RELEASE AND WAIVER OF LIABILITY, ASSUMPTION OF RISK, INDEMNITY, AND MEDIA RELEASE

In consideration of you accepting this entry, I, the participant, intend to be legally bound and agree as follows. This agreement is binding on me and on my heirs, executors, administrators, and assignees.

1. Released Parties. This release covers Auburn Inked, Inc., doing business as Lovebomb Studios and Inked House Dallas, and its owners, officers, directors, employees, independent contractors, volunteers, and agents; the Event Director; RunSignup.com; the City of Lewisville, its officers, agents, employees, and volunteers; all sponsors and their representatives; and all other persons or entities assisting with the event (together, the "Released Parties").

2. The Course. The race starts and finishes at Pavilion #3 in Central Park. The course follows the Central Park hike-and-bike trail and may continue onto the connecting Timber Creek Trail. These are public trails that stay open to the public during the event. Conditions may include paved and unpaved surfaces, uneven ground, curbs, roots, slopes, debris, wet or muddy sections, pedestrians, cyclists, pets, and wildlife. The organizers may change the course or other event details without prior notice.

3. Assumption of Risk. I know that running a race is a potentially hazardous activity. I should not enter and run unless I am medically able to do so and properly trained. I assume all risks associated with this event, including but not limited to falls, contact with other participants, spectators, or members of the public, the effects of weather and heat, and course and trail conditions. I acknowledge that I know and understand all such risks. I KNOWINGLY AND VOLUNTARILY ASSUME ALL SUCH RISKS, INCLUDING RISKS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES.

4. Fitness and Race Officials. As a material condition of entry, I certify that I am physically fit and sufficiently trained to complete this event. I agree to abide by all decisions of any race official about my ability to safely complete the run. I also agree to follow all event rules, staff and volunteer instructions, and City of Lewisville park rules.

5. Medical Treatment. If I have an illness, injury, or medical emergency during the event, I authorize the Event Director to obtain from any accredited hospital, clinic, or physician whatever treatment is deemed necessary for my immediate care. I will be fully responsible for paying for all medical services, including medical transport, medications, treatment, and hospitalization.

5A. RELEASE AND WAIVER. I HEREBY WAIVE, RELEASE, AND FOREVER DISCHARGE THE RELEASED PARTIES FROM ANY AND ALL RIGHTS, CLAIMS, DEMANDS, AND LIABILITY FOR INJURY, ILLNESS, DEATH, OR DAMAGE TO ME OR MY PERSONAL PROPERTY SUFFERED BEFORE, DURING, OR AFTER THE EVENT, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES, TO THE FULLEST EXTENT PERMITTED BY LAW.

6. INDEMNITY. I AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS THE RELEASED PARTIES FROM ANY CLAIM, LOSS, OR EXPENSE, INCLUDING ATTORNEYS' FEES, ARISING FROM MY PARTICIPATION OR CONDUCT IN THE EVENT, INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF THE RELEASED PARTIES.

7. Photo, Video, and Likeness Release. I grant Auburn Inked, Inc., doing business as Lovebomb Studios and Inked House Dallas, together with its affiliates, sponsors, and assigns, the irrevocable, perpetual, worldwide, royalty-free right to photograph, film, and record me. They may use my name, voice, image, likeness, and results in any photographs, videos, publications, social media, websites, advertising, marketing, or other print, video, or electronic media now known or later developed, for commercial or promotional purposes. This use requires no compensation, notice, or approval from me. I waive any claim for invasion of privacy or right of publicity arising from such use.

8. Charitable Purpose. Net proceeds will be donated to the National Breast Cancer Foundation, Inc. ("NBCF"). The event is independently organized by Auburn Inked, Inc. NBCF is not the organizer and is not responsible for the event.

9. Refunds and Cancellation. All entry fees are non-refundable, and bib numbers are non-transferable. The organizers may postpone, modify, or cancel the event for circumstances beyond their control, including weather, natural disaster, emergency, or to protect the safety of participants and staff. No refunds will be issued in those circumstances.

10. Minors. For any participant under 18, the parent or legal guardian who submits this entry agrees to these terms on the minor's behalf. That parent or guardian also agrees to indemnify the Released Parties for any claims brought by or on behalf of the minor and consents to the media release for the minor.

11. Governing Law. This agreement is governed by Texas law, with venue in Denton County, Texas. If any part of this agreement is found unenforceable, the rest remains in full effect.

BY SUBMITTING THIS ENTRY, I (OR MY PARENT OR LEGAL GUARDIAN, IF I AM UNDER 18) ACKNOWLEDGE HAVING READ AND AGREED TO THIS RELEASE AND WAIVER, INCLUDING THE NO-REFUND POLICY, AND UNDERSTAND THAT I AM GIVING UP SUBSTANTIAL LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
