PARTICIPANT WAIVER, ASSUMPTION OF RISK, RELEASE OF LIABILITY & PHOTO RELEASE
In consideration of being permitted to participate in the Panther Prowl Haunted Color Run, Mini Monster Dash, Trunk-or-Treat, and any related activities (collectively, the “Event”), I acknowledge and agree to the following:
ASSUMPTION OF RISK
I understand that participation in this Event is voluntary and may involve inherent and other risks, including but not limited to running, walking, physical exertion, uneven or changing surfaces, curbs, pavement, grass, gravel, holes, obstacles, slips, trips, falls, contact or collisions with other participants, spectators, volunteers, props or objects, darkness or reduced visibility, traffic or vehicles, weather conditions, heat, cold, wind, rain, loud noises, music, flashing or decorative lighting, bubbles or foam, Halloween decorations, costumed characters, theatrical scares, sudden or startling situations, and exposure to colored powder and other Event materials.
I understand that these and other risks may result in personal injury, illness, property damage, permanent disability, or other loss. I knowingly and voluntarily assume the risks associated with my participation and/or my minor child’s participation in the Event.
I certify that I and/or my minor child are physically capable of participating in the selected Event. I understand that it is my responsibility to determine whether participation is appropriate based upon my or my child’s health, physical condition, abilities, and limitations.
COLOR POWDER WARNING & ACKNOWLEDGMENT
I understand and acknowledge that colored powder will be intentionally thrown, dispersed, or otherwise used during portions of the Event.
I understand that color powder may temporarily or permanently stain or discolor clothing, costumes, shoes, hair, skin, eyeglasses, contact lenses, personal belongings, vehicles, upholstery, or other property. I accept responsibility for any staining, discoloration, cleaning expense, or damage resulting from participation in the Event.
I understand that participation may result in exposure to airborne particles. Individuals with asthma, respiratory conditions, allergies, eye sensitivities, skin sensitivities, or other medical concerns should exercise appropriate caution and determine whether participation is appropriate for them.
Participants should avoid intentionally inhaling color powder and are encouraged to protect their eyes and mouth when passing through color stations.
Costumes are welcome; however, participants are strongly encouraged to wear a plain white T-shirt over costumes or clothing they do not wish to expose to color powder.
HAUNTED COURSE & SCARE WARNING
I understand that the full Panther Prowl Haunted Color Run is intentionally designed to include frightening, startling, and Halloween-themed experiences.
These may include darkness or reduced lighting, costumed characters, actors, sudden noises, music, theatrical scares, props, decorations, fog or similar theatrical effects, and other unexpected or startling situations.
I understand that these experiences may not be appropriate for every participant.
Parents and legal guardians are solely responsible for determining whether the full Haunted Color Run is appropriate for their minor child based upon the child’s age, maturity, temperament, medical needs, and sensitivity to frightening or startling situations.
The Mini Monster Dash is intended to provide a less frightening experience for children age 10 and under; however, Halloween decorations, costumes, crowds, music, noise, bubbles, color powder, and other Event activities may still be present.
EVENT RULES & WAVE STARTS
I agree to follow all Event rules and instructions and all directions provided by Event organizers, race officials, school personnel, law enforcement, volunteers, or other authorized Event personnel.
I understand that participants may be released in designated waves or groups for safety, crowd control, and the proper operation of Event activities. I agree to enter the course only when my assigned wave or group is directed to begin.
I understand that Event officials may delay, redirect, stop, or remove a participant from the course if they reasonably believe doing so is necessary for the safety of the participant or others, or because of unsafe, disruptive, destructive, or inappropriate behavior.
I agree to remain on designated Event routes and understand that leaving the designated course may expose me to hazards that are not controlled or monitored by Event organizers.
PERSONAL PROPERTY
I am responsible for my own clothing, costumes, shoes, phones, watches, jewelry, bags, eyeglasses, vehicles, and other personal belongings brought to the Event.
I understand that the Released Parties identified below are not responsible for personal property that is lost, stolen, stained, damaged, or destroyed in connection with participation in the Event, to the fullest extent permitted by law.
MEDICAL TREATMENT
In the event of illness, injury, or a medical emergency arising during the Event, I authorize Event personnel to provide reasonable emergency assistance and to contact emergency medical services when deemed necessary.
I authorize emergency medical personnel, physicians, hospitals, clinics, or other qualified healthcare providers to provide treatment reasonably considered necessary for my immediate care or the immediate care of my participating minor child when I am unable to provide consent.
