ETHIORADO 5K RUN/WALK — WAIVER, ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND PHOTO RELEASE

In consideration of being permitted to participate in the Ethiorado 5K Run/Walk (the “Event”), I, for myself and for my heirs, personal representatives, executors, administrators, and assigns, agree as follows:

1. Assumption of risk. I understand that participating in a road run/walk involves inherent and other risks that may cause serious injury, illness, disability, death, or property damage. These risks include, without limitation, physical exertion, falls, uneven or wet surfaces, road and traffic hazards, weather, other participants, spectators, vehicles, inadequate hydration, and emergency-response delays. I voluntarily assume all such risks, known and unknown.
2. Health and safety. I certify that I am medically able, properly prepared, and in sufficiently good health to participate. I will follow Event rules, course instructions, and the directions of Event officials and public-safety personnel. I understand that officials may deny, suspend, or end my participation when they determine it is necessary for safety or Event operations.
3. Release and waiver. To the fullest extent permitted by Colorado law, I release, waive, discharge, and covenant not to sue the organizers, the Ethiorado 5K Run/Walk, RunSignup, the City of Aurora, the State of Colorado, Event sponsors, volunteers, contractors, vendors, landowners, public-safety agencies, and each of their respective officers, directors, employees, agents, representatives, successors, and assigns (collectively, the “Released Parties”) from any and all claims, liabilities, demands, causes of action, damages, costs, or expenses arising from or related to my participation in the Event, including claims arising from the ordinary negligence of a Released Party.
4. Medical care. If I become ill or injured, I authorize Event personnel to obtain emergency medical care or transportation for me if they reasonably believe it is necessary. I understand that I am responsible for all resulting medical, transport, and related costs.
5. Photo and results release. I grant the Released Parties permission to photograph, film, record, and otherwise use my name, image, voice, likeness, and Event results in any media for Event-related, promotional, educational, archival, or commercial purposes, without compensation to me.
6. No refund; Event changes. Registration fees are nonrefundable. Registrations may be transferred to another participant up to three (3) days before the Event, subject to the Event’s registration-transfer procedures. The organizer may postpone, modify, shorten, reroute, convert to a virtual format, or cancel the Event because of weather, safety conditions, public-health guidance, governmental direction, or other circumstances beyond its reasonable control. No refund is required in those circumstances.
7. Minors and electronic acceptance. If I am registering a participant younger than 18, I represent that I am the participant’s parent or legal guardian and have authority to accept this agreement on the participant’s behalf. I understand that clicking acceptance and submitting registration constitutes my electronic signature and agreement to this waiver.

I HAVE READ THIS WAIVER, UNDERSTAND THAT I AM GIVING UP IMPORTANT LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE FOR CLAIMS BASED ON ORDINARY NEGLIGENCE, AND VOLUNTARILY AGREE TO IT.
