PENSACOLA PICKLES AND WINGS RUN
WAIVER AND RELEASE
In consideration of you accepting this entry, I, the participant, intending to be legally bound, do hereby waive and forever release any and all rights and claims for damages or injuries that I may have against Pensacola History and Hauntings Tours and Events LLC, and its members, managers, officers, owners, employees and agents individually, the Event Director, the Pensacola Pickles and Wings Family Festival, the City of Pensacola, Escambia County, RunSignup.com, and all of their agents assisting with the event, sponsors and their representatives, volunteers and employees, for any and all injuries to me or my personal property. This release includes all injuries and damages suffered by me before, during or after the event. I recognize, intend and understand that this release is binding on my heirs, executors, administrators and assignees.
I know that participating in a run or walk is a potentially hazardous activity. I should not enter and participate unless I am physically able to do so. I assume all risks associated with participating in this event including, but not limited to: falls, contact with other participants, the effects of weather, heat, humidity, sun and rain, uneven, wet or slippery ground surfaces, and course conditions, and I waive any and all claims which I might have based on any of those risks and other risks typically found in a recreational run or walk. I acknowledge all such risks are known and understood by me. I agree to abide by all decisions of any event official relative to my ability to safely complete the course.
I understand that this event takes place in May in Northwest Florida and that conditions are likely to be warm and humid, with the possibility of direct sun, high heat index or thunderstorms. I understand that costumes are encouraged and that I am solely responsible for choosing costume, layers and footwear that are safe, that allow clear vision and free movement, and that are appropriate for the weather. I am responsible for hydrating before, during and after the event and for recognizing the signs of heat related illness in myself and stopping if I experience them.
I understand that this event takes place on public streets, sidewalks and park paths in downtown Pensacola, including the Seville Historic District, and that surfaces may include asphalt, concrete, brick, grass, curbs, cracks, tree roots, drainage grates and standing water. I agree to remain on the marked course at all times, to follow the instructions of course marshals, law enforcement and event staff, and to remain aware of my surroundings. I understand that the course is not fully closed to traffic, that vehicles, cyclists, pedestrians and other members of the public may be present, and that I am responsible for my own safety at intersections and crossings.
I understand that this is an untimed recreational event. There are no timing devices, no official results, no age group awards and no course monitoring for pace. I understand the course closes at 9:30 AM and that I am responsible for completing my chosen distance within that window or leaving the course when directed.
If I am registering a participant under the age of 18, I certify that I am that participant's parent or legal guardian, that I have the authority to enter into this agreement on their behalf, and that they will be accompanied on course by a responsible adult. I accept all terms of this release on their behalf. I further understand that strollers and wagons are permitted only where posted, that participants using them start at the rear, and that I am responsible for the safety of any child in my care for the entire duration of the event and afterward at the festival.
In the event of an illness, injury or medical emergency arising during the event, I hereby authorize and give my consent to the Event Director to secure from any accredited hospital, clinic or physician any treatment deemed necessary for my immediate care. I agree that I will be fully responsible for payment of any and all medical services and treatment rendered to me, including but not limited to medical transport, medications, treatment and hospitalization.
Further, I grant permission to all of the foregoing to use my name, voice and images of myself in any photographs, motion pictures, publications or any other print, videographic or electronic recording of this event for legitimate purposes, including promotion of this event and of the Pensacola Pickles and Wings Family Festival.
All entry fees are non-refundable. Bib numbers are non-transferable and registrations may not be transferred to another participant, another event or another year. All participants must be pre registered. There is no event morning registration. We reserve the right to postpone or cancel the event due to circumstances beyond our control, including severe weather, lightning, natural disaster or emergency, or as required to protect the safety of participants and staff. No refunds will be issued under these circumstances. We reserve the right to change the details of the event without prior notice.
By submitting this entry, I acknowledge, or a parent or legal guardian acknowledges for any participant under 18 years of age, having read and agreed to the above release and waiver, including the no refund and no transfer policy.
One flag: the waiver on the Food Fight document you sent me reads PHH Tours and Events LLC, and I have that name on file for the Government Street business too. If Pensacola History and Hauntings Tours and Events LLC is the registered entity and PHH is the shortened trade version, the Food Fight waiver and anything else already published under the PHH name should be corrected to match, since a release that names an entity which does not legally exist is the kind of thing a defense attorney goes after first.
