PARTICIPANT WAIVER, ASSUMPTION OF RISK, RELEASE OF LIABILITY, AND PARENTAL CONSENT
Make Miles Matter 5K Community Fun Run & Walk
October 3, 2026 – Eulalona Park – Klamath Falls, Oregon
PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS AND INCLUDES A RELEASE OF LIABILITY.
In consideration of being permitted to participate in the Make Miles Matter 5K Community Fun Run & Walk (the “Event”), I acknowledge and agree as follows:
1. Voluntary Participation and Assumption of Risk
I understand that participation in running, walking, and related activities involves inherent and other risks that may result in property damage, illness, bodily injury, permanent disability, or death.
These risks include, without limitation, falls; uneven, wet, slippery, broken, or otherwise hazardous surfaces; curbs; potholes; rocks; debris; weather conditions; heat or cold; overexertion; dehydration; physical exertion; contact or collisions with other participants, pedestrians, bicyclists, animals, vehicles, or other users of public areas; and risks associated with streets, intersections, sidewalks, parks, trails, and multi-use paths.
I knowingly and voluntarily assume all risks associated with my participation in the Event, whether specifically identified above or not, to the fullest extent permitted by Oregon law.
2. OPEN COURSE — TRAFFIC AND PUBLIC USE
I UNDERSTAND THAT THE EVENT COURSE IS NOT CLOSED TO VEHICULAR TRAFFIC OR TO THE GENERAL PUBLIC.
The Event takes place on or adjacent to public streets, sidewalks, crosswalks, parks, trails, and/or multi-use paths that may remain open to vehicles, bicycles, pedestrians, and other users.
I understand and agree that I am responsible for my own safety and that I MUST obey all applicable Oregon traffic and pedestrian laws, traffic signals, signs, crosswalk requirements, and other traffic-control devices at all times.
I will not enter or cross a roadway unless it is lawful and reasonably safe to do so. I understand that Event volunteers may provide directions regarding the Event route but are not law-enforcement officers or traffic-control personnel and do not have authority to stop or control vehicular traffic.
I understand that participation in the Event gives me no special right-of-way or exemption from applicable traffic laws.
3. Participant Responsibility
I represent that I am physically capable of participating in the Event and will exercise reasonable judgment concerning my ability to participate and continue participating.
I agree to conduct myself in a reasonably safe manner, remain aware of my surroundings, follow the marked Event route, comply with applicable laws, and follow reasonable safety instructions provided by Event organizers and volunteers.
4. Release and Waiver of Liability
TO THE FULLEST EXTENT PERMITTED BY OREGON LAW, I RELEASE AND DISCHARGE the Event organizer, Event volunteers, sponsors, donors, and persons or entities assisting with the Event (collectively, the “Released Parties”) from claims, demands, causes of action, damages, losses, or liabilities arising from or relating to my participation in the Event, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY.
This release does not apply to conduct that cannot lawfully be released or waived under Oregon law.
I intend this release to be interpreted as broadly as Oregon law permits.
5. Public Property and Third Parties
I understand that the Event may use property owned or controlled by governmental entities or other third parties. Unless separately identified as an Event organizer or sponsor, the use of such property does not mean that the property owner or governmental entity organizes, sponsors, supervises, or controls the Event.
I agree to respect public and private property and understand that the Event course remains available for use by members of the public.
6. Medical Treatment
If I become injured or ill during the Event and am unable to provide instructions, I authorize Event personnel or volunteers to seek reasonable emergency medical assistance on my behalf.
I understand that the Event does not undertake or guarantee the availability of medical services and that I am responsible for medical expenses incurred on my behalf.
7. Photographs and Event Media
I authorize the Event organizer to photograph or record me during the Event and to use those photographs or recordings for noncommercial purposes relating to the Event, Team for Kids fundraising, promotion of community running activities, or future charitable events, without compensation to me.
8. MINOR PARTICIPANTS — PARENT OR LEGAL GUARDIAN REQUIRED
A PARTICIPANT UNDER 18 YEARS OF AGE MAY PARTICIPATE ONLY WITH THE CONSENT OF A PARENT OR LEGAL GUARDIAN. THE PARENT OR LEGAL GUARDIAN MUST COMPLETE AND ACCEPT THIS AGREEMENT ON THE MINOR'S BEHALF.
If I am signing for a participant under age 18, I represent that I am the minor participant's parent or legal guardian and have authority to enter into this agreement on the minor's behalf.
I give permission for the minor to participate in the Event. I acknowledge the risks described in this agreement, including that portions of the course may remain open to vehicular traffic and the general public.
I agree that the minor must comply with applicable traffic and pedestrian laws and reasonable Event safety instructions.
To the fullest extent permitted by Oregon law, I individually and on behalf of the minor agree to the assumption-of-risk and release provisions stated above, recognizing that the enforceability of any release of a minor's claims is governed by applicable Oregon law.
Children who are not capable of independently and safely following traffic and pedestrian laws must remain under the direct supervision of a parent, guardian, or responsible adult throughout the Event.
9. Severability and Oregon Law
This agreement is governed by Oregon law. If any provision is determined to be invalid or unenforceable, that provision shall be limited or severed to the minimum extent necessary, and the remaining provisions shall remain in effect to the fullest extent permitted by law.
ACKNOWLEDGMENT
I HAVE READ THIS AGREEMENT. I UNDERSTAND THAT PARTICIPATION IN THE EVENT INVOLVES RISKS, THAT THE COURSE MAY REMAIN OPEN TO VEHICULAR TRAFFIC AND THE GENERAL PUBLIC, AND THAT I AM REQUIRED TO FOLLOW APPLICABLE TRAFFIC AND PEDESTRIAN LAWS. I UNDERSTAND THAT THIS AGREEMENT INCLUDES AN ASSUMPTION OF RISK AND A RELEASE OF CERTAIN LEGAL CLAIMS. I VOLUNTARILY AGREE TO ITS TERMS.
