MILES THAT MATTER 5K PARTICIPANT WAIVER, RELEASE, AND EVENT POLICIES

Please read this agreement carefully. It affects important legal rights.

This agreement applies to every person included in this registration transaction and covers participation in any Miles That Matter 5K event, including the in-person 5K Run and Walk, Kids Fun Run, Virtual 5K, and related activities held before, during, or after the event.

In consideration for each registered participant being permitted to participate, I agree to the following:

AUTHORITY TO AGREE
I am agreeing to this waiver for myself and every participant included in this registration transaction.

For each participant under age 18, I certify that I am the participant’s parent or legal guardian, or that I have legal authority to register the child and provide the required consent.

For each adult participant other than myself, I certify that I have provided or will provide that participant with this entire agreement, that the participant has authorized me to complete the registration, and that the participant knowingly agrees to its terms. I understand that every participant is bound by the event rules and policies described in this agreement.

PARTICIPANT FITNESS AND RESPONSIBILITY
Running, walking, and participating in athletic events can be physically demanding and potentially hazardous. Each participant is responsible for determining whether they are physically able to participate safely and for obtaining medical advice when appropriate.

Each participant agrees to follow event rules, course markings, posted instructions, safety directions, and decisions made by event officials. Event personnel may delay, modify, stop, or prevent a participant’s participation if they reasonably believe that conditions are unsafe or that the person cannot participate safely.

A parent or legal guardian remains responsible for supervising their child before, during when appropriate, and after the Kids Fun Run. The Kids Fun Run is a recreational athletic activity and is not a childcare service.

ACKNOWLEDGMENT AND ASSUMPTION OF RISK
I understand that participation may involve known and unknown risks, including falls, slips, uneven surfaces, road or trail conditions, traffic, vehicles, bicycles, strollers, animals, weather, heat, humidity, dehydration, overexertion, illness, physical contact with other participants, crowds, equipment, and the acts or omissions of participants or other persons.

I knowingly and voluntarily accept these risks for myself and acknowledge them on behalf of every minor participant included in this transaction.

VIRTUAL PARTICIPATION
The Virtual 5K is completed independently at a time, location, pace, and route selected by the participant. The Working Moms of San Antonio Foundation does not inspect, supervise, close, mark, or provide traffic control, security, hydration, medical support, or course monitoring for a participant’s selected virtual route.

Each virtual participant is solely responsible for selecting a lawful and reasonably safe route, following traffic and property laws, remaining aware of their surroundings, obtaining any required permission, and using appropriate safety precautions. A parent or legal guardian is responsible for selecting and supervising the route and activity of a minor virtual participant.

RELEASE OF LIABILITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, I RELEASE, WAIVE, AND DISCHARGE THE WORKING MOMS OF SAN ANTONIO FOUNDATION, RUNSIGNUP, IAAP, THE CITY OF SAN ANTONIO, EVENT SPONSORS, VENDORS, VOLUNTEERS, CONTRACTORS, PROPERTY OWNERS, VENUE OPERATORS, AND EACH OF THEIR RESPECTIVE DIRECTORS, OFFICERS, EMPLOYEES, REPRESENTATIVES, AGENTS, SUCCESSORS, AND ASSIGNS, COLLECTIVELY THE “RELEASED PARTIES,” FROM CLAIMS, LIABILITIES, DAMAGES, OR LOSSES ARISING FROM OR RELATED TO PARTICIPATION IN THE EVENT, INCLUDING CLAIMS ARISING FROM THE ORDINARY NEGLIGENCE OF A RELEASED PARTY.

I agree to this release for myself and, to the fullest extent permitted by law, on behalf of every minor participant included in this transaction. This release does not apply to conduct that cannot legally be released under applicable law.

MEDICAL CARE
If a participant becomes ill or injured and is unable to provide consent, I authorize event personnel to contact emergency services and arrange reasonably necessary emergency assistance or transportation.

I understand that the Working Moms of San Antonio Foundation does not provide medical insurance for participants. The participant, parent, or legal guardian is responsible for medical and transportation costs incurred on the participant’s behalf.

I understand that the Foundation does not provide on-site medical assistance, route supervision, or emergency support for Virtual 5K participation.

EVENT CONDITIONS AND POLICIES
I understand and agree that:

• The in-person events are scheduled to occur rain or shine. The Foundation may delay, modify, relocate, convert to a virtual format, postpone, or cancel an event because of weather, emergencies, governmental instructions, unsafe conditions, or circumstances beyond its reasonable control.

• Registration fees, donations, and shipping charges are nonrefundable, including when an event is modified or canceled because of circumstances beyond the organizer’s reasonable control.

• Registration transfers must be completed through the official RunSignup transfer process by April 23, 2027. Giving, selling, or transferring a race bib outside the official process is prohibited.

• Strollers are permitted only when allowed by the venue and event officials. Participants using strollers must begin toward the back and exercise appropriate care.

• Pets are not permitted on the in-person event course, except trained service animals as allowed by law.

• The Virtual 5K must be completed during the published completion window of April 24 through May 9, 2027.

• An official race shirt is included only with registrations completed by March 31, 2027 at 11:59 PM Central. Shirts are ordered specifically for eligible registered participants. Registrations completed after this deadline will not include a shirt. Shirt selections cannot be added or changed after the deadline. If a registration is officially transferred after the deadline, the original shirt size and availability will remain attached to that registration. Shirts have no cash value and are not eligible for refunds, substitutions, or guaranteed exchanges.

• The Foundation is not responsible for virtual packet shipping delays, loss, theft, damage, or incorrect delivery resulting from inaccurate information supplied during registration or circumstances outside the Foundation’s reasonable control.

• Virtual results may be participant-reported and are not independently monitored or certified by the Foundation.

• Event details may be reasonably modified to protect participant safety or accommodate operational requirements.

PHOTOGRAPHY, VIDEO, AND EVENT RESULTS
I understand that photographs, video, audio, and race results may be created during the in-person events. I grant the Working Moms of San Antonio Foundation and its authorized representatives permission to use the name, voice, likeness, image, participation, and event results of each registered participant for legitimate event, educational, promotional, archival, and charitable purposes without additional compensation.

If I or a registered participant has a significant privacy or safety concern, I understand that I may contact the event organizer before the event to request reasonable accommodation. I understand that the organizer cannot guarantee exclusion from incidental crowd photography or public race results.

If a Virtual 5K participant voluntarily submits photographs, video, comments, or other content, I grant the Foundation permission to use the submitted content for the same purposes. I will not submit content depicting another person, particularly a minor, unless I have permission to do so.

ACKNOWLEDGMENT AND ELECTRONIC ACCEPTANCE
I confirm that I have read this entire agreement and understand its terms. I understand that it includes an assumption of risk and release of substantial legal rights.

I enter into this agreement knowingly and voluntarily for myself and in the capacities described above. I intend my electronic acceptance to have the same effect as my handwritten signature.

If any provision of this agreement is found unenforceable, the remaining provisions will continue to the fullest extent permitted by law.
