THREE HILLS WINERY – WINE & MUSIC JAM

RELEASE OF LIABILITY, ASSUMPTION OF RISK & EVENT WAIVER

In consideration of being permitted to attend and participate in the Wine & Music Jam at Three Hills Winery (“Event”), I, the participant/attendee, acknowledge and agree to the following:

ASSUMPTION OF RISK

I understand that the Wine & Music Jam is an outdoor event held on private winery property and that participation and attendance involve certain inherent risks.

I understand and acknowledge that the property may include, but is not limited to, uneven ground, dirt, gravel, grass, rocks, steps, landscaping, agricultural areas, wet or slippery surfaces, insects, wildlife, vehicles, equipment, low-light conditions, and other conditions normally associated with an outdoor rural winery property.

I further acknowledge that there is an UNFENCED LAKE on the property and a SWIMMING POOL. I understand that these areas may present a serious risk of injury or drowning.

I voluntarily assume all risks associated with attending the Event, whether known or unknown, including risks associated with walking around the property, weather conditions, food and beverage consumption, alcohol consumption, other guests, animals, the lake, swimming pool, outdoor conditions, and other activities occurring during the Event.

OUTDOOR EVENT & WEATHER

I understand that this is an outdoor event and is weather permitting.

Weather conditions may include heat, cold, wind, rain, sun, or other changing conditions. Three Hills Winery may modify, postpone, relocate, shorten, or cancel all or part of the Event if weather or other conditions make it unsafe or impractical to continue.

I understand that event details may change due to weather, safety concerns, emergencies, or circumstances beyond the control of Three Hills Winery.

CHILDREN

I understand that parents and guardians are solely responsible for supervising their children at all times while on the property.

Children must remain under the direct supervision and control of their parent, legal guardian, or responsible adult.

I understand that Three Hills Winery does not provide childcare or supervision.

I specifically acknowledge the presence of the unfenced lake and swimming pool and understand that children must be closely supervised around these and all other areas of the property.

I accept full responsibility for the safety, actions, and behavior of any minor attending the Event under my supervision.

DOGS & OTHER PETS

If I bring a dog to the Event, I understand and agree that:

My dog must remain on a leash and under my control at all times.
I am solely responsible for supervising and controlling my dog.
I am responsible for any injury, damage, disturbance, or other incident caused by my dog.
I will keep my dog away from other guests, children, animals, food-service areas, the lake, swimming pool, and other areas when necessary for safety.
I will immediately clean up after my dog.
Three Hills Winery may require me to remove my dog from the property if winery staff determines that the dog is aggressive, disruptive, uncontrolled, or creates a safety concern.
I understand that I bring my dog onto the property entirely at my own risk.

ALCOHOLIC BEVERAGES

I understand that wine and other alcoholic beverages may be served or available during the Event.

I agree to drink responsibly and understand that I am solely responsible for my decisions and actions regarding alcohol consumption.

I agree not to drive while impaired and understand that it is my responsibility to arrange for a designated driver, rideshare, taxi, or other safe transportation if needed.

I understand that outside alcohol is not permitted at this event. 

Three Hills Winery reserves the right to refuse alcohol service to any person at its discretion.

RELEASE AND WAIVER OF LIABILITY

To the fullest extent permitted by law, I voluntarily waive, release, and forever discharge Three Hills Winery, its owners, officers, employees, representatives, agents, contractors, musicians, entertainers, vendors, volunteers, sponsors, Event organizers, property owners, and affiliated organizations from any and all claims, demands, damages, losses, liabilities, actions, or causes of action arising from or related to my attendance or participation in the Event.

This release includes claims arising from personal injury, illness, property damage, loss, accident, or death occurring before, during, or after the Event, including risks associated with the property, outdoor conditions, weather, animals, food and beverages, alcohol, the lake, swimming pool, and the actions of other attendees.

This release is intended to be binding upon me and my heirs, executors, administrators, representatives, and assigns to the fullest extent permitted by California law.

PERSONAL PROPERTY

I understand that I am responsible for my own personal property.

Three Hills Winery is not responsible for lost, stolen, misplaced, or damaged personal belongings, vehicles, equipment, or other property brought onto the premises.

MEDICAL EMERGENCIES

In the event of an illness, injury, accident, or medical emergency, I authorize Three Hills Winery or Event personnel to contact emergency medical services and obtain reasonable emergency assistance on my behalf if necessary.

I understand that Three Hills Winery does not guarantee that medical personnel will be present at the Event.

I agree that I am responsible for any costs associated with emergency transportation, medical treatment, hospitalization, medications, or other medical services provided to me or to a minor under my supervision.

PHOTOGRAPHY & MEDIA RELEASE

I understand that photographs, video, and audio recordings may be taken during the Event.

I grant Three Hills Winery and its authorized representatives permission to use photographs, video, or recordings containing my image, likeness, or voice for legitimate promotional, advertising, social media, website, editorial, or other business purposes without compensation to me.

EVENT CHANGES, CANCELLATION & REFUNDS

I understand that the Wine & Music Jam is an outdoor, weather-permitting event.

Three Hills Winery reserves the right to change, postpone, relocate, shorten, or cancel the Event due to weather, fire, natural disaster, government restrictions, emergencies, safety concerns, circumstances beyond its control, or other conditions that may affect the safe operation of the Event.

Unless otherwise specifically stated by Three Hills Winery, event tickets and admission fees are non-refundable.

ACKNOWLEDGMENT

By purchasing a ticket, registering, checking the waiver acceptance box, or attending the Event, I acknowledge that I have carefully read and understand this Release of Liability, Assumption of Risk & Event Waiver.

I voluntarily accept the risks associated with attending the Wine & Music Jam at Three Hills Winery.

I understand that I am responsible for myself, my children or other minors under my supervision, and any dog or pet that I bring onto the property.

I specifically acknowledge that:

THIS IS AN OUTDOOR EVENT.

THE EVENT IS WEATHER PERMITTING.

THERE IS AN UNFENCED LAKE AND A SWIMMING POOL ON THE PROPERTY.

CHILDREN MUST BE SUPERVISED BY A RESPONSIBLE ADULT AT ALL TIMES.

DOGS MUST REMAIN LEASHED AND UNDER THE OWNER’S CONTROL AT ALL TIMES.

By checking the acceptance box, I confirm that I am at least 18 years old, or that I am the parent, legal guardian, or authorized responsible adult accepting this waiver on behalf of any minors included in my registration.
