SASSQUAD TRAIL RUNNING EVENT WAIVER, RELEASE OF LIABILITY, AND ASSUMPTION OF RISK AGREEMENT

By submitting this registration and participating in any trail race, training run, or event hosted by Sassquad Trail Running LLC, I acknowledge and accept that trail running and outdoor activities involve inherent risks, both known and unknown, which may result in serious injury, illness, permanent disability, death, or property damage. These risks include, but are not limited to, slips, falls, collisions with natural or manmade obstacles, contact with wildlife or insects, dehydration, exposure to extreme weather conditions, rugged terrain, lack of accessible emergency services, malfunctioning or inadequate equipment, and the actions or negligence of other participants, volunteers, or organizers. I further acknowledge that the event may take place in remote or natural environments subject to unpredictable and dangerous conditions, including but not limited to lightning, high winds, snow, ice, rain, heat, wildfire, landslides, falling trees or rocks, and other acts of nature or God.

I also understand and accept the risks associated with exposure to communicable diseases, including but not limited to COVID-19 and any variants or future strains, norovirus, influenza, or any other viruses, bacteria, or illnesses that may be spread through person-to-person contact, airborne transmission, or shared surfaces. I acknowledge that Sassquad Trail Running LLC cannot guarantee that I will not be exposed to or contract a contagious illness while participating in or attending an event. I voluntarily assume full responsibility for the risk of illness, injury, or death related to such exposure and agree to comply with any health and safety protocols implemented by the event organizers or required by local, state, or federal authorities.

In consideration of being permitted to participate in this event, I, for myself and on behalf of my heirs, assigns, personal representatives, and next of kin, hereby release, waive, discharge, and hold harmless Sassquad Trail Running LLC, its owners, officers, directors, employees, volunteers, sponsors, agents, contractors, landowners, venue hosts, municipalities, permitting agencies, and any other individuals or organizations associated with the event (collectively, the “Released Parties”), from any and all claims, liabilities, damages, losses, causes of action, costs, or expenses of any kind arising out of or related to my participation in or presence at this event. This includes, without limitation, claims for personal injury, illness, disability, death, property damage, medical expenses, or economic loss, whether caused by negligence, acts of omission, course or venue conditions, force majeure, cancellation, postponement, or any other reason. This release applies even if caused in whole or in part by the negligence of the Released Parties and includes claims based on ordinary negligence, including negligent rescue, emergency care, or failure to act.

I certify that I am in good health, physically fit, and able to safely participate in strenuous physical activity in a trail or outdoor setting. I have not been advised otherwise by a qualified medical professional and assume full responsibility for my participation and personal well-being. I authorize event personnel to provide medical attention to me if necessary, and I understand that I am solely responsible for any medical costs that may arise from my participation, including transport and treatment in the event of an emergency. I understand that medical support may be limited or unavailable and that emergency response may be delayed due to the remote nature of the event setting.

I also grant full permission to Sassquad Trail Running LLC and its agents or affiliates to capture, reproduce, publish, or otherwise use my name, image, voice, and likeness through photographs, video recordings, livestreams, or any other media, whether recorded before, during, or after the event. I understand that these materials may be used for promotional, commercial, or educational purposes in print, broadcast, social media, digital, and online formats, without compensation, approval, or any rights of ownership. I expressly consent to being filmed or recorded for live broadcasts and waive any rights of privacy or publicity associated with those recordings. I release the Released Parties from any and all claims arising out of the use of such images or media.

I understand and agree that all registrations are final. There are no refunds for any reason, including but not limited to injury, illness, scheduling conflicts, transportation issues, event rescheduling, inclement weather, natural disasters, communicable disease outbreaks, event modification, or event cancellation. I understand that by registering, I am reserving a spot in a limited-capacity event, and that my registration fee helps cover up-front costs that are not recoverable by the organizer. I further acknowledge that it is my responsibility to read and understand the event policies, including those regarding bib transfers or deferrals, if offered.

If the participant is under 18 years of age, I affirm that I am the parent or legal guardian of the minor and that I have the authority to enter into this agreement on their behalf. I agree to be bound by all the terms of this waiver as they apply to the minor participant and I consent to their participation under these terms.

This agreement shall be governed by the laws of the State of New York. If any provision is found to be invalid or unenforceable, the remainder of the agreement shall remain in full force and effect. This waiver and release is intended to be as broad and inclusive as permitted by applicable law. I understand and agree that any dispute arising out of or related to this agreement or my participation in a Sassquad Trail Running event shall be resolved through binding arbitration in New York, unless prohibited by applicable law.

By submitting this registration or signing below, I confirm that I have read and understood this entire waiver and release, that I am voluntarily giving up substantial legal rights by agreeing to it, and that I am legally competent to do so. I understand this is a release of liability and a contract and I agree to be bound by its terms
