Chad Chronister, as Sheriff of Hillsborough County and HCSO Charities, Inc. Ultimate Run Release and Indemnity Agreement

This Release and Indemnity Agreement is made by and between Chad Chronister, as Sheriff of Hillsborough County, and HCSO Charities, Inc., (hereinafter “Releasee”) and the undersigned (hereinafter “Releasor”). In consideration of Releasor’s participation in Releasee’s Ultimate Run scheduled for September 1, 2023, along with any related events and activities (“Run”), Releasor hereby acknowledges and agrees that pursuant to their participation in the Shootout:

(1)Releasor understands and acknowledges that the Run will be scheduled on days and times set by Releasee and Releasee reserves the right to restrict, modify, or reschedule.

(2)Releasor may visit, use, or occupy Releasee’s property or other property utilized for the Shootout (real property, facilities, equipment, vehicles, etc.) and will maintain such property in the appropriate condition and be responsible for any clean-up or repair necessitated by their actions to said property, as determined by Releasee. Any property used or occupied during Releasor’s participation in the Run is used or occupied at their own risk and without any warranty as to condition or suitability.

(3)Releasor will abide by any and all administrative, operational, and safety commands, rules, or regulations established or given by Releasee’s employees or representatives, at all times. A breach of any such command, rule, or regulation may result in Releasor’s immediate termination and/or removal from the Run, as determined by Releasee.

(4)Releasor will advise Releasee’s employees or representatives of any physical limitations that they have prior to their participation in the Run. Releasor understands that they may be subjected to risks and inherently dangerous situations of which a reasonably prudent person would be aware, and they voluntarily and deliberately consent and agree to expose themselves to such risks and situations. Releasor consents and assumes all such risks to themselves and their property even from the negligence of Releasee or others. Releasor further agree to assume full responsibility for any damage, injury, or death to their person or property which may occur directly or indirectly as a result of or during their participation in the Run, regardless of the location of any such damage, injury, or death.

(5)Releasor hereby releases, acquits, and forever discharges Releasee, Releasee’s successors, representatives, assigns, employees, and any other persons associated with Releasee, from any and all claims, causes of action, suits, debts, accounts, judgments, rights, damages, costs, loss of services, claims for attorney’s fees, claims for litigation costs, loss of companionship or consortium, expenses, compensation, or demands whatsoever in law or equity in the present or future, regardless of when the injury or damage becomes known, which occurred as a result of or during Releasor’s participation in the Run.

(6)Releasor agrees to protect, indemnify, hold harmless, and defend Releasee, Releasee’s successors, representatives, assigns, employees, and any other persons associated with Releasee, from any and all claims, causes of action, suits, debts, accounts, judgments, rights, damages, costs, loss of services, claims for attorney’s fees, claims for litigation costs, loss of companionship or consortium, expenses, compensation, or demands whatsoever in law or equity in the present or future, regardless of when the injury or damage becomes known, which occurred as a result of or during their participation in the Run.

(7)Releasor acknowledges that Releasee, Releasee’s successors, representatives, assigns, employees, and any other persons associated with Releasee, do not waive and hereby invoke any and all applicable limitations on liability, including but not limited to, Florida Statute §768.28 or the Federal Tort Claims Act, 28 U.S.C. § 2671, et seq.

(8)Releasor agrees that they have read this Release and Indemnification Agreement and they understand all of the terms herein and have voluntarily signed below.
