, right of publicity, or defamation. 

Sponsor Products and Services. From time to time, Girls on the Run sponsors may provide products or offer services to event participants. I understand that the Participant may receive products or service offerings from sponsors of Girls on the Run and consent to their provision and the Participant’s receipt thereof. To the fullest extent permitted by applicable law, I hereby irrevocably and unconditionally waive any right to a trial by jury in any legal action or proceeding arising out of or relating to this Agreement.
