PARTICIPANT WAIVER, ASSUMPTION OF RISK, RELEASE OF LIABILITY, MEDICAL AUTHORIZATION, PHOTO RELEASE, AND REFUND POLICY
I wish to participate in the Cocoa Classic 5K (the “Event”) on November 8, 2026, at Washington University in St. Louis. The Event is hosted by the Alpha Epsilon Pi Sigma Chapter and Cocoa Classic. I understand that participation in the Event is voluntary and that the Event involves strenuous physical activity and certain inherent dangers, hazards, and risks.
In consideration of the acceptance of my entry, and intending to be legally bound, I hereby waive and forever release any and all rights and claims for damages, injuries, losses, liabilities, costs, or expenses that I may have against Washington University in St. Louis, its governing board, officers, agents, employees, students, volunteers, Campus Life, the Alpha Epsilon Pi Sigma Chapter, Cocoa Classic, the Event Director, RunSignup.com, Big River Race Management, all sponsors, their representatives, all persons assisting with the Event, race officials, medical personnel, volunteers, and employees, and all other persons or entities acting in any capacity on their behalf (collectively, the “Releasees”), for any and all injuries, illness, death, or damage to me or my personal property arising out of or related to my participation in, attendance at, travel to or from, or presence at the Event. This release includes all injuries and/or damages suffered by me before, during, or after the Event. I understand and intend that this release is binding on my family, heirs, executors, administrators, personal representatives, and assigns.
I understand and appreciate the dangers, hazards, and risks inherent in participating in a 5K road race and related activities. These risks include, but are not limited to, falls; contact with other participants, spectators, volunteers, vehicles, animals, or other natural or manmade objects; lack of hydration; uneven or irregular surfaces; slips and falls; course conditions; vehicular traffic; equipment failure; water hazards; effects of weather, including high heat, cold temperatures, rain, or storms; injury resulting from physical exertion, including but not limited to sprains, pulled muscles, broken bones, illness, serious injury, or death; transportation to, from, and around the Event area; crimes; accidents; natural disasters; riots; terrorist activities or attacks; and any risks associated with independent activities I undertake as an adjunct to the Event. I acknowledge that all such risks are known and understood by me.
I know that running a road race is a potentially hazardous activity. I should not enter and participate unless I am medically able to do so and properly trained. I certify as a material condition of being permitted to enter and participate in this Event that I am physically fit, sufficiently trained, and able to safely complete this Event, and that there are no health-related reasons or problems which preclude or restrict my participation. I understand that it is my sole responsibility to determine whether I am sufficiently fit and healthy enough to participate, and I assume all risk and responsibility for my physical condition, medical needs, and participation.
Knowing the conditions, dangers, hazards, and risks of the Event, and in consideration of being permitted to participate, I voluntarily assume all risks and responsibilities surrounding my participation in the Event. On behalf of myself, my family, heirs, executors, administrators, personal representatives, and assigns, I release, waive, forever discharge, and covenant not to sue the Releasees from and against any and all liability for any harm, injury, illness, death, damage, claim, demand, action, cause of action, cost, or expense of any nature whatsoever that I may have or that may hereafter accrue to me, arising out of or related to any loss, damage, or injury sustained by me or my property in connection with the Event, whether caused by the negligence or carelessness of any of the Releasees or otherwise, to the fullest extent permitted by law.
I understand that Washington University in St. Louis does not require me to participate in the Event, and that neither the University nor any student, faculty member, staff member, administrator, volunteer, sponsor, or other participant is acting as a guardian of my safety. I understand that I am solely responsible for my own safety and conduct during the Event.
I agree to abide by all oral and written instructions, all decisions of race officials, and all applicable laws, ordinances, and policies, including Washington University policies and behavioral standards, during my participation in the Event. I understand that I am expected to behave in a manner consistent with applicable University rules and policies. I understand that the use or possession of illegal drugs, including marijuana, may have serious legal consequences, and that it is unlawful for me to consume alcohol if I am under the age of 21. I agree to obey all laws and ordinances of the applicable jurisdiction during my participation in the Event.
I agree that race officials and Event personnel may make decisions concerning my ability to safely begin or continue participation in the Event, and I agree to abide by all such decisions.
In the event of illness, injury, or medical emergency arising during or in connection with the Event, I hereby authorize and give my consent to the Event Director and/or the Releasees to secure from any accredited hospital, clinic, emergency responders, and/or physician any examination, treatment, or medical care deemed necessary for my immediate care. I grant permission to the Releasees to authorize emergency medical treatment for me if reasonably necessary. I understand and agree that I will be fully and solely responsible for payment of any and all medical services and treatment rendered to me, including but not limited to ambulance or medical transport, medications, treatment, hospitalization, physician services, and related expenses. I understand that neither Washington University in St. Louis nor any other Releasee assumes legal or financial responsibility for such treatment or costs.
As it applies to my participation in this Event, I agree to abide by any applicable public health and safety guidance and any health, safety, or communicable disease protocols issued by federal, state, local, University, or Event authorities in effect at the time of the Event, including any guidelines or requirements relating to COVID-19 or other public health concerns.
Further, I grant permission to the Releasees to use my name, voice, photograph, image, likeness, and race results in any photographs, motion pictures, recordings, broadcasts, publications, websites, social media, promotional materials, or other print, videographic, digital, or electronic record of the Event for legitimate purposes, without compensation or further approval.
This Event follows the standard running industry policy: all entry fees are non-refundable. The Event reserves the right to postpone, cancel, modify, or delay the Event due to circumstances beyond its control, including but not limited to severe weather, natural disaster, emergency, public health concerns, governmental orders, unsafe conditions, or any other reason deemed necessary to protect the safety of participants, staff, or the public. No refunds will be issued under such circumstances. The Event reserves the right to change the details of the Event without prior notice. I understand that my entry fee is non-refundable and that bib numbers are non-transferable.
I further agree to save, indemnify, defend, and hold harmless the Releasees from and against any claim by me or my family arising out of or related to my participation in or attendance at the Event.
I warrant that I have carefully read this agreement, fully understand its contents and significance, understand that it is contractual in nature and not a mere recital, and sign or accept it freely and voluntarily as my own act.
I certify that I am at least eighteen (18) years of age and fully competent to agree to this waiver and release.
THIS IS A RELEASE OF LEGAL RIGHTS. READ IT CAREFULLY AND BE CERTAIN YOU UNDERSTAND IT BEFORE AGREEING.
By submitting this entry, I acknowledge that I have read, understood, and agreed to the above waiver and release, including the assumption of risk, medical authorization, photo release, and no-refund policy.