I understand and agree that I am responsible for any costs associated with medical evaluation, treatment, medications, ambulance transportation, hospitalization, or other medical services provided to me or my minor child.
RELEASE AND WAIVER OF LIABILITY
To the fullest extent permitted by applicable law, I, on behalf of myself and, where applicable, my participating minor child, voluntarily release, waive, discharge, and agree to hold harmless the Permian High School Tennis Booster Club, its officers, board members, members, volunteers, representatives, and agents; Permian High School; Ector County Independent School District, including its officers, trustees, employees, representatives, agents, volunteers, facilities, and property; the Event Director; RunSignup.com; Event sponsors; vendors; participating booster clubs and organizations; volunteers; contractors; and their respective representatives and agents (collectively, the “Released Parties”) from claims, demands, causes of action, damages, losses, or liabilities arising from the ordinary risks associated with my or my minor child’s voluntary participation in or attendance at the Event, including personal injury and property damage, except to the extent such release or limitation is prohibited by applicable law.
I understand that this release is intended to be binding upon me and, to the extent permitted by law, my heirs, executors, administrators, personal representatives, successors, and assigns.
PHOTO, VIDEO & MEDIA RELEASE
I understand that photographs, video, audio, and other recordings may be made during the Event.
I grant permission for my name, voice, likeness, photograph, video, and/or other image—and, when I am the parent or legal guardian of a participating minor, those of my child—to be photographed or recorded during the Event and used by the Permian High School Tennis Booster Club and other authorized Event or school representatives for legitimate promotional, informational, fundraising, social media, website, print, or other communications purposes without compensation.
I understand that school district policies concerning student photographs, video, and media may also apply.
WEATHER, EVENT CHANGES, CANCELLATION & REFUNDS
Panther Prowl is scheduled to take place rain or shine. The safety of our participants, volunteers, sponsors, staff, and community is our highest priority.
The Permian High School Tennis Booster Club, in coordination with Permian High School/ECISD and appropriate public safety officials, reserves the right to delay, modify, shorten, postpone, relocate, suspend, or cancel any portion of the Event due to severe weather, lightning, unsafe field or course conditions, emergencies, governmental or school district requirements, operational needs, or other circumstances beyond the reasonable control of Event organizers.
Whenever reasonably possible, Event organizers will make every effort to delay or modify activities rather than cancel the Event entirely. This may include changes to the course, schedule, wave assignments, activities, attractions, start times, or other Event details.
Registration fees are non-refundable, including if a participant chooses not to attend or is unable to participate, or if the Event is delayed, modified, postponed, relocated, suspended, or canceled due to circumstances beyond the reasonable control of Event organizers. Panther Prowl is a nonprofit fundraising event benefiting the Permian High School Tennis program, and registration proceeds may be committed in advance to Event expenses and program support.
If Panther Prowl is postponed to a rescheduled date, existing registrations will automatically transfer to the new date. Event organizers may, at their discretion, provide additional options to registered participants when circumstances allow.
Registrations, race bibs, and participant entries are non-transferable unless Event organizers expressly authorize a transfer.
T-shirt sizes are requested during registration; however, availability of a particular size cannot be guaranteed for registrations received after any published shirt-order deadline.
Weather-related or other important Event updates will be communicated to registered participants through RunSignup and/or official Panther Prowl communication channels.
MINOR PARTICIPANTS
If I am registering a participant under the age of 18, I certify that I am the participant’s parent or legal guardian, or otherwise possess legal authority to provide the permissions contained in this agreement.
I understand that I am responsible for determining whether participation is appropriate for the minor.
Children participating in the Mini Monster Dash must have a responsible parent or guardian remain on-site during the Event. Parents and guardians remain responsible for the supervision of their children before and after participation and during all other Event activities.
ACKNOWLEDGMENT
I acknowledge that I have carefully read and understand this Participant Waiver, Assumption of Risk, Release of Liability & Photo Release.
I understand the nature of the Event and the risks associated with participation, including the specific risks associated with physical activity, darkness, Halloween scare elements, color powder, crowds, weather, course conditions, and other Event activities.
I voluntarily choose to participate and/or permit my minor child to participate with knowledge of those risks.
By completing registration, I acknowledge that I have read, understand, and agree to the terms of this Participant Waiver, Assumption of Risk, Release of Liability & Photo Release, including the Weather, Event Changes, Cancellation & Refund Policy.
