Participant Waiver, Release of Liability & Assumption of Risk
PLEASE READ CAREFULLY. BY REGISTERING FOR OR PARTICIPATING IN THIS EVENT, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTAND, AND AGREE TO THE TERMS OF THIS WAIVER AND RELEASE.

1. Voluntary Participation and Assumption of Risk
I understand that my participation in the From Awareness to Action: Domestic Violence Awareness 5K Walk/Run(“Event”) is voluntary and may involve walking, running, standing, outdoor activity, crowds, uneven or changing surfaces, weather conditions, interaction with other participants, and other conditions associated with a public community event.

I understand that participation in the Event involves inherent and other risks, including, but not limited to, slips, trips, falls, collisions with other participants or objects, physical exertion, dehydration, heat-related illness, adverse weather, course conditions, contact with animals, insects, plants or environmental conditions, and other foreseeable or unforeseeable risks associated with participation in an outdoor walk/run and activities conducted at or near the Event venue.

I knowingly and voluntarily assume the risks associated with my participation in the Event.

2. Participant Health and Responsibility
I understand that I am responsible for determining whether I am physically capable of safely participating in the Event.

I agree not to participate if I know of any physical or medical condition that would make my participation unsafe without appropriate medical clearance.

I agree to exercise reasonable care, follow Event rules and instructions, remain on designated routes and in authorized areas, and comply with reasonable safety directions provided by Event staff, venue personnel, law enforcement, emergency personnel, or authorized Event representatives.

3. Release and Waiver of Liability
To the fullest extent permitted by applicable law, I, on behalf of myself and my heirs, personal representatives, executors, administrators, successors, and assigns, voluntarily release, waive, and discharge the Event organizer(s), Event director(s), participating organizations and agencies, venue and property owner/operator, sponsors, vendors, contractors, volunteers, officers, directors, employees, agents, representatives, and other parties involved in organizing, supporting, hosting, or conducting the Event (collectively, the “Released Parties”) from claims arising from or relating to my participation in the Event, including claims involving personal injury, illness, death, or loss of or damage to personal property, except to the extent such release is prohibited by applicable law.

I understand that this waiver is intended to be as broad and inclusive as permitted under applicable law.

4. Medical Treatment and Emergencies
If I experience an illness, injury, or medical emergency during the Event and I am unable to provide consent at the time treatment is reasonably required, I authorize Event personnel, emergency medical personnel, or other appropriate responders to obtain or provide emergency medical assistance reasonably believed necessary for my immediate care.

I understand that the Event organizer does not guarantee the availability or outcome of medical treatment.

To the extent permitted by law, I understand that I am responsible for medical expenses incurred on my behalf, including emergency transportation, evaluation, treatment, medication, and hospitalization, except where another party is legally responsible for such expenses.

5. Event Rules and Venue Requirements
I agree to comply with all Event rules, course requirements, safety instructions, and applicable policies and requirements established by the Event organizer and Event venue.

I understand that Event officials may restrict or discontinue my participation if they reasonably determine that my continued participation creates a safety concern, violates Event or venue rules, or interferes with the safe operation of the Event.

6. Photography and Media
I understand that photography, video recording, livestreaming, and other media coverage may occur in public areas of the Event.

Unless I have separately opted out where an opt-out is offered, I grant the Event organizer permission to use photographs, video, or recordings in which I appear for legitimate Event-related, educational, promotional, archival, and community-awareness purposes without compensation.

I understand that the Event addresses the sensitive issue of domestic violence and that the Event organizer will make reasonable efforts to communicate designated photography or media procedures. I agree to respect the privacy of other participants and will not photograph, record, interview, or publicly identify another participant as a survivor of domestic violence without that person's permission.

7. Personal Property
I understand that I am responsible for safeguarding my personal belongings during the Event. The Released Parties are not responsible for lost, stolen, misplaced, or damaged personal property except to the extent otherwise required by law.

8. Event Changes, Cancellation, and Refund Policy
I understand that Event details, including the course, schedule, activities, location within the venue, speakers, entertainment, participating organizations, and other elements, may be modified when reasonably necessary because of weather, safety concerns, venue requirements, government directives, emergencies, circumstances beyond the organizer's reasonable control, or other operational needs.

The Event may be postponed, modified, suspended, or canceled when reasonably necessary for participant safety or because of circumstances beyond the organizer's reasonable control.

Registration fees are non-refundable unless otherwise expressly stated by the Event organizer.

If the Event is postponed, modified, or canceled, any available options concerning registration transfers, credits, rescheduling, or other accommodations will be communicated by the Event organizer, subject to applicable venue agreements and law.

Registrations may not be transferred to another participant unless expressly authorized by the Event organizer.

9. Participants Under 18
A participant under the age of eighteen (18) must be registered by a parent or legal guardian.

By registering a minor, the parent or legal guardian represents that they have authority to provide consent for the minor's participation and acknowledges the risks associated with the minor's participation in the Event.

The parent or legal guardian agrees to the terms of this waiver on behalf of themselves and, to the extent permitted by applicable law, on behalf of the participating minor.

10. Acknowledgment and Electronic Agreement
By completing registration, checking the acknowledgment box, signing electronically or physically, or otherwise indicating my acceptance of this waiver, I acknowledge that:

I have carefully read this Participant Waiver, Release of Liability & Assumption of Risk;
I understand its terms;
I understand that participation in the Event is voluntary;
I understand that this document affects legal rights;
I voluntarily assume the risks associated with participating in the Event;
I agree to comply with Event and venue rules; and
I agree to be bound by this waiver to the fullest extent permitted by applicable law.
I understand that my electronic acknowledgment or signature is intended to have the same force and effect as my handwritten signature.
