PARTICIPANT WAIVER, RELEASE OF LIABILITY, ASSUMPTION OF RISK, AND MEDIA RELEASE
In consideration of being permitted to register for and participate in the Dirty Birdie Trail Run (the “Event”), I, the participant, intending to be legally bound, hereby waive, release, and forever discharge any and all rights, claims, demands, causes of action, damages, or liabilities that I may have arising out of or related to my participation in the Event against the Event Director, RunSignup.com, OK Runner Timing, Norman Sports Commission, VisitNorman, the City of Norman, the State of Oklahoma, the Oklahoma Tourism and Recreation Department (“OTRD”), Lake Thunderbird State Park, Event sponsors, and each of their respective officers, directors, agents, representatives, employees, contractors, volunteers, successors, and assigns (collectively, the “Released Parties”), to the fullest extent permitted by law.
This release applies to injuries, illness, death, property damage, or other loss that may occur before, during, or after my participation in the Event and that arises out of or relates to my participation in the Event or presence at the Event. I understand and intend that this waiver and release shall be binding upon me and my heirs, executors, administrators, personal representatives, successors, and assigns.
ASSUMPTION OF RISK
I understand that trail running and participation in the Event are potentially hazardous activities involving inherent and other risks. I understand that these risks include, but are not limited to, falls; slips and trips; contact or collisions with other participants, spectators, volunteers, vehicles, wildlife, or objects; uneven, loose, wet, muddy, rocky, steep, or otherwise hazardous terrain; roots, rocks, branches, holes, water crossings, natural and man-made obstacles; changing trail and course conditions; limited visibility; weather conditions, including heat, cold, rain, wind, storms, and lightning; dehydration; overexertion; and other risks associated with outdoor endurance events and use of public trails and park property.
I knowingly and voluntarily assume the risks associated with my participation in the Event, whether specifically identified above or otherwise reasonably associated with trail running and outdoor recreational activities.
I understand that I should not participate unless I am medically and physically able to do so and have adequately prepared for the distance and conditions of the Event. I certify that I am physically capable of participating in the Event and accept responsibility for determining my own ability to participate safely. I agree to abide by the instructions and decisions of Event officials concerning my participation and my ability to safely continue or complete the Event.
MEDICAL TREATMENT
In the event of illness, injury, accident, or medical emergency arising during the Event, I authorize the Event Director, Event personnel, volunteers, emergency responders, or other appropriate personnel to obtain or provide emergency medical assistance, treatment, or transportation reasonably deemed necessary for my care.
I understand that I am responsible for any costs associated with medical services provided to me, including, but not limited to, ambulance or other emergency transportation, medications, treatment, physician services, and hospitalization.
EVENT CHANGES, CANCELLATION, AND REFUNDS
I understand that all Event entry fees and associated Event charges are non-refundable unless otherwise expressly stated by the Event organizers.
I understand that the Event organizers reserve the right to modify, postpone, relocate, shorten, suspend, or cancel the Event, alter the course, or change other Event details when reasonably necessary due to circumstances beyond their control or to protect the health and safety of participants, volunteers, spectators, staff, or the public. Such circumstances may include, but are not limited to, severe weather, natural disasters, wildfire, flooding, unsafe trail or park conditions, emergencies, governmental actions or orders, or closure or restriction of Lake Thunderbird State Park or any portion of the Event course.
I understand that no refund will be issued as a result of such circumstances unless otherwise expressly determined by the Event organizers. I further understand that registrations and bib numbers are non-transferable except when expressly authorized by the Event Director.
PHOTO, VIDEO, AND MEDIA RELEASE
I grant permission to the Event organizers, Norman Sports Commission, VisitNorman, Event sponsors, and their authorized representatives to photograph, film, record, or otherwise capture my name, likeness, image, voice, and participation in the Event.
I authorize the use of such photographs, video, audio, Event results, and other recordings for legitimate promotional, informational, advertising, archival, editorial, and Event-related purposes in print, websites, social media, digital communications, video, and other media without compensation to me.
