In consideration of you accepting this entry, I, the participant, intending to be legally bound do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against the Event Director, RunSignup.com, and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.
I know that running a road race is a potentially hazardous activity. I should not enter and run unless I am medically able to do so and properly trained. I assume all risks associated with running in this event including, but not limited to: falls, contact with other participants, the effects of weather, traffic, and course conditions, and waive any and all claims which I might have based on any of those and other risks typically found in running a road race. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any race official relative to my ability to safely complete the run. I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event and that a licensed Medical Doctor has verified my physical condition.
In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.
As it applies to my participation in this race, I agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC’s guidance at: https://www.cdc.gov. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the community or by this race for my participation in this race.
Further, I grant permission to all the foregoing to use my name, voice and images of myself in any photographs, motion pictures, results, publications or any other print, videographic or electronic recording of this event for legitimate purposes.
This event follows the standard running industry policy: All entry fees are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable, and bib numbers are non-transferable.
By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver including the no refund policy.
2026 ST. SAVA SERBIAN DAYS 5K RUN/WALK
WAIVER AND RELEASE FORM
In consideration of my participation in the St. Sava Serbian Days 5K Run/Walk and associated activities (the “Event”), I hereby RELEASE, WAIVE, DISCHARGE, AND COVENANT NOT TO SUE St. Sava Serbian Orthodox Cathedral, American Serb Memorial Hall, Inc., their boards, officers, agents, volunteers, or employees (collectively, the “Releasees”) from any and all liability, claims, demands, actions, and causes of action whatsoever arising out of or related to any loss, damage, injury, including death or emotional distress, medical treatment or service rendered, or property damage that may be sustained by me, or to any property belonging to me, while participating in the Event, REGARDLESS OF WHETHER SUCH LOSS IS CAUSED BY THE NEGLIGENCE OF THE RELEASEES, or otherwise, and regardless of whether such liability arises in tort, contract, strict liability, or otherwise, to the fullest extent allowed by law. I agree to indemnify, defend, and hold all of the Releasees harmless from and against any and all damages, costs, claims, or demands, including reasonable attorneys’ fees, made by any third party due to or arising from or related to my participation in the Event.
I understand and acknowledge that participating in the Event is a potentially hazardous activity and that the Event course will not be closed to traffic. I am voluntarily entering, and assume full responsibility for all risks associated with participating in the Event, including, but not limited to, property damage or personal injury and even death; falls; contact with other participants, spectators or others; any loss or damage to property owned by me, as a result of being engaged in such activities; the effect of the weather, including heat and/or humidity; traffic and the conditions of the course, including natural obstacles; and all such risks being known and appreciated by me.
I agree that by entering and participating in the Event that I am healthy, medically able and properly trained, and agree that it is my responsibility to consult with a physician prior to my participation in the Event to determine if I am medically able to participate in the Event.
By submitting my signature below, I hereby authorize the Releasees and those acting pursuant to its authority to use any photographs, videotapes, motion pictures, recordings or similar medium of my participation in the Event (collectively, “Recordings”), and to exhibit or distribute such Recordings in whole or in part without restrictions or limitation for any purpose, including on the Releasees’ websites and social media accounts. I understand that the Releasees own all rights in the Recordings and are free to distribute the Recordings as it determines without obligation or compensation to me.
It is my express intent that this waiver and release shall be binding on me, my heirs, next of kin and members of my family, administrators, executors, legal representatives, successors and assigns.
I hereby further agree that this waiver and release shall be construed in accordance with the laws of the State of Wisconsin, without regard to conflict of laws principles, and that any mediation, suit, or other proceeding must be filed or entered into in Wisconsin, including its federal or state courts. Any portion of this document deemed unlawful or unenforceable is severable and shall be stricken without any effect on the enforceability of the remaining provisions.
I HAVE READ THIS RELEASE AND WAIVER AND UNDERSTAND ITS TERMS AND CONDITIONS, INCLUDING THAT I AM GIVING UP THE RIGHT TO SUE AND OTHER LEGAL RIGHTS. I REPRESENT THAT I AM 18 YEARS OF AGE OR OLDER, I HAVE FULL CAPACITY TO ENTER INTO THIS WAIVER AND RELEASE AND DO SO VOLUNTARILY. I REPRESENT THAT IF I AM REGISTERING A CHILD UNDER THE AGE OF 18 OR AN INCAPACITATED ADULT, I REPRESENT AND WARRANT THAT I AM THE PARENT OR ASSIGNED LEGAL GUARDIAN OF SUCH PARTY, I HAVE THE LEGAL AUTHORITY TO ENTER INTO THIS AGREEMENT ON THEIR BEHALF, AND BY PROCEEDING WITH THE EVENT REGISTRATION, I DO SO VOLUNTARILY AND AGREE THAT THE TERMS OF THIS WAIVER AND RELEASE SHALL APPLY EQUALLY TO ALL PARTIES THAT I REGISTERED.
