NIGHT SERPENT 5K PARTICIPANT WAIVER AND RELEASE OF LIABILITY
In consideration of being permitted to participate in the Night Serpent 5K (the “Event”), hosted and organized by Mamba Trail Runners and conducted on private property and private trails owned by Matt Lewis in Eads, Tennessee, I acknowledge and agree to the following:
ASSUMPTION OF RISK
I understand that the Night Serpent 5K is a nighttime trail race conducted in darkness. I understand that running trails at night involves inherent risks that may be significantly increased because of limited visibility.
These risks include, but are not limited to, falls, slips, trips, collisions, rocks, roots, holes, uneven or unstable terrain, fallen limbs or trees, mud, water, changing terrain, wildlife, insects, weather conditions, other participants, course markings, decorations, props, lighting equipment, volunteers, and other natural or man-made hazards.
I understand that some trail hazards may be difficult or impossible to see because the Event takes place at night.
A headlamp or appropriate personal lighting is required, and I accept responsibility for providing adequate lighting and controlling my speed according to trail and visibility conditions.
HAUNTED TRAIL EXPERIENCE
I understand that the Night Serpent 5K is a haunted trail event and may include costumed actors or “haunted creatures,” sudden movements, people hiding in or emerging from dark areas, chasing or approaching participants, loud or unexpected noises, frightening images, decorations, props, lighting effects, and other intentionally surprising or frightening elements.
I understand that these elements, combined with darkness and natural trail conditions, may increase the risk of falls, collisions, injuries, or other accidents.
I voluntarily choose to participate with full knowledge of these conditions and knowingly assume all risks associated with participating in this nighttime haunted trail race.
PARTICIPANT RESPONSIBILITY
I certify that I am physically capable of participating in this Event and accept responsibility for determining whether I am medically and physically prepared to participate.
I agree to follow all Event rules, course markings, and instructions provided by Mamba Trail Runners, race officials, volunteers, medical personnel, and the property owner.
I agree to remain on the designated race course and respect the private property on which the Event is conducted.
RELEASE OF LIABILITY
To the fullest extent permitted by law, I knowingly and voluntarily assume all risks associated with my participation, both known and unknown.
I hereby release, waive, and discharge Mamba Trail Runners, as the host and organizer of the Event; Matt Lewis, as the owner of the private property and trails on which the Event is conducted; and their respective race directors, employees, volunteers, contractors, sponsors, agents, representatives, affiliates, and other individuals or organizations associated with the Event (collectively, the “Released Parties”) from claims or liabilities arising out of or related to my participation in the Event, including claims arising from the ordinary negligence of a Released Party, except to the extent such release is prohibited by applicable law.
EMERGENCY MEDICAL CARE
I authorize Event personnel to obtain or provide emergency medical assistance if reasonably necessary. I understand that I am responsible for medical expenses incurred on my behalf.
PHOTO AND VIDEO RELEASE
I grant Mamba Trail Runners and its authorized representatives permission to photograph, film, or otherwise record me during the Event and to use my image, likeness, and voice for legitimate Event, promotional, advertising, and social media purposes without compensation.
ACKNOWLEDGMENT
I HAVE READ THIS WAIVER AND RELEASE OF LIABILITY, UNDERSTAND ITS TERMS, UNDERSTAND THAT PARTICIPATION IN A NIGHTTIME HAUNTED TRAIL RACE INVOLVES INHERENT RISKS, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS BY AGREEING TO THIS WAIVER.
I ACCEPT THESE TERMS FREELY AND VOLUNTARILY.
