Registration Waiver for the Race to Change Lives

In consideration of you accepting this entry, I, the participant, intending to be legally bound do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against the Race, MONSTAR DASH 5K & KIDS PUMPKIN DASH event, Event Director(s), FAU ( Florida Atlantic University ), RunSignup.com, Investments Limited, Changing Lives of Boca Raton Inc., Palm Beach Running Company, Accuchip Timing, The City of Boca Raton, Palm Beach County, The State of Florida, ( HOSTS ) and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees, affiliates, spectators, or bystanders for any and all injuries to me or my personal property. This release includes all injuries and/or damages suffered by me, before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators, or assignees.

I further understand and agree that there will be no refunds or credits provided to me if I am unable to participate in the Activities through their duration.   

I know that running a road race is a potentially hazardous activity. I should not enter and run unless I am medically able to do so and properly trained. I assume all risks associated with running in this event including, but not limited to: falls, contact with other participants, volunteers, spectators, pets, by standers, the effects of weather, traffic, and course conditions, and waive any and all claims which I might have based on any of those and other risks typically found in running a road race. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any race official relative to my ability to safely complete the run or walk. I certify as a material condition to my being permitted to enter this race that I am physically fit and sufficiently trained for the completion of this event and that a licensed Medical Doctor has verified my physical condition.

I fully understand that the Activities could be dangerous and that there are risks relating to my participation in and/or observation of the Activities including the risk of serious bodily injuries and property damage to me, which injuries and damage could arise out of my own actions or inactions, those of other individuals participating in the Activities, contact with dogs or spectators during the Activities, the conditions in which the Activities take place, my health conditions, or the negligence of the Released Parties named below or others

In the event of an illness, injury or medical emergency arising during the event I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic and/ or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me including but not limited to medical transport, medications, treatment and hospitalization.

As it applies to my participation in this race, I agree to abide by the Center for Disease Control (CDC)’s recommendations for the prevention of the spread of COVID-19 and attest to having read the CDC’s guidance at: https://www.cdc.gov. I also agree to abide by any COVID-19 distancing and other safety guidelines issued by the state, the city, the community or by this race for my participation in this race.

Accident Waiver and Release of Liability ("WAIVER")
This Accident Waiver and Release of Liability ("WAIVER") is meant to protect the owner, operator and location (individually, jointly and collectively) as more specifically set forth herein from any and all claims, by any and all persons taking part in activities being conducted by, for the benefit of, or for Palm Beach Running Company, Changing Lives or any Charity Partners and any and all of its agents, employees, owners, officers, directors, volunteers, sponsors, etc. (hereinafter collectively referred to as "HOSTS").
NOTE TO MINORS: If you are under the age of 18, you may only attend the Event accompanied by an adult. You also acknowledge that your parent or guardian has reviewed, understood and agreed to the terms below.

I acknowledge that, for myself,  this Accident Waiver and Release of Liability form will govern my actions and responsibilities at said events. I understand that it shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law. I hereby certify that 

I have read this Accident Waiver and Release of Liability and I understand its content for myself. 

It is further understood and agreed that this waiver, release and assumption of risk is to be binding on my heirs and assigns.

I consent to medical care and transportation in order to obtain treatment in the event of injury to me as HOSTS, volunteers or medical professionals may deem appropriate and understand that this Waiver & Release extends to any liability arising out of or in any way connected with the medical treatment and transportation provided in the event of an emergency and/or injury.
  
I agree to observe and obey all posted rules and warnings, to follow any instructions or directions given by HOSTS through its employees, representatives, agents or signage, and to abide by any decision of any Event official relative to my ability to safely participate in or attend the Event.
  
I understand and agree that I am expected to exhibit appropriate behavior at all times while at the Event and to obey all local, state and federal civil and criminal laws while participating in or attending the Event. This includes, generally, respect for other people, equipment, facilities or property. HOSTS may dismiss me, without refund, should my behavior endanger the safety of or negatively affect the Event, Premises or any person, facility or property. I also agree to indemnify the Releases from any and all third party claims caused in whole or in part by my negligent or intentional acts or omissions.
  
I recognize and acknowledge that there are hazards and risks of physical injury or illness to Event attendees and that not all such hazards or risks can be fully eliminated. I freely and voluntarily agree to assume the full risk of death, bodily injury or property damage, regardless of severity, that I (or my minor child/ward) may sustain as a result of my attendance at the Event, whether or not caused by the active or passive negligence of the Releasees or an Event participant(s).
  
I indemnify and hold harmless the Releases from any loss, liability, damage or cost they may incur while I am at the Event or on the Premises, whether or not caused by the active or passive negligence of the Releases.
  
I release, waive, discharge and covenant not to sue the Releases from all liability to me, my personal representatives, assigns, heirs and next of kin, for any claims, causes of action, obligations, lawsuits, charges, complaints, controversies, damages, costs or expenses of whatsoever kind, nature, or description, whether direct or indirect, in law or in equity, in contract or in tort, or otherwise, whether known or unknown, arising out of or connected with my (or my minor child’s/ward’s) attendance at the Event or while on the Premises, whether or not caused by the active or passive negligence of the Release
  
I expressly agree that the Waiver is intended to be as broad and inclusive as permitted by the law of the State of Florida, and that if any portion is held invalid, it is agreed that the balance shall continue in full legal force and effect.
  
I have read, understand and agree to abide by the rules of the event, for myself and my dog.
  
I have read, understand and agree to abide by the rules as set forth above, for myself.

Further, I grant permission to all the foregoing to use my name, voice and images of myself or my child if under 18 in any photographs, motion pictures, results, publications or any other print, video graphic or electronic recording of this event for legitimate purposes.

This event follows the standard running industry policy: All entry fees are non-refundable. We reserve the right to postpone or cancel the event due to circumstances beyond our control such as a natural disaster or emergency or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice. I understand that my entry fee is nonrefundable and bib numbers are non-transferable.

By submitting this entry, I acknowledge (or a parent or adult guardian for all children under 18 years) having read and agreed to the above release and waiver including the no refund policy.

I understand that this event has a NO Refund Policy in place.
