LIABILITY WAVIER
In exchange for my participation in the Old Home Day Rails to Trails Run and other good and valuable consideration, the adequacy of which is hereby acknowledged, I forever release and remise, by and on behalf of my heirs, successors, executors, administrators, and assigns, Old Home Day Rails to Trails Run, The Connecticut Draft Horse Rescue, O2 Event Productions, The Last Mile Racing LLC, The Old Home Day Committee, and their agents of and from any and all liability, including for liability from their own negligent acts, arising from my participation in the Race, pre-race activities, and post-race activities.
By signing this waiver, I represent that I am in good physical health and able to participate in this activity. Further, I agree to abide by any decision of a race official relative to any aspect of my participation in this event, including the right of any official to deny or suspend my participation for any reason. I assume all risks associated with running in this event, including but not limited to: falls, contact with other participants, the effects of the weather, including high heat and/or humidity, traffic and the conditions of the road/trail, all such risks being known and appreciated by me. I understand that the terrain of this course is unpredictable and potentially dangerous at times and have been made aware of this and am still voluntarily participating in the Race. I understand that bicycles, skateboards, baby joggers, roller skates or roller blades, and personal music players are not allowed in the race. I am aware of any food allergies I may have and am responsible for the food that I consume. I grant permission to all of the foregoing to use my photographs, motion pictures, recordings or any other record of this event for any legitimate purpose.
I understand that dogs can not accompany me on this race, and if elect to have a dog present and violate this rule I represent that I have homeowner’s insurance and I agree to defend and indemnify Old Home Day Rails to Trails Run, The Connecticut Draft Horse Rescue, O2 Event Productions, The Old Home Day Committee and their agents for any and all actual or alleged harm arising from or related to my dog.
If any provision of this waiver is found to be unenforceable, it shall be severed, and the remainder shall remain in full force and effect. This agreement shall be governed and interpreted under the laws of the State of Connecticut.
